W. Amsbry August 11, 1897 Allegheny Township, Cambria Co. PA This Indenture, made the eleventh day of August in the year of our Lord one thousand eight hundred and ninety seven, Between Margaret Mary Sharp (widow) and John C. Sharp (single) of Munster Township Cambria County Pa. and Mary S. Flick and Jerome Flick her husband Allegheny Township, Cambria County Pa of the first part and W. W. Amsbry of the Township of Gallitzin in the County of Cambria and State of Pennsylvania of the second part, Witnesseth, that the said parties of the first part for and in consideration of the sum of Eighteen hundred and ninety nine and 06/100 dollars lawful money of the United States of America, well and truly paid by the said party of the second part to the said parties of the first part at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, conveyed, and confirmed, unto the said party of the second part his heirs and assigns All the coal in under or upon all that certain piece or parcel of land lying and being situate in the Township of Allegheny, County of Cambria and State of Pennsylvania bounded and described as follows. Beginning at a post on line of land of Philip Flick at a corner of land of Demetrius A. McGough, thence by line of land of said McGough South sixty six degrees and twenty-two minutes East ten thousand six hundred and sixty-five feet to a post at a corner of land of Anthony J. Sill; thence by said land of Anthony J. Sill South two degrees and three minutes West two thousand and seventy-six feet to a post and South eighty five degrees and eleven minutes East one hundred and sixty-six feet to a post at a corner of land of estate of George Delaney deceased; thence by said Delaney land South three degrees and five minutes West seven hundred and thirty-three feet to a post at a corner of land of Sylvester Eckenrode; thence by said land of Sylvester Eckenrode North eighty-six degrees and fifty minutes West one thousand eight hundred and fifty-one feet to a post and South thirteen degrees and five minutes East five hundred and ninety-seven feet to a post on line of land of Mrs. Ellen Conrad; thence by said land of Ellen Conrad North eighty-seven degrees and twenty four minutes West eleven hundred and thirty- three feet to a post on line of land of J. W. Eckenrode thence partly by said land of J. W. Eckenrode and partly by land of Philip Farabough North ten degrees and fifteen minutes East three thousand four hundred and twenty two feet to a post at a corner of land of Demetrius a McGough the place of beginning. Containing one hundred and eighty-nine acres and one hundred and forty five perches. Being the same piece of land conveyed to George Sharp Jr., John Sharp and George Sharp by deed from George Seymore et ux; and Philip Seymore et ux; bearing date the 12th day of April 1875 Recorded in the office for recording deeds at, in and for said County of Cambria in Deed Book No. 38 at page 70 et seq., and by deed bearing date the 16th day of April 1875 and Recorded in said office in Deed Book No. 38 at page 72 said George Sharp, Sr. and Mary Sharp his wife granted and conveyed the undivided one-third part of said piece or parcel of land to said John Sharp and George Sharp their heirs and assigns, said George Sharp, Jr. having died on 23rd day of August, 1895 intestate, unmarried and without issue leaving to survive him as his only heirs his father, the said George Sharp, Sr. (since deceased) his mother, the said Mary Sharp, his brother, the said John Sharp, and his sister Mary S. Sharp, intermarried with Jerome Flick. Together with free ingress, egress or regress at all times, with all necessary rights and privileges needful for the mining and removing of all said coal, such as are usual and necessary for mining, boring, testing, shipping and transporting the same, of constructing and building such roads and railroads under the surface of said lands as may be necessary for the proper mining, shipping and transporting of said coal, with the right to use said roads and railroads in transporting under the surface of said land any coal owned, leased or operated by the party of the second part, his heirs and assigns underlying other lands, without liability for damages, and for the consideration aforesaid the parties of the first part release all and every claim or claims for damages that may be done to the strata of rock overlying and the strata of rock underlying each vein or seam of coal in said land caused by the mining or shipping of said coal, and it is further agreed and distinctly understood that none of the mining rights and privileges above mentioned are to extend to any portion of the surface of said land but are to be confined entirely to operations underneath the surface of said land.. Together with all and singular the tenements, herditaments, and appurtenances to the same belonging, or in anywise appertaining and the reversion and reversions, remainder and remainders rents issues and profits thereof and also all the estate right title interest property claim and demand whatsoever both in law and equity of the said parties of the first part of in to or out of the said coal and mining rights and every part and parcel thereof. To Have and to Hold the said coal and mining rights with all and singular the appurtenances unto the said party of the second part his heirs and assigns to and for the only proper use and behoof of the said party of the second part his heirs and assigns forever. And the said Margaret Mary Sharp, John C. Sharp, Mary S. Flick, Jerome Flick their heirs, executors, and administrators, do by these presents, covenant, grant and agree to and with the said party of the second part his heirs and assigns that they the said parties of the first part, for themselves, their heirs all and singular the herditaments and premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against the said parties of the first part, and their heirs, and against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof, shall and will by these presents warrant and forever defend. Sharp, Mary S. Flick, and Jerome Flick her husband who in due form of law acknowledged the foregoing Indenture to be their act and deed, desired the same might be recorded as such. The said Mary S. Flick being of full age and by me examined separate and apart from her said husband, and the contents of the said Indenture being first made fully known to her declared that she did of her own free will and accord sign and seal and as her act and deed deliver the same without any coercion or compulsion of her said husband.
