The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************* William BAUER & Wife To Benjamin BAUER intrust for Catherine BAUER This indenture made the twenty fifth day of November in the year of our lord one thousand eight hundred and seventy two between William BAUER and Catherine his wife of the Borough of Butler, County of Butler and State of Pennsylvania of the first part, and Benjamin BAUER of the County and State aforsaid in trust for the use of the said Catherine BAUER, wife of the said William BAUER for her natural lifetime, and then in trust and for the rest of the children of the said William BAUER in fee subject, however to the accpetance and control of the said William BAUER for and during her natural lifetime, of the second part. Witnesseth,that the said parties of this first part for and in consideration of the sum of one dollar and the further consederation of natural loss, and affections lawful money of the United States of Americas of America unto them will and truly paid by this said party of the second part at or before the sealing and delivery of these presents there except whereof is hereby acknowledged have granted, bargained sold aliened ??? released conveyed and confirmed and by these presents do grant bargain, sell, alien, ??? convey and confirm into the said party of the second part his heirs and assigns all that cetain lot of ground, where on the said parties of the first part now reside, situates in the Borough of Butler and County and State aforsaid, bonded and described as follows on the North by the New Castle Road formerly now a street - on the East by lot of George MANICH on the South by lot of Henry and Phillip BAUER and of Wm LENGLE and on the West by John lA? lot, and Company about seventy feet in front on said New Castle Street or Road and extending back about one hundred and eighty feet with buildings and appurtenances ??? the ??? one half of ten acre and twenty seven perches of land situates partly in the Boro of Butler and partly in the Township of Butler in the County and State aforsaid, and bounded and described as follows. Beginning at a post on the West side of the Old Mercer road and thence by lands of James M B??? North seventy nine and one half degree west forty and seven tenths perches to a post. Thence by lands of ??? O'Donnels heirs North sixty three degrees west eleven and seven tenths perches to a white oak stump thence by lands of Rev. L??? north thirty nine degrees west twenty perches to a stone heap at or opposite three white oaks, thence by lands of ??? WHITE North forty degrees east thirty three perches to white oaks or the western one of ??? thence by land of ??? WHITE southern sixty eight and one half degree east seventeen perches to the Old Mercer Road thence along said Road south twenty seven and one half degrees east fifty and seven tenths perches to the place of beginning containing as aforsaid ten acres and twenty seven perches be the same more or less the undivided one half there of being the amount thereof hereby sold and conveyed. Together with all and singular the buildings imporvments ways waters, water courses rights, liberities, privileges, hereditament and appueteances what so ever there unto belonging or in any in so and the revisions and remainders rents issues and profits there of, and all the ?? right little intrest, property, claim and demand whatsoever of the said parties of the first part in law equity or otherwise howsoever of in and to the same and every part thereof To have and to old the said lot and land above described with the hereditament and promises hereby granted or mentioned and intended to so be with the appurtenance and the said party of the second part hie heirs and assigns to and for the only proper use and behalf of the said Catherine BAUER wife of the said William BAUER for and during her natural lifetime and for the children of the said William BAUER in fee simple forever. The said Wiliam BAUER hereby reserving unto himself the occupancy and control of the said house lot and land for and during his natural lifetime and the right to sell and convey the same if he sees proper with the cosent of said Catherine his wife, and the said parties of the first part their heirs executors and adminastrators do by these presents covenant grant and agree to and with the said party of the second part his heirs and assigns that they the said party of the first part & their heirs all and singular the witness and promises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said party of the second part his heirs and assigns against them, the said parties of the first part and their heirs and against all such every other person or persons whomsoever lawfully claiming or to claim the same or any part there of shall and will warrant and forever defend. Wm BAUER R M McLURE Catherine BAUER State of Penna Butler County SS On the 25th day of November Anno Domini 1872 before me I Justice of the Peace in and for said County came the above named Willaim BAUER and CAtherine BAUER his wife and acknowledged the above indenture to be their act and deed and desired that the same might be recorded as such She the said Catherine being of full age and by me examined seperate and, apart from her said husband and the contents of the said indenture her said husband, and the contents of the said indenture being first made fully known to her, declared that she did of her own free will and accord, sign and seal and as her act and deed deliver the same without any concern or compulsion of her said husband witness my hand and seal the day and year aforsaid Recorded Dec 14th 1875 R M McLURE J.P.
