TO ENOS MORRIS THIS INDENTURE made the eleventh day of January in the year of our Lord one thousand eight hundred and twenty eight: BETWEEN Willy Ann Cadwallader and Thomas Evans, she being Administratrix and he Administrator of all and singular the Goods and Chattels Rights and Credits which were of Isaac Cadwallader Junior late of the Township of Uwchlan in the County of Chester and State of Pennsylvania, Yeoman, who died Intestate of the one part, and Enos Morris of the Township of Uwchlan aforesaid Wheelwright of the other part, WHEREAS Isaac Cadwallader Senior of the Township of Uwchlan in the Count of Chester in Pennsylvania aforesaid Yeoman and Sarah his wife by their Indenture bearing date the seventeenth day of January in the year of our Lord one thousand eight hundred and fourteen for the consideration therein mentioned did grant and confirm unto the said Isaac Cadwallader Junior and to his heirs and assigns All that Tract or piece of land situate lying and being in the Township of Uwchlan aforesaid bounded and described as follows, to wit, BEGINNING at a stone in a line of land of Conrad Aker Junr: and running thence by the same and Land of John Martin and by land of John Weisner North seventy five degrees and thirty minutes East one hundred and thirty eight perches and five tenths of a perch to a stone set for a corner between the hereby granted premises and land of Aaron Allison senior and thence by the same North twenty six degrees West twenty two perches and seven tenths of a perch to a white oak tree marked by the said parties and North eight degrees East sixty six perches and four tenths to a stone thence by land of Isaac Cadwallader Senr: South sixty six degrees and fifteen minutes West one hundred and thirty nine perches and seven tenths to a stone, and South four degrees and thirty minutes West sixty four perches and five tenths of a perch to the place of Beginning CONTAINING fifty eight acres and fifty perches of land to the same more or less, which said recited Indenture is Recorded in the Recorder’s office for Chester County in Book L-3 Vol. 59 Page 129 – recourse being thereunto had will mere fully appear.) By force and virtue of which said recited Indenture or of some other good Conveyances and assurances in the law duly had and executed the said Isaac Cadwallader Junior became in his life time lawfully seized in his demise as of fee of and in the premises aforesaid with the appurtenances, and being so thereof seized died Intestate: After whose death, to wit, at an Orphans Court held at West Chester in and for the County of Chester the third day of February Anno Domini one thousand eight hundred and twenty three upon Petition of Willy Ann Cadwallader Administratrix and Thomas Evans Administrator aforesaid stating to the said Court that the personal Estate of the said deceased was not sufficient for the payment of the debts of the said Intestate and the maintenance and Education of his miner Children, and prayed the Court to direct a sale to be made of the above described messuage Tenement Plantation and tract of Land: It was considered and ordered by the said Court that the Premises aforesaid should be sold at public sale on the twenty second day of February then next for the purpose aforesaid and that a Report of the Proceedings thereof be made to the next Orphans Court to be held for the said County after such sale: IN PURSUANCE of which said order the said Willy Ann Cadwallader Administratrix and Thomas Evans Administrator as aforesaid after having given due public and timely notice of the time and place of sale did on the day and time therein mentioned, to wit, on the twenty second day of February AnnoWilly Ann Domini 1823 Expose the premises aforesaid to sale by public vendue or outcry and sold the same to Enos Morris for the sum of twenty five Hundred sixty five Dollars and seventy five cents lawful money of the United States he being the highest bidder and that the best price bidden for the same which sale on Report thereof made to the Judges of the said Court was on the tenth day of March following by them confirmed. And it was considered and adjudged by the said Court that the same should be and remain firm and stable forever, as by the Records and proceedings of the said Court relation thereunto will at large appear: NOW THIS INDENTURE WITNESSETH that the said Willy Ann Cadwallader and Thomas Evans for and in consideration of the said sum of twenty five hundred sixty five Dollars and seventy five cents to them in hand paid by the said Enos Morris at and before the ensealing and delivery hereof the Receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Enos Morris his heirs Executers and Administrators by these presents have granted bargained sold released and confirmed, and these presents, in pursuance and by virtue of the said order of Court do grant bargain sell release and confirm unto the said Enos Morris all that the said above mentioned messuage and described Tract of fifty eight acres and fifty perches of land TOGETHER with all and singular other the houses out houses buildings barns stables ways, weeds, waters, water courses, rights, liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the Reversions and remainders rents issues and profits thereof. And also all the Estate Right Title Interest property claim and demand whatsoever of the said Isaac Cadwallader, at and immediately before the time of his decease in law or equity or otherwise howsoever of in to or out of the same. TO HAVE AND TO HOLD the said Messuage or Tenement and tract of fifty eight acres of land fifty perches of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Enos Morris his heirs and assigns, to the only proper use and behoof of the said Enos Morris his heirs and assigns forever: And the said Willy Ann Cadwallader and Thomas Evans for themselves their heirs Executors and Administrators do severally and not jointly nor the one for the other or for the act or deed of the other but each for their own acts only, Covenant promise grant and agree to and with the said Enos Morris his heirs and assigns by these presents: That the said Willy Ann Cadwallader & Thomas Evans have not heretofore done or committed any act matter or thing whatsoever, or willingly suffered to be done or committed any act whereby the premises hereby granted or any part thereof is are or shall or may be impeached charged or encumbered in Title Charge Estate or otherwise howsoever: IN WITNESS WHEREOF the said parties to these presents have hereunto interchangeably set their hands and seals, dated the day and year first above written: SEALED & DELIVERED in the presence of us: Owen Evans Willy Ann Cadwallader Ezekiel Evans Surviving Administratrix Received on the day of the date of the above written Indenture of and from the above named Evan Morris the sum of Twenty five hundred sixty five Dollars and seventy five cents Lawful money of the United States, it being the consideration money above mentioned in full.
