Deed: Saml Burges et al to Ed Mayos, 1706 To all People to whom these presents shall come Samuel Burges of ye County of Bucks Carpenter and Daniel Burges and John Burges both of ye same County of Bucks and Province of Pennsylvania Yeoman Sendeth Greeting Whereas Israel Taylor son and heir of Christopher Taylor decd and Joseph Taylor ye other son of ye said Christopher and Isaac Morris and David Lloyd Executors of ye testament of Thomas Lloyd deceased by their Deed Poll duly executed under their hands and seals dated ye Second day of February Anno Domini 1701/2 for ye consideration mentioned did grant and confirm unto Thomas Yardley a certain tract of land Situate in ye aforesaid County of Bucks Containing five hundred and sixty two acres to hold to him ye said Thomas Yardley his heirs and assigns forever as by ye said Deed recorded in ye Rolls office for ye said County in Book C Vol 1 page 78 etc may at large appear by virtue of which Deed Poll ye said Thomas Yardley became lawfully seized of and in ye tract of land in his demisne as of fee and being so thereof seized he ye said Thomas Yardley did make his last will and testament in writing dated ye twenty seventh day of ye eleventh Month 1703/4 and thereby did amongst other things devise in these words to wit Item it is my will and mind that my wife sell all my lands and of ye same testament did appoint his said wife sole executrix and soon after died as aforesaid seized of ye premises after whose decease ye same testament was duly proved And whereas William Brown of ye town of Chichester and Province aforesaid Yeoman and Esther his wife sole Executrix of ye Testament of Thomas Yardley aforesaid her former husband decd by virtue of which testament and ye power thereby unto ye said Esther granted they ye said William Brown and Esther has by one Indenture under their hands and seals bearing date ye third day of May Anno Domini 1705 for ye consideration therein mentioned did grant and confirm unto John Rowland to hold to him his heirs and assigns forever as by ye said Indenture recorded in ye Rolls office for Bucks Book C Vol 1 page 232 etc may more at large appear And whereas ye said John Rowland did grant and confirm unto ye above named Saml, Daniel and John Burges one hundred acres of ye abovesaid tract of five hundred and sixty two acres as by an Indenture under ye hand and seal of ye said John Rowland ye first day of March Ano Domini 1705 may appear Now Know Ye that ye Samuel Burges Daniel Burges and John Burgess for and in consideration of ye sum of fourteen pounds of current silver money of Pennsylvania to them in hand paid by Edward Mayos of ye town of Bristol in ye County and Province aforesaid Yeoman the receipt whereof they ye said Samuel Daniel and John Burges do hereby acknowledge and thereof and every part thereof do acquit exonerate and discharge ye said Edward Mayos his heirs and assigns forever by these presents have granted bargained sold aliened enfeoffed and confirmed and by these presents do fully clearly and absolutely grant bargain sell alien enfeoff and confirm unto ye said Edward Mayos his heirs and assigns thirty three acres fifty three perches and one third of a perch of land out of ye upper or back part of ye said one hundred acres last above mentioned which said land is Situate and bounded as is herein set down vizt Beginning at a post standing in ye line of ye said one hundred acres thence running North Northwest by ye land of John Rowland eighty seven perches and one third of a perch to a corner post thence Northeast thirty nine degrees Sixty eight perches to a corner post by ye land of ye said John Rowland then South Southeast eighty seven perches and one third of a perch to a corner post thence by a line running parallel to ye upper head line sixty eight perches to ye first mentioned post Containing thirty three acres fifty three perches and one third of a perch as above said And he ye said Edward Mayos shall have free liberty and permission for ye fall of waters and drainage for ye said thirty three acres fifty three perches and one third of a perch of land downwards through ye lands of ye said Samuel Daniel and John Burges without ye let or interruption therein or any of them Together with all ye woods ways watercourses waters hawkings huntings fishings fowlings rights liberties privileges advantages hereditaments and appurtenances to ye said thirty three acres fifty three perches and one third of a perch of land belonging or in any wise and all ye estate right title interest use possession property claim and demand whatsoever of them ye said Samuel Daniel and John Burgess of in and to ye same with ye reversions remainders rents issues and profits thereof To Have and To Hold ye said thirty three acres and fifty three perches and one third of a perch of land and all other ye premises hereby granted mentioned or intended to be hereby granted with their appurtenances unto ye said Edward Mayos his heirs and assigns to ye only use and behoof of him ye said Edward Mayos his heirs and assigns forever Under ye yearly rents due or to become due to ye proprietary or Chief Lord of ye fee thereof And ye said Samuel Daniel and John Burges and their heirs ye said thirty three acres fifty three perches and one third of a perch of land premises hereby granted with ye appurtenances unto ye said Edward Mayos his heirs and assigns against them ye said Samuel Daniel and John Burges and their heirs and against all other persons whatsoever lawfully claiming or to clam by from or under them or any of them shall and will warrant and forever defend by these presents, And ye said Samuel Burgess Daniel Burges and John Burges do for themselves their executors and administrators covenant promise and grant to and with ye said Edward Mayos his heirs and assigns by these presents that they ye said Samuel, Daniel and John Burges and their heirs and all and every other person and persons whatsoever lawfully claiming or to claim ye said thirty three acres fifty three perches and one third of a perch of land and premises hereby granted or any part or parcel thereof shall and will at any time hereafter upon ye reasonable request costs and charges in law of ye said Edward Mayos his heirs or assigns make execute and acknowledge or case so to be all and every such farther and other reasonable act and acts deed or deeds device or devices in law for ye further and better assurance and confirmation of ye said thirty three acres and fifty three perches and one third of a perch of land and premises hereby granted with ye appurtenances unto ye said Edward Mayos his heirs and assigns as by him or them or by this or their counsel learned in ye law shall be reasonably devised advised or required. In Witness whereof they have hereunto set their hands and seals the eleventh day of December in ye fifth year of ye reign of our Sovereign Lady Ann over England etc Queen Anno Domini 1706. (seal) Daniel Burges (seal) John Burges (seal) Sealed and Delivered in ye presence of us Jno Rowland Roger Moone Be it remembered that ye Eleventh day of December in ye year of our Lord one thousand seven hundred and six before me Joseph Kirkbride one of ye Justices of ye Peace of ye County of Bucks came ye within named Samuel Burges Daniel Burges in their proper persons and then and their brought this writing or conveyance which they acknowledge to be their Deed and desired that ye same may be enrolled or recorded as their deed according to an act of Assembly of this Province lately made and provided. Joseph Kirkbride (seal) Be it remembered that I Jeremiah Langhorne Recorder of Deeds for ye County of Bucks was present when ye above named Samuel Burgess Daniel Burges and Jon Burges did before ye said Justice acknowledge ye said writing to be their deed whereupon ye said Justice having certified ye said acknowledgment made ye day and year and manner aforesaid did deliver ye said writing to me to be entered of record and ye same is recorded ye twenty seventh day of December 1706.
