All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Pamela Nelson pam.g.nelson@gmail.com December 21, 2011, 3:35 am Uwchland Township Written: May 27, 1788 Ezekiel Leonard Sheriff To Isaac Cadwallader To all People to whom these presents shall come I Isaac Cadwallader, Ezekiel Leonard Esq. high Sheriff of the County of Chester in the Commonwealth of Pennsylvania send greeting, Whereas by a certain writ of Fieri Facias to me directed Issued out of the County Court of Common Pleas for Chester County aforesaid and tested the first day of December now last past I was commanded that of the goods and chattels lands and tenements which were of John Evans late of my County decreased in the hands and possession of Isaac Cadwallader and wife and Archibald Young executors of the said deceased in my ______ I should cause to be levied as a will a certain debt of Seventy Pounds lawful money of Pennsylvania which William Butler lately in the said Court of Common Pleas before the Justices of the same court Recovered against them and also seventy two shillings for his damage and Costs and that I should have that money before the said Justices at West Chester at the County Court of Common Pleas there to be held on a certain day in the said wit contained to under to the aforesaid William Butler for his debt and damages aforesaid at which day I myself to the said Justices did return that by virtue of the said wit to me directed I had seized and taken in execution a Messuage Plantation and tract of land situate in the Township of Uwchlan bounded by land of John Chasewell, Rees Gatlive and Robert Allison and others Containing two hundred and twenty one acres more or less which remained in my hands unsold for want of buyers and therefore I could not have the money thereunto mentioned at the day and place therein specified as thereby I was commanded and that the residue of the execution of the said Writ did by in a certain inquisition thereunto annexed whereby it appears by the said Oath and Solemn Affirmations of twelve honest and lawful men of the said County that the clear profits of the said Messuage Plantation and tract of land are not beyond all reprisals sufficient within the space of seven years to satisfy the debt and damages aforesaid Wherefore I was by a certain writ of benditioni exponas issuing out of the said court and to me directed tested the first day of March last past commanded that the said Messuage Plantation and tract of land with the appurtenances so by me in form aforesaid seized and taken in Execution without delay I should expose to sale and have that money before the Justice of West Chester at the County of Common Pleas there to be held on the last Tuesday in May the next following to under to the aforesaid William for his debt and damages aforesaid by virtue whereof I the said sheriff did from day to day expose the said Messuage Plantation and tracts of land with the appurtenances to publick life having given due and legal Notice of the time and place thereof and on the day of the date of these presents did sell the same to Isaac Cadwallader of the Township of Uwchlan in the County of Chester aforesaid Yeoman for the sum of One hundred and seventy pounds in gold or silver money of Pennsylvania, Subject to a mortgage on the premises made by a certain David Evans to Mary Norris for Securing the payment of the sum of two hundred pounds and its interest dated the third day of March 1773 he being the highest and best bidder and that being the greatest and best price bidden for the same. Now Know ye that the said Ezekiel Leonard Sheriff for and in consideration of the said sum of one hundred and seventy pounds to me in hand will and truly paid by the said Isaac Cadwallader at or before the sealing and delivery hereof the receipt which I do hereby acknowledge and thereof do acquit and forever discharge the said Isaac Cadwallader his heirs and Assigns by the presents have granted bargained sold delivered confirmed and by these presents in pursuance of the said recited writ and by virtue of the power and authority thru and by the laws of this state given me do grant bargain Sell deliver and confirm unto the said Isaac Cadwallader and to his heirs and Assigns, a certain Messuage or tenement and tract or parcel of land situate and being in the Township of Uwchlan aforesaid. Beginning at a post in Mordecai Evans line thence by the same land and land of Edward Owen north twenty five degrees West one hundred and fifty four perches to a post thence by land of Griffith Davis north sixty degrees East forty perches to a black oak then by the same land north eighty four degrees and fifty six perches and an half to a walnut tree by same lands South eighty two degrees East eighty eight perches to a gum thence by land of Rees Gatliff north twenty one degrees East sixty seven perches and a half to a post in Rees Gatliffs line thence by land of Robert Allison South seven degrees west one hundred and fourteen perches to a part thence by the same land South twenty eight degrees East twenty three perches and an half to a post thence by the same land and land of Thomas Martin and Conrad Acker South Seventy Six degrees and an half West one hundred and seventy perches and a half to the place of beginning Containing one hundred and thirty six acres and thirty two perches of land. Being the same Messuage and tract of land seized and taken in execution as aforesaid or mentioned or intended so to be which David Evans by deed dated the nineteenth day of May in the year of our Lord 1778 granted and conveyed to the aforesaid John Evans in fee.
