Enoch Bye was my wife’s GGG- Grandfather Deed Robert Power & wife To Enoch Bye This Indenture Made the twelfth day of April in the year of our Lord one thousand eight hundred and six Between Robert Power of Chester county and the state of Pennslvania of the one part, and Enoch Bye of Bucks county and state aforesaid of the other part. Witnesseth that the said Robert Power is legally scized(???) in a certain tract of land ling and being in East Nottingham by virtue of two separate deeds on of which is from his fathers Patrick Power dated the 29th day of February 1790 the other from his brother in law Thos. Whacken dated the 9th day of March 1792 both which deeds is recorded in the land office of Chester county, and the said Robert Power for and in consideration of the sum of Nine hundred pounds current lawful money to him in hand paid by the said Enock Bye the receit whereof is hereby acknowledged hath given, granted, bargained, sold , and confirmed and by these presents doth give, grant, bargain, sell, and confirm unto the said Enoch Bye his heirs and assigns all that tract of land or plantation situate in Chester county and where the said Robert Power now lives and the outlines is as follows. Beginning at a Spanish oak at or near (?) the South West corner of Gge. Scottıs land and running from thence by and with said land south eighty three degrees East sixty-five perches to a stone standing in or near a road called Tannerıs road, then with or near said runs South twenty six degrees East forty two perches to a stone, then South twenty degrees east one hundred & eighteen perches to a small hickory, then South forty six degrees East one hundred & five perches to a stone at Major Wherryıs land-then by and with said land South eight degrees West to a stone Seventeen and one hald perches then by and with said Major Wherryıs land North eighty two & one half degrees West one hundred & ninety four perches to a stone standing on the West side of the Little Elk Creek, then North eighty-one degrees West seventy four perches to a Chesnut at Sidwells land, then by and with air (?) North twenty & one fourth degrees East twenty-three & one half perches to a port; then North sixty-five & one fourth degrees East twenty six perches to a stone, then North five degrees East forty three perches to a stone, then North eighty six degrees East seventeen perches to a Gum, then North seven & one fourth degrees East, one hundred & thirty three perches to the place of beginning. Containing one hundred and eighty four acres with six percent allowance, let the same be more of less with all and singular the buildings improvements inheritance and appertainances whatsoever this unto belonging to have and to hold the premises with the appertainances to the said Enock Bye his heirs and assigns to the only proper use of him the said Enock Bye his heirs and assigns forever. And the said Robert Power for himself his heirs executors & administrators doth covenant grant and agree to and with the said Enock Bye his heirs executors administrators and assigns that he the said Robert Power his heirs executors & administrators the hereby granted land and premises to him the said Enock Bye his heirs and assigns from and against the said Robert Power his heirsŠ [there is a line of the bottom of page 2 missing, and unreadable at the tope of page 3]ŠEnock Bye his heirs and assigns forever. And the said Robert Power for himself his heirs, executors and administrators doth covenant, grand and agree to and with the said Enoch Bye, his heirs an executors administrators and assigns that he the said Robert Power his heirs executors & administrators the hereby granted land and premises to him the said Enoch By his heirs and assigns (????) and against the said Robert Power his heirs assigns and from and against the aforesaid Patrick Power and Thomas Whaken their heirs & assigns and from end(?) against all persons whatever lawfully claiming by through or under him or any of them shall and will forever Warrant and defend by these presents. In Testimony whereof the said Robert Power hath hereunto let his hand and seal the day and year first before written Signed sealed and delivered in the presence of Robert Power [SEAL] Amos Bye, Philip Scott Marget Power [SEAL] Received this twelfth day of April eighteen hundred & six of Enoch Bye nine hundred pounds the consideration money in the foregoing instrument of writing mentioned Robert Powers Amos Bye, Philip Scott Pennsylvania, Chester county.. Personally came before the subscriber one of the Justices of the peace for Chester county by the above named Robert Power and acknowledged the foregoing instrument of writing to be his act and deed and the land and premises thereon mentioned to be the right property and estate of Enoch Bye, his heirs and assigns forever according to the true intent and meaning thereof and at the same time Margarett Power the wife of the said Robert out of the hearing of her said husband said she freely renounced her right of dower in said land and premises, and that not from any fear from her said husband.
