Indenture: Ed Smith to Jos Kirkbride, 1689/97 This indenture made the tenth day of the third month one thousand six hundred eighty and nine being the fifth year of the reign of James the second over England as King between Edward Smith of Burlington in the province of West Jersey yeoman of the one part and Joseph Kirkbride of the county of Bucks and province of Pennsylvania linen weaver on the other part Witnesseth that the said Edward Smith for and in consideration of the sum of thirteen pounds ten shillings on hand paid by the said Joseph Kirkbride unto the said Edward Smith the receipt whereof the said Edward Smith doth hereby acknowledge and thereof doth acquit exonerate and discharge the said Joseph Kirkbride his heirs executors and administrators by these presents he the said Edward Smith hath given granted aliened bargained sold enfeoffed and confirmed and by these presents doth give grant alien bargain sell enfeoff and confirm unto the said Joseph Kirkbride his heirs and assigns a certain tract of land lying an being in the county of Bucks aforesaid and now in the tenure & occupation of the said Joseph Kirkbride or his assigns beginning at a corner post of Robert Lucas land thence by the same east two hundred eighty four perches thence south eighty five perches thence west two hundred eighty four perches from thence north by a line of trees eighty five perches to the place of beginning containing and laid out for one hundred and fifty acres of land granted by virtue of a warrant bearing date the twenty eight day of the fourth month 1683 & laid out by the surveyor generals order the day and year unto Edward Smith renter and confirmed by William Markham & John Goodson commissioners to grant lots and lands for William Penn proprietarie governor of the said province to the said Edward Smith his heirs assigns forever by these letters patent bearing date the sixth day of the second month of April in the fifth year of the reign of James the second over England are King and ninth of the proprietaries government 1689 and all the estate right title intrest propertie claim and demand of him the said Edward Smith of in and to the said premises with their appurtenances To have and to hold the said one hundred and fifty acres of land with there appurtenances and every part and parcel of the same to the said Joseph Kirkbride his heir4s and assigns forever at or under the yearly rents of one english silver penny or the value thereof in coin current for each acre of the said one hundred and fifty acres of land to the proprietor and his heirs at and upon the first day of the first month in every year forever at the towne of Pennsbury in the county of Bucks aforesaid to such persons as shall be from time to time appointed for that purpose and the said Edward Smith doth covenant and grant for himself and his heirs that they the said lands and premises unto him the Joseph Kirkbride and his heirs against him the said Edward Smith and his heirs shall and will warrant and defend by these presents forever and also that he the said Edward Smith his heirs and assigns shall and will at any time & times within the space of seven years now next ensuing at the reasonable cost & charges of him the said Joseph Kirkbride his heirs and assigns make do & execute all and every such further and other act & acts thing and things conveyances and assurances in the law whatsoever for he further better and surer making & conveying the said lands & premises unto the said Joseph Kirkbride his heirs and assigns or by his or there counsel learned in the law shall by lawfully and reasonably devised advised and requried Provided always that the person or persons so requested to make such further conveyances or assurances be not compelled or compellable for the doing thereof to travel further than ten english miles from their respective habitations or places of abode at the time of such request made or enter in any other or further covenant or warrantie for his or their heirs but against their own respective act o& acts and against the acts of their respective heirs In witness whereof the said Edward Smith hath to the present month 1697 the within conveyance was by me delivered in open court of the aforesaid county unto the within named Joseph Kirkbride Certified under my hand Phineas Pemberton Co Com Recorded 8th day 2 month 1697 Know all men by these presents that I Edward Smith do appoint my true and trusty friend Phineas Pemberton to be my lawful attorney to deliver in open court a certain deed of a hundred and
