This Indenture made the twenty first day of the fifth month called May in the year of our Lord one thousand seventy four Between Richard Jones & Humphrey Marshall both of the county of Chester in the province of Pennsylvania yeoman Executors of the last will and testament of Evan Jones late of East Bradford in the said County of Chester deceased of the one part and John Jones of the said Township of East Bradford in the county aforesaid yeoman of the other part. Whereas the said Evan Jones in his lifetime became seized in his demesne as of fee of and in several tracts of land situate in the township of Whiteland in the said County of Chester containing upwards of four hundred acres as by the patents remaining on record in the Office for recording deeds for the City and County of Philadelphia in patent book A Vol 7 page 359 &etc. And in patent book AA Vol 10 page 489 & etc relation being thereunto had may more fully and at large appears and being so seized of part of said lands mentioned in the before recited patents departed this [life] having some time before made his last will and testament in writing bearing date the sixth of the eleventh month anno Dom 1772 in which last will are the words “Item my will and mind is and I do hereby authorize impower and direct my Executors hereafter named or the survivors or survivor of them to grant bargain sell and Convey all that my Messuage plantation and tract of two hundred acres of land situate in West Whiteland together with my personal estate unto such person or persons as maybe willing to purchase the same in fee simple or otherwise as by the said last will and testament duly proved and remaining in the Register Generals Office at Chester reference being thereupon had may appear Now this Indenture witnesseth that the said Richard Jones and Humphrey Marshall having taken upon themselves the execution of the said Will for and in consideration of the sum of sixty pounds current money of Pennsylvania to them in had well and truly paid by the said John Jones he being the highest bidder at a public sale at and before the sealing and delivery hereof the receipt whereof they do hereby acknowledge Have granted bargained sold released and confirmed and by these presents Doth grant bargain sell alien enfeoff release and confirm unto the said John Jones his hers and assigns all those two tracts pieces or parcels of land lying contiguous together situate and being in West Whiteland aforesaid One whereof begins at a black oak at a corner of John Collins land and thence by the same according to the original survey thereof south by East ninety perches to a post thence south by west one hundred and ninety three perches to a corner made by a division line of the land contained in the patent of which this is a part thence by along the said line by George Hoffman’s land according the late survey thereof north thirty five degrees west twenty three perches and north thirty nine degrees East sixteen perches and a half south thirty nine degrees west twenty four perches north thirty degrees west sixty perches to a white oak north two degrees East to a hickory and north nine degrees west one hundred and forty perches to a hickory in or near the line of Richard Thomas land thence according to the original course East north East twenty five perches and a half to a black oak thence as saith the original by land of John Earl south east one hundred and six perches to a hickory and East northeast one hundred and sixty perches to the place of beginning The other piece called Hempfield Begins at a white oak in the land of which the before described was a part now belonging to George Hoffman thence by said Hoffman’s land north sixty five degrees east fifty six perches to a stone thence by John Smiths land north twenty five degrees west nineteen perches to a post north sixty five degrees East seventy perches to a post or white oak north sixteen degrees East fifty five perches to a post in the line of the before described tract thence by the same and land of George Hoffman by the original survey south west by West but by the late survey south fifty four degrees west One hundred and sixty five perches to a marked white oak thence by said Hoffmans land south twenty five degrees East twenty nine perches to the place of Beginning containing the whole of the two described tracts by computation two hundred acres of land being the same land mentioned in said will to be sold and conveyed and a part of what is contained in the before mentioned patents. Together with all the houses Buildings Orchards woods ways waters watercourses rights liberties and privileges hereditaments and appurtenances whatsoever unto the said two tracts or parcels of land and premises herein before described belonging or in any wise pertaining and the reversions and remainders rents issues and profits thereof to have and to hold the said Plantation and two tracts of parcels of land hereditaments and premises hereby granted or mentioned intended to be granted and every part thereof with the appurtenances into the said John Jones his heirs and assigns to the only proper use and behoof of him the said John Jones his heirs and assigns forever Under the yearly quit rent now due and hereafter according to the chief lord or lords of the fee thereof for the same and the said Richard Jones and Humphrey Marshall by Virtue and in pursuance of the trust reposed in them the said plantation and two tracts or parcels of land hereditaments and premises hereby granted or mentioned and intended so to be and every part thereof with the appurtenances unto the said John Jones his heirs and assigns against the said Richard Jones and Humphrey Marshall and their heirs and against the heirs of the said Evan Jones ay other than the said John Jones and his heirs and against all and every other person or persons whatsoever anything having lawfully claiming or to claim by from or under him the said Evan Jones or them the said Executors or either or any of them shall and will Warrant and forever defend by these Presents In Witness whereof the parties to these presents have interchangeably set their hands and seals thereunto dated the day and year first above written Richard Jones (seal) Hum’y Marshall (seal) Sealed and Delivered in the presence of us Wm Woodward Jas Marshall, Received the day of the date of the above deed of the above and within named John Jones the sum of sixty pounds being the full consideration Moneys above mentioned we say Rec.’d by us Richard Jones Hum’y Marshall and John Marshall The 21st day of May Anno Domini 1774 Before me the subscriber one of the Justices of the peace for the County of Chester appeared the above and within named Richard Jones and Humphrey Marshall and acknowledged the above and within Indenture to be their and deed and was willing it should be recorded as such in testimony whereof I have hereunto set my hand and seal the day and year above written.
