Number: R 8358 Contents: To the honourable the Senate and the House of Representatives of the Commonwealth of Pennsylvania in General Assembly met. Your petitioner a soldier in the Revolutionary War most humbly (illegible). Your petitioner entered the flying camp in August one thousand seven hundred and seventy five in Captain Jacob Netherlins Company and Colonel Montgomeries Regiment in which he continued until He was taken prisoner at Fort Washington and carried a prisoner to New York and confined in Bridewell until He was discharged on parole, under which He continued for one year After which he Enlisted in Captain William (illegible) Company and Colonel Harmons Regiment for three years during which time he faithfully served and received an honourable discharge at Princeton in New Jersey. Your petitioner is now in reduced circumstances and labouring under the infirmities of old age wishes your honours to grant to grant him an annuity for his support And your petitioner as well as well as his comrades in arms in duty bound will pray. Harmons Regiment is the truth being an eye witness to his suffering. (partly illegible) Tho. Bulls Lt. Col (original signature) Jan 23rd 1823 I do thus far certify that the Petitioner was taken prisoner at Fort Washington (illegible) 6, 1776 and admitted on parole in (illegible) 1777. It was understood after his exchange he re-enlisted in the Continental Army. I was a witness to his suffering and captivity. (illegible) Gherekiah?? Davies (original signature) State of Pennsylvania Chester County SS: On this the 5th day of October 1853 personally appeared before the (illegible) an (illegible) judge of the county of Chester Rachel Posey a citizen of East Vincent township in said county aged Eighty-four years who being duly sworn according to law doth declare in order to obtain the benefits of the provision made by the Act of Congress (illegible) July 7, 1838 entitled an act granting half pay and pensions to certain widows. That she is the widow of Micajah Posey who was a private in the Flying camp during the Revolutionary War in Captain Hetherlings Company of Col. Montgomerys Battalion. That he was taken prisoner at Fort Washington in 1776 and admitted to parole in 1777 under which he continued one year. That he resided in Chester County when he continued upon this tour of duty and belonged to the Pennsylvania portion of the flying camp. That some time after he returned home he enlisted in Captain (illegible) Lusks?? Company of the Regiment of Col. Harmon and was discharged after serving three years at Princeton New Jersey. That she was married to the said Michajah Posey on the 5th day of November 1793. That her marriage certificate has been lost, and her husband, the said Posey died on the 31st day of March 1829. That he would have made an application for a pension before he died but a severe attack of the palsy prevented his going to court to make his declaration. That she was not married to him previous to him leaving the service but before the first day of January 1794 at the time above stated. She further declares that she makes this declaration in the alternative of obtaining under the Act of Congress which allows to widows of Revolutionary War soldiers a pension if they were married before the year 1800 in case her first application is disallowed. That her husband the said Michajah Posey drew a state pension. That she would have made this application before but that in view of her having lost her marriage certificate she thought she could not obtain a pension. Corner of 21st and Chestnut Streets Philadelphia, PA Sir, In response to your letter of the twenty-first instant, you are advised that the only Revolutionary War soldier named Michajah Posey found on the records of this Bureau is one whose widow Rachel applied for a pension on account of his services in the Pennsylvania troops, but her claim was not allowed because she did not prove that he had rendered six months service as required by the Act of July 7, 1838, under which she applied. The date and place of soldier’s birth is not stated in said claim nor is his age given. His widow alleged that he lived in Chester County, Pennsylvania at the time of the Revolution, that she married him on November 5 or 6 1795. that he died either on March 30 or April 1 1828, or on March 31, 1829, and that he was allowed a pension of $ 40. per annum by the State of Pennsylvania. For information relative to said pension you should write to the State Librarian at Harrisburgh, Pennsylvania. Very Respectfully, (illegible) Commissioner (hand written message at end of typed letter) I did not make any definitive statement about the troops he was in because the Pennsylvania Archives show a man of his name in (illegible) Lusk-Harriners?? Regiment and it does not seem as if it ought to have been rejected when his offers offered testimony, but I cannot help that now. And as far as her statements rel. to mar. and etc.. I used the word alleged.
