Kline to First National Bank of Patton, Penna. August 5, 1932 Elder Township, Cambria Co. PA Cambria Co., PA Deed Book, Volume 449 This Indenture made the 5th day of August in the year of our Lord one thousand nine hundred and thirty-two, Between Mary A. Kline (widow) of Los Angeles, California, party of the first part, and the First National Bank of Patton, Pennsylvania, party of the second part; Witnesseth, that the said party of the first part for and in consideration of the Sum of One Dollars lawful money of the United States of America, unto her well and truly paid by the said party of the second part, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged has granted, bargained, sold, aliened, enfeoffed, released, conveyed, and confirmed, and by these presents does grant, bargain, sell, alien, enfeoff, release, convey, and confirm unto the said party of the second part its successors and assigns. All the coal in the "B" or Miller seam of coal in and upon that certain tract of land situate in Elder Township, Cambria County and State of Pennsylvania, bounded and described as follows, to-wit: Beginning on the line of Jacob Cronaurer and F. Yeager, at a point, thence along line of Jacob Cronaurer, eighty-five degrees East eighty-five perches to a point; thence South five degrees East twenty-six perches to a point; thence South eighty-five degrees East eighty-four perches to a point; thence South six degrees West along land of Chest Creek Land and Improvement Co. ninety Perches to a point; thence along land of Adam Hass, North eighty-five degrees West, one hundred eighty-one and one-fifth perches to a point and place of beginning. Containing 114 Acres. Excepting and reserving however, two acres of coal under the buildings of the said land, said reservation to be surveyed and set apart for the protection of the buildings thereon erected. Together with free ingress, regress and egress at all times, with the necessary rights and privileges needful for the mining and removing of all said "B" seam, or Miller Seam of coal, such as are usual and necessary for mining, boring, testing, shipping and transporting the same, including right of way for rail road sites, chutes, air courses, buildings, machinery, sidings and all other structures necessary and convenient for the mining, preparing and shipping of coal and the various by-products thereof, and the right to use water and water ways necessary for the mining and removal and shipping of coal without liability for damages, with free release from all damages to the water, springs, water courses and surface of the above described land, with full right, free from all charges whatsoever to transport, haul, and remove any coal from adjoining property leased or controlled by the party of the second part , its successors and assigns, through or under the above described land for a period of twenty years, or until all the marketable coal in said "B" or Miller seam of coal shall have been removed. CERTIFICATE OF RESIDENCE I do hereby certify that the precise residence of the within named grantee is the First Ward of Patton Borough, Cambria County, Pennsylvania. August 5th, 1932. /s/ Reuel Somerville Attorney for Grantee Together with all and singular the said property, improvements, ways, waters, water-courses, rights, liberties, privileges, herditaments, and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property, claim, and demand whatsoever of said party of the first part, in law, equity, otherwise howsoever, of, in, and to the same and every part thereof. To have and to hold the said "B" or Miller seam of coal, along with the mining rights aforesaid, the hereditatments, and premises hereby granted, or mentioned and intended to be, with the appurtenances, unto the said party of the second part, its successors and assigns, to and for the only proper use and behoof of the said party of the second part, its successors and assigns forever. And Mary A. Kline the said party of the first part, for herself, her heirs, executors and administrators does by these presents covenant, grant and agree to and with the said party of the second part, its successors and assigns that she the said party of the first part, and her heirs all and singular the herditaments, and premises hereinabove described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, her heirs and assigns, against her the said party of the first part, and her heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, shall and will warrant and forever defend.
