We encourage links to the state and county table of contents. http://www.usgwarchives.net/ ****************************************************************** METHUSELAH DAVIS to JAMES DAVIS DEED (1750) RECORDED 12 August, 1767 BOOK O, PAGE 536 Methuselah DAVIS to James DAVIS THIS INDENTURE made the twenty seventh day of November in the year of our Lord one thousand seven hundred and fifty BETWEEN Methuselah DAVIS of the Township of Tredyffrin in the County of Chester and Province of Pennsylvania Yeoman and Elizabeth his wife of the one part and James DAVIS of Charlestown in the said County Yeoman of the other part WHEREAS David POWELL of the County of Philadelphia and Province afforesaid Yeoman by his deed bearing date the ___ day of April in the year of our Lord one thousand and seven hundred and eight for the consideration therein mentioned did grant and convey unto Thomas DAVID acertain Tract or Parcel of Land Situate and being within the bounds of the Welsh Tract in the County of Chester afforesaid containing two hundred acres herein after described part of one thousand acres of Land which the commissioners of property on the twenty eighth day of January in the year of our Lord one thousand seven hundred and five ordered to be laid out! to the said David POWEL in part of fourteen hundred acres of Land which William PENN late Proprietary and Governor in chief of the Province afforesaid bargained and sold to the said David POWELL his heirs and assigns forever on the ___ day of November in the year of our Lord one thousand seven hundred TO hold to him the said Thomas DAVID his heirs and assigns forever as in and by the said recited Indenture Recorded at Chester in Book B page 221 relation Hereunto being had may at Large appear AND WHEREAS the said Thomas DAVID by his deed bearing date the seventh day of March in the year of our Lord one thousand seven hundred and forty one for the consideration therein mentioned did grant Bargain and sell unto his son Mathuselah DAVIS his heirs and assigns All that Messuage Tenement plantation and Tract of two hundred acres of Land afforesaid Situate lying and being in the Township of Tredyffrin afforesaid within the Welsh Tract part of one thousand acres afforesaid BEGINNING! at apost in line of Marked Trees of Henry LAWRENCE'S Land thence East NorthEast two hundred and fifty perches to another post or stake set in the ground in a line of William CUARTON'S Land thence North NorthWest by aline of Trees and vacant land one hundred and twenty perches to a third stake set in the ground then West SouthWest by aline of marked Trees and vacant Land one hundred and fifty perches to apost thence extending West one hundred and eight perches to apost set in the ground then South SouthEast one hundred and sixty perches by aline of marked trees dividing it from Land belonging to Philip HOWEL to the place of Beginning containing two hundred acres afforesaid. TO HOLD to him the said Methuselah DAVIS his heirs and assigns forever AND WHEREAS John PENN Thomas PENN and Richard PENN Proprietarys of the Province afforesaid by their Letters Patent bearing date the twelfth day of April in the year of our Lord one thousand seven hundred and forty five did grant and co! nfirm the same above described Messuage Tenement Plantation and Tract of Land unto the said Methuselah DAVIS his heirs and assigns TO HOLD to him the said Methuselah DAVIS his heirs and assigns forever under the yearly quitrent of two shillings sterling or value thereof in coin current NOW THIS INDENTURE WITNESSETH that the said Methuselah DAVIS and Elizabeth his wife for and in consideration of the sum of seven hundred and seventy four pounds Lawful money of the Province afforesaid to them in hand well and truly paid the receipt whereof they do hereby acknowledge and thereof do acquit and discharge him the said James DAVIS his heirs Executors Administrators and Assigns forever have granted bargained sold Released and confirmed and by these presents they the said Methuselah DAVIS and Elizabeth his wife do grant bargain sell release and confirm unto the said James DAVIS his heirs and Assigns forever All the Messuage Tenement Plantation and Tract or Parcel of Land containg two! hundred acres as afforesaid TOGETHER with all and singular the Houses Edifices Buildings Orchards Gardens Meadows Pastures Woods Underwoods Ways Waters Water- courses Easements Profits Commoditys Advantages Emoluments Hereditaments and Appurtenances thereunto belonging or in any wise appertaining AND the Reversion and Reverions Remainder and Remainders Rents Issues and profits thereof AND all the Estate Right Title Property Claim and Demand whatsoever in Law or equity of them the said Methuselah DAVIS and Elizabeth his wife of in to or out of all and Singular the Premises above granted or intended so to be and every part thereof (excepting one acre of Land which the said Methuselah DAVIS by deed dated the 6th day of May in the year of our Lord 1745 granted unto William MOORE and others in Trust for the use of the members of St. Peters Church and also half an acre which the said Thomas DAVID Leased unto Samuel LILLEY by Indenture dated the 6th of February 1739 for and during! the Term on nine hundred and ninety nine years). AND all deeds evidences and writings touching or concerning the same premises onlyin their custody possession or power TO HAVE AND TO HOLD all and Singular the Messuage Tenement Plantation and Tract or parcel of two hundred acres of Land above granted (except before excepted) with the appurtenances unto the said James DAVIS his heirs and Assigns to the only proper use benefit and behoof of the said James DAVIS his heirs and Assigns forever and to no other use intent or purpose whatsoever AND the said Methuselah DAVIS for himself and Elizabeth his wife and for their and every of their heirs Executors and Administrators doth covenant promise grant and agree to and with the said James DAVIS his heirs and Assigns that they the said Methuselah DAVIS and Elizabeth his wife or one them at the time of the sealing and delivery of these presents are or is Lawfully and Rightfully seized in their or one of their own rights of a good perf! ect absolute and indefeasable estate of inheritance in fee simple of in and to all and Singular the premise above granted and also that they the said Methuselah DAVIS and Elizabeth his wife or one of them have or hath good right full power and sufficient and absolute authority in the Law to grant Bargain and sell the same Messuage Plantation Tenement and Tract or parcel of Land Hereditaments and premises above granted with the appurtenances in manner and form afforesaid AND also that the said James DAVIS for and notwithstanding any act matter or thing by them the said Methuselah DAVIS and Elizabeth his wife done or wittingly or wllingly suffered to the contrary he the said James DAVIS his heirs and Assigns shall or Lawfully may peaceably and quietly have hold occupy possess and enjoy the said Messuage Tenement Plantation and Tract or parcel of two hundred acres of Land with all and Singular the Hereditaments and premises above granted with their and every of their Appurtenan! ces forever and that free and clear and freely and clearly acquitted exonerated and discharged of and from all former and other grants bargains sales Leases Joyntures Dowers Wills Intails Judgements Executions Extents and Incumberances whatsoever (the quitrent afforesaid to the Proprietors of Pennsylvania only excepted) had made done or wittingly suffered to the contrary by them the said Methuselah DAVIS and Elizabeth his wife or either of them or any other person or persons with their consent Privity or knowledge AND LASTLY that they the said Methuselah DAVIS and Elizabeth his wife their heirs and Assigns and every of them and all and every other person and persons lawfully claiming or to claim any estate right Title or Interest of in or out of the premises hereby granted or intended so to be by from or under him them or either of them shall and will at any time or times hereafter at the reasonable request costs and charges in the Law of him the said James DAVIS his heirs o! r Assigns make do execute and acknowledge or cause so to be all and every such further and other reasonable act or acts deed and deeds device and devices in Law whatsoever for the further better and more perfect assurance and confirmation of the Messuage Plantation Tenement and Tract or parcel of two hundred acres of Land above granted or intended so to be with their and every of their appurtenances unto the said James DAVIS his heirs and Assigns forever to the only proper use Benefit and Behoof of the said James DAVIS his heirs and Assigns forever as by their or any of their council Learned in the Law shall be reasonably devised advised or required IN WITNESS whereof the said Methuselah DAVIS and Elziabeth his wife have hereunto set their hands and seals dated the day and year first above written. EVANS Joseph MITCHELL BE IT REMEMBERED that this twentieth day of December in the year of our Lord one thousand seven hundred and fifty personally appeared before me Joseph BONSALL Esquire one of his Majesties Justices of the County Court Of Common Pleas for the County of Chester the within named Methuselah DAVIS and Elizabeth his wife and did acknowledge the within written Indenture of bargain and sale to be their act and deed and desired that the same might be Recorded and IN TESTIMONY whereof I have hereunto set my hand and seal the day and year aforesaid.
