In the name of God Amen, I Richard Malone of Bald Eagle Township in Centre County and State of Pennsylvania being weak in body, but of perfect mind and memory, blessed be God for the same, calling to mind the uncertainty of this life, doth commit to writing this my last will and testament viz: I recommend my soul to Almighty God the Author and Giver and my body to the earth, to be buried in a Christian like manner at the discretion of my executors hereinafter named. Item. I give and bequeath unto my beloved wife Mary all that part of the Old tract whereon I now live, which lies on the south side of the Bald Eagle Creek toward the bringing u p of my two youngest children viz: Frederick and Morgan, until the youngest of them arrives at the age of twenty one years, ( if they live so long ). Together with the late survey of one hundred acres adjoining, at which time the said two tracts or pieces of land to be equally divided between them, to them & their heirs, reserving one third of the part of the profits arising therefrom to the use of my said wife Mary during her widowhood and longer. Likewise I give unto my said wife two of my best cows my brown mare with saddle and bridle, with my best bed and bedding thereunto belonging with all the furniture she brought with her to me. Likewise at the time of my black man Hark if he chooses to live with her for the space of five years and he behaves himself will then be free at the expiration of that time. Otherwise to be sold and the money to go to her for bringing up said children. Item. My will is that the rents now due with all my just demands against my son-in-law Joseph Alexander be secured by my executors hereinafer named, to be by them applied to the use and support of the said Joseph Alexander's children. Item. All the residuary part of my estate both real and personal wheresoever it may be sold, and the money arising therefrom, after paying my just debts and funeral expences to be equally divided between the whole of my children. Viz, Ann Armstrong, Francis Malone, Francis Allexander, Richard and Lesslie Malone, Samuel and Hartley Malone and Catherine Bogs, Frederick and Morgan Malone and Rebecca Howard and James Ramsey. And furthermore I do nominate and appoint Thomas Hamilton Samuel Miles & John Miles to be the executors of this my last will and testament, hereby revoking all wills whatever by me made heretofore. Witness my hand this third day of August in the year of our Lord 1801. Richard Mallone Signed, published and declared and uttered by the said Richd. Malone to be his last will and testament the interlineations in the sixteenth and twenty fifth lines of the first page from the top and the second line from the top of the second page being first made. Miles Sworn his Henry X Gates Sworn mark I left in all the errors and misspellings although I'm not sure if they were made in the original will or by the typist of the registered copy. Now it seems in order for Richard's children to be able to inherit or be proven heirs, they had to document that they were Richard's children. So accompanying the will was a transcript of Richard's bible listing the birth dates of his children which is included below. Anne Malone daughter of Richd & Mary Malone was born on the 14th day of May 1755. Francis Malone son of Richd & Rebecca Malone was born January the 17th 1760. Frances Malone daughter of Richd. & Rebecca Malone August 27th 1762. Richard & Leslie Malone twon sons of Richd. & Rebecca Malone were born Sseptemer the 11th 1765. Samuel Malone son of Richd. and Rebekah Malone was born February 14th 1767. Rebekah Malone daughter of Richd. & Rebekah Malone was born April 30th 1769. Catherine Malone daughter of Rich'd and Rebekah Malone was born December 11th 1773 Hartley Malone son of Rich'd & Rebekah Malone and Rebekah Malone his wife was born September the 9th 1778. Frederick Malone son of Richd & Mary Malone was born on Sunday Morning about ? o'clock the 3rd day of December Anno Domini 1796 Morgan Malone son of Rich'd & Mary Malone born on Thursday January the 31st about nine o'clock P.M. 1799. I do certify the above transcript was taken from the family bible of RIchard Malone late desceased the seventeenth day of September Anno Domini 1801.
