I William Flemming of Parker Township, Butler County and State of Pennsylvania, Being in a weak state of bodily health but of sound mind and memory and understanding, Blessed be the Almighty God for the same, and considering the uncertainty of this transitory Life do make and publish this my last will and testament in the manner and form following viz. Principally and first of all I do command my soul unto the Hands of the Almighty God who gave it and my body to the earth to be buried in a decent and Christianlike manner at the discretion of my executors hereinafter named and as to such notary Estate as here with it has pleased God to keep me in this Life I give and dispose of the same in the following manner. And first I do will and bequeath unto my beloved wife Elizabeth one cow and six sheep and one horse being for the use of herself and daughter Mary and also one bed and beding, one beauro and also the dresser furniture also one wash kettle also I will and bequeath unto each of my sons Edward, Hugh, William and Thomas and Robert one dollar cash. Next I will and bequeath unto my daughter Elinor Bartly five dollars Next I will and bequeath unto my daughter Joana Campbell five dollars. Next I will and bequeath unto my daughter Margaret Mortton five dollars. Next I will and bequeath unto my daughter Mary five dollars, one cow, one bed, and beding and where I also will that my grand son William Flemming Edwards son shall have the Colt which he now has raised of or from my Mare. I also will that my grand son Thomas Fleming, Edwards son, shall have the next Colt said mare may have. And that said mare shall remain on the place for the use of my son Edwards family in Common. Next I also will the Balance of my l**** property to my wife Elizabeth if she survives me If I cannot sell it to an advantage. It is at her discretion with the consultation of the executors. Next I will and bequeath unto my Wife Elizabeth my Clock and at her death if she survives me it is to fall into my son Thomas hands___________ And lastly I do nominate and Constitute and appoint Mr. Thomas Kelly and my son Thomas Flemming to be the Executors of this my Last will and testament hereby revoking all other wills Legacies and Bequeaths by me heretofore made declaring this and no other to be my last will and testament. In which whereof I have hereunto set my hand and seal this thirtieth day of June in the year of our Lord one thousand eight hundred and forty four AD 1844. Wm. Given in my hand seal of said office at Butler this 23rd day of May A.D. 1848 William Balph, Reg. Butler County Before me Register for the probate of wills and granting letters of administration in and for said County, personally came George Bartley a subscribing witness to the foregoing will and being duly sworn deposeth and saith that he was present with William Flemming the testator on the thirtieth day of June A.D. 1844 and saw and heard the testator sign, seal, publish, and declare the foregoing instrument of writing to be his last will and testament and at the time of so doing he appeared to him to be of sound and disposing mind and memory and he at his request and in his presence subscribed his name as a witness thereunto. George Bartly Sworn and subscribed before me this 22nd day of September A.D. 1847 William Balph, Register Before me the subscriber Register for the probate of wills and granting letters of administration in and for said County, personally came James Kelly a subscribing witness to the last will and testament of William Flemming, decd. And being duly sworn according to law deposeth and saith that he was present with the testator on the 13th day of June 1844 and saw and heard the testator sign, seal, publish, and declare the foregoing instrument of writing to be his last will and testament and at the time of so doing he appeared to him to be of sound and disposing mind and memory and he at his request and in his presence subscribed his name as a witness thereunto. James Kelly Sworn and subscribed before me this 12th day of May 1848 William Balph, Reg. Whereas I have been appointed Executor in the last will and testament of my father William Flemming late of Parker township decd. I therefore renounce my right as Executor in said will and decline serving as such.
