Kline to Raymond Thomas October 28, 1919 Elder Township, Cambria Co. PA This Indenture, made the Twenty-eighth day of October in the year of our Lord one thousand nine hundred and nineteen Between Mary A. Kline widow of the late Anton Kline Deceased of Elder Township in the County of Cambria and State of Pennsylvania of the first part and Raymond Thomas of Elder Township County and State aforesaid of the second part; Witnesseth, that the said party of the first part, for and in consideration of the Sum of Forty Nine Hundred dollars lawful money of the United States of America, unto her well and truly paid by the said party of the second part, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, conveyed, and confirmed, and by these presents, do grant, bargain, sell alien, enfeoff, release, convey, and confirm unto the said party of the second part, his heirs and assigns. ALL that certain tract of land in Elder Township Cambria County and State of Pennsylvania bounded and described as follows to wit, beginning at a point on line of Jacob Cronauer and F. Yeager, thence along line of Jacob Cronauer South 85 degrees East 85 Perches to a point and thence South 5 degrees East 26 Perches to a Point Thence South 85 degrees East 84 perches to a Point thence South 6 degrees West along land of C & C Land and Improvement Co. 90 Perches to a Point and Land of Adam Hass thence along said land North 85 degrees West 181.1/5 Perches to a Point and Place of beginning, and containing 114 Acres Net. The title to these lands became vested in the late Anton Kline by Deed of F. C. Kline and wife dated the 10th day of October 1902 and Recorded in the office for recording of deeds in said County in Deed Book, Vol. 148, Page 119 and the present Grantor by Will of the late Anton Kline, Dated 30th day of May 1905 and Recorded in the Registers Office in said County on the19th day of March 1910 in Will Book Vol. 8, Page_ whence reference may be had thereto. Reserving however from the above indenture the B vein of coal with the mining rights and privileges the same as they are leased to the Miller Run Coal Co. Two acres in under the building and surroundings. As they are now purveyed by the said Miller Run Coal Co. to be Undisturbed for the protection to said buildings and waters. Reserving also from the above indenture all of the balance of coal in and under said lands with sufficient mining rights to mine and remove the same without being liable for damages in the mining and removal of same. One surface road to said operations only. Together with all and singular the said property improvements, ways, waters, water-courses, rights, liberties, privileges, herditaments, and appurtenances whatsoever thereunto belonging or in anywise appertaining, and the reversions and remainders, rents, issues, and profits thereof; and all the estate, right, title, interest, property, claim, and demand whatsoever of said party of the first part, in law, equity, otherwise howsoever, of, in, and to the same and every part thereof, Excepting the reservations herein before recited. To have and to hold the said described parcel of land the hereditatments, and premises hereby granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, to and for the only proper use and behoof of the said party of the second part, his heirs and assigns forever. And the said Mary A. Kline and Theodore Huber an Executor mentioned in the said Anton Kline will heretofore mentioned, the said parties of the first part for themselves and their heirs, executors, and administrators, does by these presents covenant, grant and agree to and with the said party of the second part his heirs and assigns that they the said parties of the first part, and their heirs all and singular the herditaments, and premises hereinabove described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against them the said parties of the first part, and their heirs, and against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof, shall and will warrant and forever defend. Kline /s/ Theodore Huber State of Pennsylvania County of Cambria On this 1st day of November A.D. 1919, before me the subscriber a Justice of the Peace in and for said County personally came the above named Mary A. Kline widow of Anton Kline deceased and Theodore Huber an Executor in Anton Kline will who in due form of law acknowledged the foregoing Indenture to be their act and deed, and desired the same might be recorded as such.
