All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lynn Beatty klbeatty@redrivernet.com July 31, 2006, 11:57 am Source: Public Records Written: September 21, 1790 Will of Joseph PHILIPS, Estate File #4229, Chester County, Pennsylvania: In the Name of God Amen The Twenty First day of September in the Year of our Lord One Thousand Seven Hundred and Ninety I Joseph Philips of the Township of Uwchlan in the County of Chester & State of Pennsylvania Weaver being Weak in Body but of sound and perfect Mind & Memory Thanks be to Almighty God therefor Calling to Mind the Mortality of my Body and that it is Appointed for all Men once to Die, do make this my last Will and Testament; That is to say Principally and first of all I give and Recommend my Soul into the Hands of God that gave it, and for my Body I recommend it to the Earth to be buried in a Christian like and Decent manner at the discretion of my Executor, Nothing doubting, but at the General Resurrection, I shall Receive the Same again by the mighty Power of Almighty God; And as touching Such Worldly Estate wherewith it hath pleased God to bless me with in this Life; I give, devise and dispose of the same in the following Manner and form. -?-, It is my Will and I do order that in the first place all my Just Debts and funeral Charges be paid and Satisfied by my Executor Item I give and Bequeath unto Mary my Beloved Wife the Yearly Profits of all my Lands & Plantation in the Township of Uwchlan aforesaid during her Natural Life time, and I give her my said Wife all my Houshold Goods and all my Moveables [Except what I Shall herein give and bequeath unto my Children] to be at her disposal to give & bequeath in and by her Last Will. Item I give and Bequeath unto my Son Josiah Philips, my Looms and all the Tacklings belonging thereunto, and I do hereby Give, devise and Bequeath unto my Said Son Josiah Philips his Heirs & Assigns all my Lands and Tenements Situate in the Township of Uwchlan aforesaid to be possessed and enjoyed by him my said Son Josiah Philips his Heirs & Assigns immediately after My said Wife's Decease he my said Son Josiah Philips his Heirs or Assigns Paying or Cause to be paid to my son David Philips or his Heirs the Sum of Twenty Pounds in Gold or Silver Money and that within two years after my said Wife's Decease, And, and also his paying unto my Grand Children herein after named Sons and Daughters of my Son John Philips Deceased, the Sum of Thirty five Pounds in Gold or Silver Money to be paid or Delivered unto them by my said Son Josiah Philips his Heirs or Assigns in the following Manner, That is to Say, To pay or Deliver unto my Grand Daughter, Mary Pettit the Sum of five Pounds in two years after my Said Wife's Decease, And to pay or Deliver unto my Grand Son Isaac Philips the Sum of five Pounds in two years after my said Wife's Decease or when he arrives to the Age of Twenty Twenty One Years, And pay or Deliver unto my Grand Son George Philips the Sum of five Pounds in two years after my said Wife's Decease or when he arrives to the age of Twenty one years; And pay or Deliver unto my Grand Daughter Sarah Philips the Sum of five Pounds in two years after my said Wife's Decease or when she the said Sarah arrives to the age of Twenty one years, And pay or Deliver unto my Grand Daughter Ruth Philips the Sum of five Pounds in two years after my said Wife's Decease or when she the said Ruth arrives to the age of twenty one years; And pay or Deliver unto my Grand Daughter Hannah Philips the Sum of five Pounds in two years after my said Wife's Decease or when she the said Hannah arrives to the age of Twenty one years; And to pay or Deliver unto my Grand Son Joseph Philips the Sum of five Pounds being the Remainder of Said Thirty five Pounds when he arrives to the age of Twenty one years, and if any of my before Named Grand Children Shall Die before the time he or she is to Receive their Money as aforesaid the Money of that one so Dying is to be Divided equally between my before named Surviving Grand Children Share & Share alike and paid or Delivered unto them as aforesaid at the time, the one so Dying was to Receive their Share; Item I give, Devise and Bequeath unto my son Joseph Philips his Heirs & Assigns all my Lands in the County formerly called Washington County in the State of Pennsylvania to be possessed by him his Heirs & Assigns immediately after my Decease he or his Heirs & Assigns paying unto my Son David Philips or his Heirs the Sum of five Pounds in Gold or Silver money in two years after my Decease. I give unto my sons David Philips and Joseph Philips all my Wearing Apparel to be delivered unto them as soon as conveniently may be after my Decease by Executor and both my said Sons to Divide them between them as they both best agree; Item I do hereby Constitute make and ordain my Said Son Josiah Philips my only and Sole Executor of this my Last Will and Testament; And I do hereby utterly disallow, Revoke & disannul all and every other Testaments, Wills, Legacies and Executors by me in any Ways before this time Named, Willed and Bequeathed, Ratifying and Confirming this and no other to be my Last Will and Testament; In Witness whereof I have hereunto Set my Hand & Seal this day and year above Written Signed, Sealed, Pronounced } And Declared by the Said } Joseph Philips Joseph Philips as his Last } Will and Testament in the } Presence of Us the Subscribers} Samuel John } Proved June 9th 1792 William John } Executor affirmed -?- David John } Sworn ------------------------------------------------------------------------------- Will of Joseph Philips First Codicil, Estate File #4229, Chester Co., Pa.: Joseph Philips of the Township of Uwchlan in the County of Chester and State of Pennsylvania Weaver, do make and Publish this my Codicil to my last Will and Testament in Manner following, Whereas in and by my last will I have given to Beloved Wife, Mary all my Hoshold Goods and moveables to be at her disposal to give an dbequeath in and by her last will - I do hereby order and Declare, That my will is That if my said Wife Mary Should die without making a Written Will That my Son Josiah Philips is to have all my Horned Cattle and all my Sheep & Swine, my Iron Vessels and all my Brass Vessels, my Stove Plates and Pupes & all my Cyder Vessels & my cart and all my Utensils of Husbandry, And Lastly It is my deisre That this Present Codicil be annexed to and made part of my Last Will & Testament to all Intents and Purposes; In Witness whereof I have hereunto put my Hand and Seal the Tenth Day of December in the year of our Lord One Thousand Seven Hundred and ninety one Signed Sealed Published Pronounced } And Declared by the Said Joseph Philips } Joseph Philips As his Codicil to his last Will & Testatment} In the presence of us the Subcribers } Samuel John William John David John ------------------------------------------------------------------------------- Will of Joseph Philips Second Codicil, Estate File #4229, Chester Co., Pa.: I Joseph Philips of the Township of Uwchlan in the County of Chester and State of Pennsylvania Weaver, Do make and Publish this my Second Codicil to my Last Will & Testament in Manner following Viz Whereas, I have in my Will Bequeathed unto my Son Josiah Philips Sumery Bequests therein Mentioned, I do hereby Delcare and give and Bequeath unto him my said son Josiah Philips more that what is Mentioned in my Will the sum of £33 2 shilling & two pense half penny together with the Interest that will accrue thereon it being a sum due on tow Notes one on Enos Miles the other on Levi Evans Signed to me by Daneil Cornog May the 14th 1792 And it is my Will & desire that this Present Codicil be annexed to and made part of my last Will and Testament & to all Intents & Purposes In Witness whereof I have hereunto put my Hand & Seal this fourtheenth day of May in the year of our Lord One Thousand Seven Hundred and Ninety Two Signed Sealed Published Pronounced } And Declared by the Said Joseph Philips } Joseph Philips As his Codicil to his last Will & Testament } In the presence of us the Subscribers } Israel Robbinson David John } Sworn ------------------------------------------------------------------------------- - Will of Joseph Philips, Estate File #4229, Proved June 9, 1792, Recorded in B. Page 44: West Chester June 9th, 1792 When personally appeared William John and David John and on their solemn oaths respectively according to law, did depose & say that they were present and did see and hear Joseph Philips Testator within named Sign, Seal, Publish, Pronounce and declare the within instrument of writing as and for his last Will and Testament and that at the doing thereof he was of sound and well disposing Mind and Memory to the best of their understandings - And that William and David the aforesaid Witnesses were also present and did see and hear Joseph Philips the Testator aforesaid, Sign, Seal, Publish, promounce and declare the first of the within Codicils to and as a part of his last Will and Testament, and that at the doing thereof he was of sound and well disposing Mind and Memory to the best of their Understandings And that Israel robinson and the said David John the Witnesses to the Second Codicil did on their oaths declare depose and say they were present and did see & hear the Testator aforesaid Sign, Seal, publish, pronounce and declare the same to be a Codicil to and a part of his last Will and Testament and that at the doing thereof he was of sound and well disposing Mind & Memory to the best of their Understandings.
