All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Diana Quinones audianaq@msn.com August 31, 2005, 2:31 am 112 1/4 acres in East Nantmeal, land of Thomas Hogset seized for debts, bordering William Thomas, Hartenstines, Stanley Kirby, James Sands, Thomas Hogset Written: February 22, 1803 Recorded: February 18, 1805 Deed Poll James Kelton, Sheriff to Jacob High To all people to whom these presents shall come, I, James Kelton, Esquire high Sheriff of the County of Chester in the Commonwealth of Pennsylvania, send greeting whereas by a writ of levari facias issued out of the County Court of Common Pleas of the county of Chester, having list the leves Sixth day of November past, I was commanded that without any other writ of the lands and tenements of Thomas Hogset in my bailiwick to wit, a certain messuage or tenement plantation or tract of land situate in the township of East Nantmeal beginning at a post in William Thomas line and Hartenstine's land, north 57 and a half west 183 perches to a post and by the land of Stanley Kirby, south 47 1/2 degrees west 119 perches to a post and by land of James Sands, south 60 and 1/2 degrees west 12 perches and by other land of the said Thomas Hogset, south 74 and 1/4 degrees east 67 perches and 3/4 to a ston and by the land of the said William Thomas north 85 degrees and 1/2 east 200 perches to the place of beginning, containing 112 1/4 acres, be the same more or less. I should cause to be levied as well, a certain debt of 300L and the interest therein which Sarah Harvard lately in our County Court of Common Pleas before our judges at West Chester, recovered against him and also 72 shillings which to the said Sarah Harvard in our same court were adjudged for her damage which she sustained as well, by occasion of that debt, as for her costs and charges by her about her suit in that behalf, expended, whereof the said Thomas Hogset is convict as appears of record and that I should have those monies before the Judges at West Chester of the County Court of Common Pleas there to be held the third Monday in February their next, to render to the said Sarah Harvard for her debt and damages aforesaid in pursuance whereof I, the said Sheriff, having given due and timely notice if the time and place of sale, did on Tuesday the 11th day of January in the year of our Lord 1803 expose the premises aforesaid to sale by public vendue or outcry and sold the same to Jacob High of the township of West Nantmill in the County of Chester for the sum of 266 pounds lawful money of Pennsylvania, he being the highest bidder and that the best price bidden for the same. Now know ye that I, the said Sheriff, for and in consideration to me in hand paid by the said Jacob High at and before the ensealing and delivery hereof the receipt whereof I do hereby acknowledge, have granted, bargained, and sold and by these presents accordingly to the directions of the said recited writ and by force and virtue thereof, grant, bargain, and sell unto the said Jacob High, his heirs ad assigns, all that that the said messuage or tenement plantation or tract of land as above mentions bounded and described together with all and singular the buildings, improvements, rights, members and appurtenances whasoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues, and profits thereof, and also all the estate right title interest property claim and demand whatsoever of him, the said Thomas Hogset, of in or out of the same to have and to hold the said messuage or tenement plantation or tract of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the same Jacob High, his heirs and assigns to his and their only proper use and behoof forever for such estate and under such rents and conditions as the said Thomas Hogset had and held the same at and immediately before the taking therein in execution according to the form and effect of the laws and usage of the Commonwealth in such case made and provided. In witness whereof I the said Sheriff have hereunto set my hand and seal dated the 22 day of February in the year 1803. Signed J Kelton, Sheriff (seal) sealed and delivered in the presence of Daniel Heister, J D Barnard, the within deed poll was duly acknowledged in open court by the within named James Kelston, Esquire High Sheriff of Chester County at a Court of Common Pleas held and kept at West Chester the 22nd day of February 1803.
