Last Will and testament of James K. McDermit of White Township, Cambria Co. PA In the name of God amen. I James K. McDermit of Cambria County and State of Pennsylvania farmer being weak in body and of sound mind memory and understanding but considering the uncertainty of this transitory life do make and publish this my last Will and Testament in manner and form following to wit. First. It is my will and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as can conveniently be after my demise. Item. I give and bequeath unto my dear wife Mary McDermit three beds two cows four hogs together with such of my house hold furniture and kitchen utensils as she made choose to keep for her own use. Item. I give and bequeath unto my said wife the use and occupation of my plantation the maintaining my mother Jane McDermit and my minor heirs and after the death of my said wife I give and devise the said plantation unto my four daughters to be equally divided amongst them. It is also my will that my debts that I have formerly contracted shall be paid as I contracted them (in lumber) and if that cannot conveniently be done it is my will that the sawmill property with forty acres of land thereto attached shall be sold to pay my debts and the balance of my plantation reserved for the above use of my wife children mother. And if the said sawmill property will have to be sold to pay my debts the over plus to be applied to the use of my wife children and mother. And if it shall not be sold my wife and children and mother is to have the whole proceeds of said sawmill property. And lastly I nominate constitute and appoint James McDermit & Jno and James McMullen to be my executors of this my last Will hereby revoking all other wills legacies and bequests by me heretofore made and declaring this and no other to be my last will and testament. I witness whereof I have hereunto set my hand seal the sixteenth day of March A.D. one thousand eight hundred and fifty four. McCanse the subscribing witnesses to the foregoing Instrument who being duly sworn according law doth depose and say that they were present and saw and heard the testator sign seal publish pronounce and declare the foregoing Instrument as and for his last Will and Testament and that at the time of so doing he was of perfect and sound mind memory and understanding to the best of their knowledge and belief.
