year of our Lord One thousand Seven hundred and Seventy four Between Henry Mitchell of the Township of Bristol in the County of Bucks and Province of Pennsylvania Mason Richard Mitchell of the Township County and Province aforesaid Mason John Mitchell of the Township of Middletown In the County and Province aforesaid Carpenter son of Henry Mitchell late of Bristol Township aforesaid Blacksmith deceased and Joshua Wright and Sarah his wife formerly Sarah Mitchell Daughter of said deceased Henry Mitchell and Grandchildren of Henry Mitchell Late of the Township of Bristol aforesaid in the County and Province aforesaid Carpenter deceased of the one part and James Barber of the Township of Bristol in the County of Bucks and Province of Pennsylvania Mason Joseph Barber of the City and County of Burlington in the Western Division of the Province of New Jersey Carpenter, Henry Barber Mill Wright, Elizabeth Moore relict and widow of Peter More late deceased and Mary Sands Widow and relict of Stephen Sands deceased Children of James Barber and Elizabeth his wife both Lately deceased which Elizabeth was one of the daughters of Henry Mitchell the Elder Carpenter above mentioned of the other part, Whereas the aforesaid Henry Mitchell the elder and Grandfather to the several parties to these presents in his Lifetime and at the time of his decease by virtue of diverse m-- conveyances available in Law stood Lawfully seized and possessed in his own --- as of fee of and in two Several Tracts pieces or parcels of Land situate Lying and living in the Township of Bristol aforesaid in the County of Bucks and Province aforesaid said One of these Beginning at a post being a corner of Land formerly belonging to John Town thence by the same west fifteen degrees South four hundred eight perches to a small white oak for a corner thence by a line of M-- --- about Twenty four perches from Neshaminy Creek fifty two perches to another corner Black oak thence east thirteen degrees North three hundred and Sixty perches to another corner Black Oak thence south fifteen degrees East fifty perches to the place of Beginning Containing one hundred and twenty five Acres of Land which Joseph Growden of Tevose in the County of Bucks aforesaid Esq. by Indenture of Lease and Release for the consideration therein mentioned did bargain sell release and Convey to the said Henry Mitchell the Grand Father in free the other Tract Beginning at a Black Oak standing by Neshaminy creek thence east twelve degrees north Eighty six perches thence by Land formerly belonging to Robert Hall to a post thence by the same east twenty five degrees North one hundred and Twenty six perches to a Spanish oak by Bristol Road thence by the said Road South east by south one hundred and five perches to a Spanish Oak thence west thirteen degrees thence West thirteen degrees South three Hundred and ten perches to a white oak by the aforesaid Neshaminy Creek thence up said Creek the several courses thereof tot he before mentioned Black oak the place of Beginning Containing one hundred and Six acres and a quarter of an acre of land which Hannah Carpenter of the City of Philadelphia, widow and sole Executrix of the Last Testament and Last Will of Samuel Carpenter Late of the aforesaid City and by Indenture of Lease & Release duly executed under her hand and seal for the consideration Money therein mentioned and bargain sell Release and convey to the said Henry Mitchell the Grandfather in fee and the said Henry Mitchell the Grandfather being thereof so seized died intestate leaving issue Lawfully begotten Three sons and Four Daughters viz John the Eldest son Henry (Father to the said Grantors above named) Richard who died in his Minority Martha intermarried with Thomas Janney Mason Elizabeth intermarried with James Barber Mothers to the Grantees herein named Sarah intermarried with Joseph Clark Taylor and Mary intermarried with Reneldo Burden since deceased leaving only one son named John coheirs to his said Estate, his Eldest son John Being entitled to two shares according to the Law of the province for the dividing Intestates Estates And Whereas the said John (Eldest son as aforesaid and the said Thomas Janney and Martha his wife and the said Joseph Clarke and Sarah is wife some time after tow witt on the Sixth day of November in the year of our Lord One thousand Seven hundred and forty two did Release unto the aforesaid Henry Mitchell all their right claim property and possession of in and to the said Two Tracts of Land and being every part thereof Together with the buildings inmporvements and appurtenance as thereunto belonging and to his heirs and assigns forever as in and by the said Release and executed under their respective hands and seals for the consideration therein mentioned and Recorded in the Rolls office for the County of Bucks in Book B Vol. 3 pages 528 &c. reference thereunto being had will more fully appear. And Whereas the said John Burden son of Renaldo Burden and Mary his wife sometime after the death of his father and Mother to witt on the fourteenth day of June in the year of our Lord One thousand Seven hundred and forty six did Release unto the aforesaid Henry Mitchell all his right claim property possession and demand of him the said John Burden as representative and Sole Heir of his said Deceased Mother Burden of and in the Two above described Tracts of Land and every part thereof with the buildings and improvements and appurtenances thereunto belonging, and to his heirs and assigns forever as in and by the said Release duly executed under his hand and seal and for the consideration therein mentioned, and Recorded in the Rolls Office for the County of Bucks in Book B, Vol. 3. Page 532 &c. reference thereunto being had will more fully appear by means of which Several Releases and Quit claims and in virtue of his own right as one of the children and coheirs of the said Henry Mitchell the Elder he the said Henry Father to the above Grantors became Legally seized & Possessed of the Two above described Tracts of Land with the Buildings Improvements and appurtenances thereunto belonging excepting the share a purport of Elizabeth one of the daughters of the above named Henry Mitchell the Elder intermarried with James Barber since deceased leaving five children the Grantees above named and the said Henry Mitchell being of the said several shares so seized died Intestate Leaving Three sons and one daughter the grantors above mentioned all of the at this time having attained their full age of Twenty one years not having effected a division with his sister the aforesaid Elizabeth. Now This Indenture Witnesseth that the first mentioned Henry Mitchell, John Mitchell and Joshua Wright, and Sarah his wife formerly Sarah Mitchell, sons and daughters of Henry Mitchell Blacksmith and Grandchildren of Henry Mitchell the Elder (carpenter) in order that a perpetual division may be made of the above described tracts of Land and that each of them may severally hold and enjoy their respective shares and purparts in their own --- as if fee and for the further consideration of the sum of Five Shillings Lawful money paid to them in hand by the said James Barber and the said Joseph Barber and the said Henry Barber and the said Elizabeth Moore and the said Mary Sands (Sons and daughters of the said Elizabeth and grandchildren of the said Henry Mitchell the elder at and before the ensealing and delivery hereof the receipt whereof they the said Henry Mitchell, Richard Mitchell and Joseph Wright and Sarah his wife doth hereby acquit and forever discharge the said James Barber, Henry Barber and Elizabeth Moore and Mary Sands and every of them their and every of their heirs by these presents Hath and by these presents doth fully clearly and absolutely remise release and forever quit claim unto the said James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands, Thirty three Acres of Land part of the first described Tract of Land conveyed by Joseph Growden Esq. Beginning at a stake six perches to the westward of a Spanish oak marked on corner of Bordens Land the same being a corner to the above described Tract of Land conveyed by Hannah Carpenter on the Newtown road thence extending along the same Land and Bordens line North Twenty two degrees thirty minutes East ninety one perches to the Mill Creek thence South nineteen degrees East fifty eight perches and one tenth of a perch thence South Seventy degrees thirty minutes west ninety one perches to a Tree now marked for a corner thence North Nineteen degrees west fifty eight perches to the place of Beginning in full for there share or right of their Mother Elizabeth Barber purport of and in the said above described two Tracts of Land which the said Henry Mitchell the Elder died seized of and possessed Together with all and Singular the messuage Building Improvements ways woods waters watercourses tenacies to the said Thirty three acres of Land belonging or in any wise appertaining and the Revisions and --- Rents issues and profits thereof and all and every of the Estate right title interest property claim and demand whatsoever of them the said Henry Mitchell, Richard Mitchell, John Mitchell and Joshua Wright and Sarah his wife of in and to the said Thirty tree Acres of Land Hereditaments and premises above described To have and To Hold the said Thirty three Acres of Land hereditaments and Premises hereby granted and released or mentioned or intended to be granted and released with the appurtenances unto the said James Barber, Joseph Barber, Henry Barber and Elizabeth More and Mary Sands and their heirs To and for the only proper use and behoof of them the said James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands their heirs and assigns forever --- or proportional part of the Quit rent now and or to become due forth hereby granted premises to the chief Lord or Lords of the fee thereof so that neither the said Henry Mitchell nor his heirs nor the said Richard Mitchell nor his heirs nor the said John Mitchell nor his heirs nor the said Joshua Wright and Sarah his wife nor their heirs nor any other person or persons in his or their names Right Title or in the Right name or stead of any of them Shall or will by any ways or means hereafter Have claim challenge or Demand any Estate right Title or interest of in or to the premises or any part thereof but from the same and every part and parcel Shall be --barred and forever Excl--- by these presents In Witness whereof the said parties to these presents have Interchangeably set their Hands and Seals hereunto the day and year first above written Henry Mitchell Richard Mitchell John Mitchell Joshua Wright Sarah Wright Sealed and Delivered in the presence of us John H. DeNormadie Esq. one of the Justices of the peace in and for the County of Bucks personally appeared Henry Mitchell, Richard Mitchell, John Mitchell and Joshua Wright and Sarah his wife and Severally Acknowledged the above Release Quit claim as their act and Deed and desire the same be recorded as such, the said Sarah being of full age severally and apart examined and the content first made known unto her Witness my hand and Seal the day and year above written John H.
