WHEREAS, by a certain writ of Teieri Facias of our Lord the King, Issued out of the County Court of Common Pleas for Chester county, aforesaid, issued the 28th day of Aug last past, I was commanded that of the goods and chattels, lands and tenements which were of Francis WAYNE, deceased in the hands and posession of Michael WAYNE and Abraham WAYNE, executors of the last Will and Testament of the said Francis WAYNE deceased, then being administered in my bailiwick, I should cause to be levied as well, a certain debt of 80 pounds lawful money of Pennsylvania which Evan THOMAS lately in the said Court recovered against them, as also 72 shillings for his damages and costs. AND WHEREAS, by a certain other writ of teiri facias of our said Lord the King, issoued out of the said court, listed the same 28 August, I was commanded that of the goods and chattels, lands and tenements of Michael Wayne in my bailwick, I should cause to be levied as well a certain debt of 30 pounds, lawful money of Pennsylvania which Hannah WAYNE lately in the said court recovered against him as also 72 shillings for her damages and costs etc., and that I should have the said monies before the Justices at Chester, at a certain day in the same writs contained to tender to the said Plaintiffs for their debt and damages aforesaid at which day I myself to the said Justices did return that by virtue of the said writs to me directed. I had seized and taken in Execution, a certain messuage or tenemant and tract or parcel of land situate in the Township of East Town in the County of Chester containing about one hundred fifty acres which remained in my hands for Want of Buyers and therefore I could no have the monies therein specified as thereby I was commanded and that the residue of the Execution of the said writs did lie in certain inquisitions to the same writs respectively annexed. WHEREBY it appears by the respective oaths and solemn affirmations of twelve free and lawful men of the said county, that the clear profits of the said messuage, lands and premises are not beyond all reprizes sufficient the space of 7 years to satify the debts and damages that the writs mentioned. WHEREFORE, I was, by two certain writs of after deliviti exponas as of our said Lord the King, issued out of the said Court and tested the 4th day of September last pst, commanded that the said messuage, land and premises so by me in form of aforesaid, seized and taken in execution without delay, I should expose to sale and have that money before the Justices at Chester a certain day in the same writs mentioned to render to the aforesaid plaintiffs for their debts and damages aforesaid. BY VIRTUE of which said writs, I the said sheriff did from Day to Day expose the said messuage, land and premises to public sale having given due and legal notice of the same and place thereof, and on the day of the sale of these presents did sell the same to Frederick LANDUS of Philadelphia County, yeoman, for the sum of 97 pounds, 6 shillings and 11 pence, lawful money of Pennsylvania, he being the highest and best bidder and that being the greatest and best price bidden for the same. NOW KNOW YE that I, the said Sheriff, pursuant to the said sale for and in consideration of the said sum of 97 pounds, 6 shillings, and 11 pence to me in hand well and truly paid by the said Frederick LANDUS, at and before the sealing and delivery hereof, the receipt whereof I do hereby acknowledge, and thereof I do acquit, exonorate and forever discharge the said Frederick LANDUS, his heirs and assigns by these presents, HAVE granted, bargained, sold, delivered and confirmed to the said Frederick LANDUS, and to his heirs and assigns ALL THAT messuage, or tenement, plantation and tract or parcel of land, thereunto belonging situate lying and being in the townships of East Town and Tredyffrin in the said county of Chester, BEGINNING at a post in the line of the land of Isaac WAYNE, thence north 62 degrees and 1/4 East by the land of Henry FOX, 40 perches to a hickory corner tree, thence north 27 degrees to a post by the South side of Lancaster Road, thence south 86 degrees east by Lancaster Road 12 perches to a post, thence north 77 degrees west by lands of Doctor VanLEER, 177 perches to a heap of stones round a little Hickory thence south 64 degrees and 1/4 west by the land of Jacob BOUGH, 58 perches and 2/10 to a post in the line of Thomas PENNINGTON's land, thence south 27 degrees east by the said Pennington's land 172 perches to a post thence south 63 degrees west and by said Pennington's land 154 perches and 7/10 to as stone being a corner of the land of Isaac WAYNE, thence south 54 degrees and 1/2 east along Darby road and land of said Isaac WAYNE 51 perches and 2/10 to a White Oak corner, thence north 88 degrees east 46 perches and 1/2 to a post, thence south 88 degrees east, 8 perches to a Chestnut corner tree, thence north 63 degrees east, 34 perches to the place of beginning by land of said Isaac WAYNE, containing 153 3/4 acres, be the same more or less, TOGETHER with all the singular the houses, buildings, gardens, orchards, woods, meadows, marshes, ways, waters, water courses, rights, liberties, privileges, improvements, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertainings, AND the reversions and remainders, rents, issues, and profits thereof, TO HAVE AND TO HOLD the said messuage or tenement and described tract or parcel of land, hereditaments and premises, unto the said Frederick LANDUS, his heirs and assigns, to the only proper use, and behoof of the said Frederick LANDUS, his heirs and assigns, forever according to the laws and customs of the Province of Pennsylvania. UNDER the yearly quitrent now due and hereafter accruing for the same to the chief Lord of Lords of the fee thereof, and UNDER and SUBJECT to the payment of 3 mortgages of the said premises, one made by the said Michael WAYNE to David DAVIS for securing the payment of 100 pounds and interest, another made by the said Michael WAYNE to Samuel EMLEN for securing the payments of 100 pounds and interest, and the other made by the said Michael WAYNE to Isaac WAYNE for securing the payments of 53 pounds, 17 shillings, and interest. IN WITNESS whereof I have hereunto set my hand and seal this twenty third day of November in the year of our Lord 1773 and in the 14th year of the reign of King George the Third. THE 23 Day of November 1773, RECEIVED of and from the above named Frederick LANDUS, the full and just sum of 97 pounds, 6 shillings, and 11 pence lawful money of Pennsylvania being the full consideration money above mentioned to be paid to me.
