Which said Joseph, Ann, Moses, Elizabeth, Sarah and Susanna are six of the Children of Joseph James late of West Town in the County of Chester, deceased, James Gibbons, Guardian duly Nominated and Appointed for Jesse James and Esther James, two other Children of the said deceased, and John Marshall Guardian duly Nominated and Appointed for Mary Marshall the Grand Child of the said deceased, send greeting. Where As the said Joseph James the deceased became in his Life time lawfully Seized in this Domestic as - of and in a Certain Messuage Grist Mill and Tract of Land of Middletown and Providence, Containing Seventy Acres. One other Messuage of Tract of Two Hundred Acres of Land in West Town. And one other Messuage and Tract of One hundred and Sixty Acres of Land in West Town aforesaid And being so thereof Seized, died Intestate leaving a widow named Hannah and Issue Ten Children and one Grand Child to survive him. And Whereas in Pursuance of a certain Writ, Issued out of the Orphan's Court for the County aforesaid, listed the Twentieth Day of December in the Year of our Lord One Thousand Seven Hundred and Seventy four, the aforesaid Messuage, Grist Mill and Tract of Seventy Acres of Land was valued and appraised at the Sum of Nine Hundred and Sixty three Pounds, and the two Messuages Tracts and Parcels of land in West Town, was valued and appraised at the Sum of Two Thousand and Thirty seven Pounds lawful Money of Pennsylvania. And Whereas upon the return of the Valuation and Appraisment to the Orphan's Court held and kept at Chester the Twenty first day of March in the Year of our Lord One Thousand Seven Hundred and Seventy five, the same was allowed, approved (inkblot) Confirmed and it was decreed and Adjudged by the said (inkblot possibly 'law-') that Caleb James oldest Son and Heir at Law of the said Intestate should hold and enjoy the said Messuages, Grist Mill and these several Tracts of Land, as fully and freely as the said Intestate held and enjoyed the same: On Condition he gave Security for the true Payment of the said Valuation Money in three months. And Whereas at an Orphans Court held and kept at Chester the Nineteenth Day of September last past, it was made appear that the said Intestate's Real Estate was at the time of the said Valuation, Indebted to sundry Persons in several Sums of Money amounting in the whole to the Sum of Six Hundred and Sixty six Pounds, Four Shillings and four pence more than his personal Estate would extend to pay, which the said Caleb James had satisfied and discharged out of the Sales and Conveyance of the said deceased's Mills and Land thereunto belonging in Middletown and Providence townships; which said Sum of Six Hundred and Sixty six Pounds, Four Shillings and four pence, being deducted from the Valuation aforesaid, leaves a balance of Two Thousand three Hundred and thirty three Pounds, Fifteen Shillings and Eight pence, of which Sum one third thereof amounting to Seven Hundred and Seventy seven Pounds Eighteen Shillings and six pence remains charged on the deceased's Real Estate in West town, Subject to the Payment of the Interest thereof to the said Hannah during her natural Life, and at her Decease to a Distribution of the Principal Sum to and among the said Intestate's Children according to Law. Now Know ye that the said Joseph James, William Patterson and Ann his Wife, Moses James, Joseph Knight and Elizabeth his Wife, Sarah James, Jacob Hoopes and Susanna his Wife, James Gibbons and John Marshall have received of and from the said Caleb James the Nine several and respective Sums of One Hundred and Twenty nine Pounds, Eleven Shillings and ten pence 1/2, amounting in the whole to the Sum of Eleven Hundred and Sixty six pounds, Seventeen Shillings and Nine pence being the full Shares and p-- belonging to the said Joseph, Ann, Moses, Elizabeth, Sarah, Susanna, Jesse, Esther and Mary, of and in two kind? parts of the said Valuation Money after deducting the Debts paid out of the residue as aforesaid, the other one third part thereof being chargeable on the Land as aforesaid, Subject to the Payments of the annual Interest thereof to the said Widow during her Life, and at her Decease to a Distribution of the Principal Sum to and amongst the said Intestate's Children or their legal Representatives according to Law, the reciept of which said Nine several Sums of One Hundred and Twenty nine Pounds, Eleven Shillings and Ten pence 1/2, they the said Joseph James, William Patterson and Ann his Wife, Moses James, Joseph Knight and Elizabeth his Wife, Sarah James, Jacob Hoopes and Susanna His Wife, James Gibbons and John Marshall do hereby severally and respectively acknowledge, and thereof do and each of them doth Acquit, Exonerate, Release and forever discharge the said Caleb James, His Heirs, Executors and Administrators by these presents. In Witness whereof the said Joseph James, William Patterson and Ann his Wife, Moses James, Joseph Knight and Elizabeth his Wife, Sarah James, Jacob Hoopes and Susanna his Wife, James Gibbons and John Marshall have hereunto set their Hands & Seals the.....Day of ......in the Year of our Lord One Thousand Seven Hundred & Seventy six. Personally appeared before me the subscriber, one of the Justices of the County Court of Common Pleas for the County of Chester, the above named Joseph James, William Patterson and Ann his wife, Moses James, Joseph Knight and Elizabeth his wife, Sarah James, Jacob Hoopes and Susanna his wife, James Gibbons, Guardian for Jesse and Esther James and John Marshall Guardian for Mary Marshall a Grand Child of the above named Joseph James late of Westtown deceased, and respectively acknowledged the above written or foregoing release to be their Act and Deed and desired the same might be recorded as such.
