To my beloved wife Hannah, all my personal property of whatsoever kind or sort during her natural life and at her death to be disposed of as I shall hereafter direct. Further it is my will that my wife shall have the priviledge of living in the house where I now live during her natural life and to have garden sufficient for her use on my said farm, plowed and manured for her by my son John and also to have 2 milch cows kept for her winter and summer by my son John on my said farm and my son John shall furnish my wife with all kinds of grains grown and delivered to her house as she shall require it or shall stand in need of during her natural life sufficiently for her use and further my wife shall require it. My son John shall keep for her two hogs. The above mentioned bequeaths unto my wife are to be in lieu of dower, but should they not be sufficent for her keeping, it is my will that my son John give her sufficiently for her living. Item - I give and bequeath unto my son John Richard(s) all that certain messuage plantation and tract of land whereon I now live to him to have and to hold and to his heirs and assigns forever subject. Never the less to the following incumbrances to wit: the aforementioned living or bequeaths to my wife which is to be liean on my farm during her natural life and no longer and also it is my will that my son John pay unto daughter Elizabeth, four hundred dollars which shall be considered her legacy ot share in the said farm which shall be a liean on the said farm until paid and to be paid unto her as shall be hereafter described further. It is my will that my son John pay all the funeral expenses and the expenses in setting my estate. ITEM - I give and bequeath unto my daughter Elizabeth RICHARD 400 dollars to be paid unto her by my son John as follows: In 8 equal annual payments, the first $50 to be paid unto her at the expiration of one year after the death of my wife and so on equally and annually until all if paid all without interest and further I bequeath at the death of my wife unto my daughter Elizabeth. AND LASTLY, I nominate constitute and appoint my wife and my son John to be the Executors of this my last will and testament revoking all other wills legacies and bequeaths by the heretofore made, and declaring this and no other to be this my last will and testatment. In witness hereof I set my hand and seal this 5th day of May in the year of our Lord 1828. Martin (his X) Richards - (seal) signed, sealed and declared by the said testator as his last will and testament in the presence of us, George LLOYD and John AMOLE. Renouncement by widow: Know all men by these presents that I, Hannah RICHARD, of E Nantmeal township, Chester Co, widow executrix named in the last will and testament of Martin Richard, late of the same place, yeoman, have renounced, released and quit claim, my rights and title to the said executorship and to the administration of the goods and chattels whatsoever, which were of the said deceased, and desire that the same may be committed to my son John RICHARD, solely or to such person or persons as may be entitled thereto. In witness whereof I set my hand and seal this day 29th of May in the year 1828. Signed Hannah (her X) RICHARD, witnessed by George Lloyd and Johan Amole. In West Chester May 31, 1828 then personally appeared John Amole and George Lloyd who being affirmed according to law did declare and say that they were personally present and did see and hear Martin Richards, the testator in the foregoing instrument of writing named sign seal publish pronounce and declare the same as and for his last will and testament and that at the doing thereof, he was of sounc and well disposing mind and memory to the best of their knowledge and belief, Affirmed coram - Richard Strickland, Depy Regs. Be it remembered that on the 31st day of May 1828 the last will and testament of Martin Richards, deceased, was proved and approved in due form of law and letters testamentary thereon were duly granted to John Martin[sic Richards] one of the executors therein named/ the other having renounced/ who was affirmed to exhibit a true and perfect inventory of the deceased's estate into the Register's office at West Chester on or before the 30th day of June next, and diligently and faithfully to regard and well and truely to comply with the provisions of the Act of Assembly of this Commonwealth passed on the 7th day of Aptil 1826 relating to collateral inheritances and to settle the account of his administration within one year or when thereunto legally required given under my and and seal of said office -C R(sp?) Strickland, Depy-Regs. Additional Comments: Martin RICHARDS and wife Hannah had son, John RICHARDS m Elizabeth LANDIS, dau of Henry LANDIS and Mary, who were in E Nantmeal, Chester Co til 1814 when they, Henry and Mary LANDIS, removed to Caernarvon, Lancaster Co abt 1814, near Churchtown.
