We encourage links to the state and county table of contents. http://www.usgwarchives.net/ _ THIS INDENTURE made the twelfth day of November in the year of our Lord one thousand seven hundred & twenty nine being the third year of the Reign of King George the Second over Great Britain, etc. BETWEEN Joseph PHIPPS of the Township of Uwchlan in the County of Chester in the Province of Pensilvania Yeoman and Mary his Wife of the one part and Joseph PHIPPS of the same Township Yeoman one of the Sons of the said Joseph and Mary of the other part. WHEREAS William Penn Esqr., late Proprietary of the said Province, DecÕd by his Indentures of Lease and Release bearing date the three & twentieth & four & twentieth days of September one thousand six hundred and eighty one for the considerations therein mentioned did grant and convey unto Thomas HAYWARD then of the County of W [page torn] Maker the Quantity of two [page torn] & fifty acres of Land to be Laid out within the said Province TO HOLD to him the said Thomas HAYWARD his Heirs & Assigns Forever, paying therefore to the said Proprietary and his Heirs the quitrent of one shilling for every hundred acres thereof upon the first day of March yearly forever as by the said Indentures may more fully appear. AND WHEREAS the said Thomas HAYWARD by an Assignment endorsed on the said recited Indenture of Release bearing date the two and twentieth day of January One thousand seven hundred & ten for a valuable consideration did Assign & Convey the said two hundred & fifty acres of Land with their Appurtenances unto Richard WEBB & Elizabeth his Wife. TO HOLD to them the said Richard & Elizabeth their Heirs and Assigns forever as by the said Assignment may more fully appear. AND WHEREAS the former Commissioners of the said William PENN, to wit Samuel CARPENTER Richard HILL Isaac NORRIS & James LOGAN by their Warrant under their hands & the Seal of the said Province bearing date the twentieth day of June Ano Dom 1712 and directed to the Surveyor Generall of the said Province did Authorize & require him to Survey or cause to be surveyÕd unto the said Richard WEBB the said quantity of two hundred & fifty acres of Land in the said Province as by the said Warrant may more fully appear. AND WHEREAS by virtue of the above recited Warrants the first mentioned two hundred & fifty acres of Land together with the two hundred & fifty acres last mentioned purchased by the said Richard WEBB of the Commissioners aforesaid, were surveyÕd and layÕd out to him the said Richard WEBB on one Regular Tract Situate lying and being in the said Township of Uwchlan and bounded as is herein after mentioned and set forth as by the Return of the Survey thereof may more fully appear. AND WHEREAS the said Richard WEBB being by virtue of the said Recited Indentures Warrants & Survey or otherwise Lawfully seized in his [illegible] as of fee of and in the said five hundred acres of Land with their Appurtenances made his last Will & Testament in writing bearing date the second day of March Ano Dom 1719 whereby he devised in these words to wit, Item. I give devise and bequeath [illegible] to Elizabeth WEBB and to her Heirs & Assigns forever all and singular my Messuages Lands Tenements & Real Estate whatsoever situate Lying & being in the County of Chester and elsewhere together with all and Singular my goods Chattles, & Personall Estate whatsoever & wheresoever the same are or may be to the intent only that my said Wife may sell my said Estate Real & Personal and with the money arising by such Sale to pay my debts and also the Legacies hereafter mentioned and the said Ricard WEBB did nominate & appoint his said Wife Elizabeth Sole Executrix of his said last Will & Testament as by the said Testament may more fully appear and the said Richard WEBB soon after dyed seized of the said Land & Premises in his Estate aforesaid after whose decease the said Testament was duly proved & Recorded in the Register GeneralÕs Office in the said County of Chester as the Law of this province directs. AND WHEREAS the said Elizabeth WEBB by her Indentures of Lease & Release bearing date the five & Twentieth & six & Twentieth days of April in the year of our Lord one thousand seven hundred & twenty one for a valuable consideration did grant Convey the said five hundred acres of Land with the Appurtenances unto the said Joseph PHIPPS the Father. TO HOLD to him his Heirs & Assigns forever as by the said Last mentioned Indentures may more fully appear. NOW THIS INDENTURE WITNESSETH that the said Joseph PHIPPS the Father and Mary his Wife as well for the natural love & Affection which they have & bear to their said Son Joseph PHIPPS as for the sum of five shillings lawful money of the said Province to them in hand paid by the said Joseph the receipt whereof they do hereby acknowledge HAVE granted aliened [illegible] and confirmed and by these presents DO grant alien [illegible] and confirm unto the said Joseph PHIPPS the Son his Heirs and Assigns All that the said Tract or Parcel of Land Situate Lying and being in the said Township of Uwchlan as aforesaid. Beginning at a white Oak marked at a corner of David LLOYDÕs Land thence West South West one hundred [illegible] to a post thence South three hundred & fifteen perches to a post thence South thereby seven degrees West sixty five [illegible] to an Oak thence South East by South one hundred & forty [illegible] to a Gum Tree thence North thirty seven degrees East one hundred seventy seven [illegible] to a post then North East by East one hundred & thirty six perches to a Chesnut Tree thence North East thirty one perches to a post thence North West by North by David LLOYDÕs Land three hundred forty & four perches to the place of Beginning containing five hundred acres and the usual allowance for Roads & highways. TOGETHER with all the Houses Out Houses Barns Buildings Gardens Orchards Fields, Fences Woods Meadows Ways Waters Water Cours es Rights Liberties Privileges Hereditaments & Appurtenances whatsoever to the said Land hereby granted belonging or in any wise appertaining and the Reversion and Reversions Remainder & Remainders Rents Issues & Profits thereof and all the Estate Right Title Interest Use Possession Property Claim & Demand whatsoever of them the said Joseph PHIPPS the Father & Mary his Wife of in and to the hereby granted Premises and all Deeds Evidences & Writings concerning the same. TO HAVE & TO HOLD the said Tract or Parcel of Land Hereditaments & Premises hereby granted or mentioned to be granted and every part thereof with the Appurtenances unto the said Joseph PHIPPS the Son his Heirs & Assigns to the only proper use and behoof of him the said Joseph PHIPPS the son his Heirs and Assigns forever Under the yearly quitrent hereafter accruing for the said Land to the Lord of the Fee thereof. AND the said Joseph PHIPPS the Father and his Heirs the said Tract or Parcel of Land Hereditaments and Premises hereby granted or mentioned to be granted & every part thereof with the Appurtenances unto the said Joseph PHIPPS the Son his Heirs & Assigns against him the said Joseph PHIPPS the Father & Mary his Wife and their Heirs and against all and every other Person and Persons whatsoever Lawfully Claiming or to Claim by from or under him them or any of them shall and will warrant and forever defend by these presents. AND the said Joseph PHIPPS the Father for himself the said Mary his Wife and for his Heirs Executors and Administrators doth covenant promise and grant to and with the said Joseph PHIPPS the Son his Heirs and Assigns by these presents that they the said Joseph PHIPPS the Father & Mary his Wife & their Heirs and all and every other Person and Persons whatsoever having or Lawfully Claiming or that shall or may at any time or times hereafter so have or Claim any Estate Right Title or Interest of in or to the Premises or any part thereof by from or under him them or any of them shall and will at any time or times hereafter upon the reasonable request costs & Charges in Law of the said Joseph PHIPPS the Son his Heirs or Assigns make Execute & Acknowledge or cause so to be all and every such further and other reasonable Act and Acts Deed or Deeds Device or Devices in Law whatsoever for the further & better assurance & confirmation of the said Tract or Parcel of Land and Premises hereby granted or mentioned so to be with the Appurtenances unto the said Joseph PHIPPS the Son his Heirs & Assigns as by him or them or by his or there Council learned in the Law shall be Reasonably devised advised or required. MEMORANDUM that the ninth day of April in the year of our Lord one thousand seven hundred & twenty nine full and peacable possession & [illegible] of the Tract of Land within mentioned was given & delivered by the within named Joseph PHIPPS the Father unto the within named Joseph PHIPPS the Son TO hold to him the said Joseph the Son his Heirs & Assigns according to the form & Effect of the within Indenture. The which Posession and Seisin was so delivered in the presence of us. Joseph PHIPPS Sr. William HOBSON Elizabeth TANIOR. PERSONALLY appeared before me Joseph BRINTON Esqr. One of his Majesties Justices for the County of Chester the within named Joseph PHIPPS and brought the within Conveyance which he Acknowledged to be his deed.
