All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Muriel Sonne cgsonne@comcast.net May 10, 2011, 6:27 pm Chester Co., PA Deedbook E-2, p. 425; FHLMF20864 Written: March 22, 1781 Recorded: May 19, 1790 Deed Book E-2, p. 425 Deed Thomas Baily to Richard Jones: This Indenture made the twenty second day of the third month called March in the year of our Lord One thousand seven hundred and eighty one Between Thomas Baily of the township of West Marlborough in the county of Chester in the province of Pennsylvania yeo'n of the one part and Richard Jones of the township of East Bradford in the county of Chester aforesaid, yeoman of the other part Whereas by a certain patent bearing date the twenty fifth day of April Anno Dom 1709 there was granted and confirmed unto Thomas Buffington five hundred and twenty acres of land as by the same patent recorded at Philadelphia Patent Book A, Vol. 4 page 151 may appear and whereas the said Thomas Buffington and Ann his wife by their Indenture duly executed bearing date the twenty eighth day of September Anno Dom 1733 did grant and convey a certain part of the aforesd. Land unto Ralph Pyle and whereas the said Ralph Pyle & Mary his wife by their Indenture duly Executed bearing date the twenty second day of April, Anno Dom1741 did grant release & confirm the same land and premises unto Evan Jones late of East Bradford deceased and whereas by some other good conveyances and assurances in the law duly had and Executed the said Evan Jones in his lifetime became lawfully seized in his demesne as of fee of and in a certain other tract of land adjoining the aforesd. and being so thereof seized made his last Will and Testament in writing bearing date the sixth day of the eleventh month Anno Dom 1772 Wherein amongst other things he did give devise and bequeath one moiety or half of the plantation whereon he then dwelt together with his mansion house unto his grandson Thos. Baily party to these presents to him his heirs and assigns forever, as by the said last Will and testament duly proved and remaining in the register General’s office for the county of Chester aforesaid may appear Now this Indenture witnesseth that the said Thomas Baily for and consideration of the sum of five hundred and seventy pounds of gold or silver money to him in hand well and truly paid by the said Richard Jones at and before the sealing and delivery hereof the receipt and payment & whereof he doth hereby acknowledge and thereof doth acquit exonerate and forever discharge the said Richard Jones his heirs Executors administrators and assigns by these presents have granted bargained sold aliened and enfeoffed released and confirmed and by these presents doth grant Bargain sell alien enfeoff release and confirm unto the said Richard Jones his heirs and assigns all and singular the hereafter described tract and parcel of land situate lying and being part in West Bradford and part in East Bradford: Beginning at a button wood tree standing by Brandywine Creek thence North seventy six degrees East sixty one perches to a post then South seventy degrees thirty minutes East twenty perches to a Spanish oak and north sixty four degrees thirty minutes East thirty eight perches to a stone North twenty three degrees thirty minutes West forty seven perches and a half to a Wild cherry tree North sixty two degrees East forty nine perches to a white oak north twenty eight degrees West fourteen perches to a post North sixty two degrees East sixty five perches to a post in line late of Thomas Worth’s land thence by the same to the present situation of the Needle north twenty eight degrees West fifty eight perches and a half to a hickory being a corner of George Carters land thence by the same south sixty two degrees West two hundred and eleven perches to a post thence by land of James Marshal South twenty eight degrees East sixty one perches to a post and south sixty two degrees West twenty one perches to Brandywine creek thence down the same several courses thereof about forty perches to the place of Beginning containing one hundred and fifteen acres, be there more or less being the one moiety and half part including the mansion house bequeathed by the said Thomas Bailey as before recited Together with all and singular the Houses Barns Stables, Gardens, Orchards, fields fences Ways Woods Meadows Waters Water courses rights Liberties privileges hereditaments and appurtenances whatsoever to the tract or parcel of land hereby & granted belonging or in any wise appertaining And the reversions and remainders rents Issues and profits thereof and all the Estate right title interest property claim and demand whatsoever either in law or equity or otherwise howsoever of him Mr. Thomas Baily of in to or out of same premises or any part thereof To have and to Hold all singular the above described one hundred one, hundred and fifteen acres of land and premises and every part thereof with its appurtenances unto the said Richard Jones his heirs and assigns to the only proper use and behoof of the said Richard Jones his heirs and assigns forever Under and subject to Quitrent now due and hereafter to become due for the same to the chief lord or lords of the fee thereof and the said Thomas Baily for himself his heirs Executors and Administrators and every of them doth covenant and grant to and with the said Richard Jones his heirs and assigns by these presents that the said Thomas Baily and his heirs and all and every other person or persons anything having or lawfully claiming or to claim any Estate right title or Interest of in or to the hereby granted premises or any part thereof shall and will at any time or times hereafter upon the reasonable request cost and charges in the law of him the said Richard Jones his heirs and assigns make do Execute and acknowledge or cause so to be done all and every such further and other reasonable act deed and device or devices whatsoever for the further and better and more perfect granting assuring and confirming of the aforesaid land and premises hereby granted or mentioned and intended to be granted with the appurtenances unto the said Richard Jones his heirs and assigns as by him or them or his or their council learned in the law Shall be reasonably devised and devised or required and the said Thomas Baily and his heira the said tract or parcel and land and premises hereby granted or mentioned and intended to be granted with the appurtenances unto the said Richard Jones his heirs and assigns against him the said Thomas Baily and his heirs and against all and every other person or persons whomsoever lawfully claiming the same or any part thereof by from or under him them or any of them shall and will warrant and forever Defend by these presents In Witness whereof the parties to these presents have hereunto interchangeably set their hands and seals hereunto Dated the day and year first above written Thomas Bailey (seal) Sealed and delivered in the presence of Jesse Buffington, Joel Baily, Benjamin Taylor, Joshua Clayton, Robert Buffington, James Marshall Received the day of the date of the above deed of the within named Richard Jones the Just and full sum of five hundred and seventy pounds hard issue being the full Consideration monies SS Personally appeared Before me the subscriber Robert Buffington and James Marshall two of the subscribing witnesses to the within Deed who on their solemn affirmations doth declare and say the they were personally present and saw the grantor Thomas Baily sign seal and as his act and deed deliver the within written Indenture for the use therein mentioned and that the Deponants names Subscribed thereto is of their own hand Writing.
