Brelsford This Indenture Made the fourteenth day of May in the year of our Lord one thousand Seven hundred and Seventy Six Between James Barber of the Township of Bristol in the County of Bucks and province of Pennsylvania Mason and Rebecca his wife of the one part and John Breslford of the same place Carpenter of the other part Whereas Henry Mitchell late of the Township of Bristol and County of Bucks aforesaid in Lifetime and at the time of his decease Stood Lawfully seized and possessed of in and to a certain Tract or parcel of Land Lying and being situate in the said Township of Bristol Containing Five Hundred and Thirty one acres and a quarter And Whereas the said Henry Mitchell being thereof so seized as aforesaid died intestate leaving lawful issue Several sons and daughters among them were Henry Mitchell and Elizabeth Mitchell (Afterwards Elizabeth Barber and Mother to James Barber party to these presents) And Whereas the said Henry his son by virtue of So many good coveyances available in Law as well as in his own right (being one of the coheirs of the said Henry the Elder) became Lawfully seized and possessed of all the above mentioned Two Hundred and thirty one acres and a quarter of Land with all and Singular the appurtenances thereunto belonging except the share and purpart of his sister the aforesaid Elizabeth who Intermarried with James Barber Father to James Barber party to these presents And Whereas the said Henry the younger being Lawfully seized as aforesaid of all the Two Hundred and Thirty one Acres and a quarter of land (except as above excepted) died Intestate Leaving Issue To wit Three sons and one Daughter And Whereas the said James Barber father and soon after his said Wife Elizabeth died Intestate leaving Lawful Issue Three sons and Two daughters to wit James Barber (party to these presents) Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands, And Whereas no Division of the said Real Estate of Henry Mitchell the elder having been made Between the said Henry Mitchell the younger and his sister in their lifetime but some time after to wit on the 24th March 1774 by Certain Indentures of Partition, Release and Quit claim made and duly executed under the hands and seals of the coheirs and Representatives of the said Henry Mitchell the younger was Released and confirmed unto the said James Barber party to these present by Joseph Barber Henry Barber Elizabeth Moore and Mary Sands (coheirs of the said Elizabeth Barber) and to their heirs and assigns forever the Following described Tract or piece of Land as their share of the Real Estate of their Grandfather the said Henry Mitchell the elder, which they claimed in right of their Mother Elizabeth Barber aforesaid Viz Beginning at Stake six perches westward of a Spanish Oak marked for a corner of Bodines Land on Newtown Road thence extending North seventy two degrees and Thirty minutes East ninety one perches into the Mill creek thence South nineteen degrees East fifty eight perches and one tenth of a perch thence South Seventy degrees and Thirty minutes West ninety one perches to a Tree marked for a corner thence North nineteen degrees West fifty eight perches to the place of beginning Containing Thirty three Acres part of the above mentioned Two Hundred and Thirty one acres and a quarter And Whereas the said Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands by certain Indentures bearing date the 25th March 1774 for the consideration therein mentioned did grant bargain sell release convey and confirm unto the said James Barber party to the these presents and to his heirs and assigns forever as the above described Tract of Land Containing as aforesaid Thirty Three Acres Now This Indenture Witnesseth that the said James Barber and Rebecca his wife for and in consideration of the sum of Two Hundred and forty five pounds Lawful money of Pennsylvania to their hand paid at or before the executing and --- hereof by the said John Brelsford the receipt whereof they the said James Barber and Rebecca his wife as hereby acknowledged and thereof and every part thereof do acquit and forever discharge them the said John Brelsford his heirs Executors Administrators and Assigns by these presents Have granted bargained sold --- released conveyed and confirmed and by these presents do grant bargain sell alien release convey and confirm unto the said John Brelsford his heirs and assigns all that above described Tract or piece of Land butted and bounded as above described Containing Thirty three acres be the same more or less Together with all and Singular the Buildings, Houses, Orchards, Gardens, land, Meadows, woods, waters, ways, water, watercourses, possessions, Emoluments Whatsoever to the said Thirty Three Acres of Land or and part thereof belonging or in any wise appertaining and also the reversions and remainders Rents, issues, and profits thereof and all the Estate right Title interest property claim and --- whatsoever of them the said James Barber and Rebecca his wife of and to the hereby granted premises or any part thereof To have and to Hold the said described Thirty three Acres of Land or be the same more or Less hereby granted or mentioned to be granted with the appurtenances thereunto belonging unto the said John Brelsford his heirs and assigns to the only proper use and behoof of him the said John Brelsford his heirs and assigns forever under the yearly quit rent hereafter to become due for the said thirty three Acres of Land to the chief Lord or Lords of the fee thereof And the said James Barber and Rebecca his wife for themselves and their heirs the same described Thirty three Acres of Land hereditaments and premises hereby granted mentioned or intended to be granted with the appurtenances thereunto belonging unto him the said John Brelsford and to his heirs And assigns against them the said James Barber and Rebecca his wife and their Heirs and against all and every other person or persons whomsoever lawfully claiming or to claim by from or --- them or any of the of them Shall and and --- forever afirm by these presents In witness whereof the parties to these presents have hereunto interchangeably set their hands and Seals the day and year first above written Sealed and Delivered in the presence of us James Barber Thos. Hartshorn Joseph Hall Rebecca Barber Received on the day of the within day of the within mentioned John Brelsford the sum of Five thousand & forty five pounds being the full consideration money within mentioned James Barber Witness Joseph Hall Rebecca Barber Bucks County Be it remembered that on the 14th day of May in the year of our Lord 1776 before me Hugh Hartshorn Esq. one of the Justices of the Peace for the said County of Bucks came the said James Barber and Rebecca his wife and acknowledge the with writing to be their act and deed and desire the same may be --- --- --- the said Rebecca being of full age Severally and apart examined and the contents make known unto her according to law Witness may hand and seal the day and year above written Hugh Hartshorn Recorded September 1st 1857
