Deed Bk 11 P 460 DEED Horace Binney Jr. & wife et al, To, David Swab This Indenture made the Eleventh day of August in the year of our Lord One Thousand eight hundred and Sixty five, Between Horace Binney Jr. & Elizabeth his wife of the City of Philadelphia, Julia A Johnston, William T Johnston and Laura W his wife of New York acting by their attorney in fact Horace Binney Jr, and Horace Binney Jr acting Executor of Maria C Johnston , Heirs and Devisies of William Johnston late of New York of the first part and David Swab of Clarion County. Witnesseth, That the said parties of the first part, for and in consideration of the sum of Four hundred and Fifty dollars and twelve and one half cents Lawful money of the United States of America, unto them well and truly paid by the said party of the second part at or before the Sealing and Delivery of these presents, that receipt whereof is hereby acknowledged, Have Granted, Bargained, Sold Aliened Enfeoffed, Released, Confirmed and Conveyed and by these Presents do, Grant, Bargain, Sell, Alien Enfeoff Release, Convey and Confirm, unto the said party of the second part His Heirs and Assigns, All that certain Tract or Parcel of Land, Situate and lying in Clarion (formerly Armstrong County) County and State of Pennsylvania, bounded and described as follows, To wit: Beginning at a Hickory thence, by land formerly owned by Holland Land Co. South One Hundred and Seventy two perches to a Dogwood, Thence through the larger tract of which his is a part West one hundred and forty eight perches to a post, thence through same North One hundred and seventy two perches to a Hickory, Thence East One hundred and forty Eight perches to the Beginning. Containing One hundred and fifty acres and Six perches and Allowance. Being the North Easterly Lot of the larger Tract as subdivided by John Sloan Esq. Surveyed on Warrent No 469, To Timothy Pickering and Co. and Patented in the name of William Johnston, which Patent was enrolled in Patent Book "H", Vol 30, Page 556, The Title to which by Sundry _____ Conveyances and Assurances in Law, hath become vested in the said parties of the first as Heirs and Devisies of the said William Johnston late of New York deceased. Together with all and singular the Buildings, Improvements, Woods, Ways, Waters, Water- courses, Rights, Liberties, Privileges Hereditaments and Appurtenances whatsoever thereunto belonging or in anywise appertaining, and the Reversion and Remainders, Rents issues, and Profits thereof; and all the Estate Right Title, Interest, Property, Claim and Demand whatsoever of the said Parties of the First Part in law or equity or otherwise howsoever of in and to the same and every part thereof, to Have and To Hold, the said described Tract or Parcel of Land together with the Hereditaments and Premises hereby granted or mentioned and intended so to be with the appurtenances unto the said party of the Second part His Heirs and Assigns, to and for the only proper Use, Benefit and Behoof of the said Party of the Second part, His Heirs and Assigns Forever. And the said Horace Binney Jr Et ux. et al, the said Parties of the first part for themselves & their Heirs, Executors and Administrators do by these Presents Covenant, Grant and Agree, to and with the said party of the Second part, His Heirs and Assigns that they the said Parties of the first part & their Heirs all and singular the Hereditaments and Premises herein above Descibed and Granted or Mentioned, and intended so to be with the Appurtenances unto the said Party of the Second part His Heirs and Assigns, against them the said parties of the First part and their Heirs and against all and every other person or persons ins whomsoever lawfully claiming or to claim the same or any part thereof by from through or under them or any of them. In witness Whereof, The said Parties of the First part have to these Presents set their Hands and seals, Dated the Day and Year First above written. Witness: Horace Binney 3rd John Binney Horace Binney personaly and as atty and acting Executor, Eliza F Binney On the day of ___ Anno Domini 1864, Before me an Alderman in and for the City of Philadelphia came the above named Horace Binney Jr. and Eliza F. his wife and acknowledged the above Indenture to be their Act and Deed for the purposes therein mentioned and desired that the same might be recorded as such, She the said Eliza F. being of full age and by me examined seperate and apart from her said husband and the contents of the said Indenture being first made fully known to her, declared that she did of her own free will and accord, Sign and Seal, and as her Act and Deed, deliver that same without any coercion or compulsion of her said husband, Witness my Hand and Seal the Day and Year aforesaid ______________ {Seal} State of New York } SS Monroe County } On the fourteenth day of August Anno Domini, One thousand eight hundred and Sixty five, before me a Justice of the Peace in and for Monroe County aforesaid personally came the above named Horace Binney Junior and Eliza F. his wife and acknowledged the within written Indenture to be their act and deed, for the purposes therein mentioned and desired that the same might be recorded as such. She the said Eliza being of full age and by me examined seperate and apart from her said husband and the full contents of the said Indenture being by me first made known to her, declaring that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the same without any coercion or compulsion of her said husband and at the same time and place the said Horace Binney Junior in his own name and in the names of his constituents, the above named and within named Julia A Johnston, William T Johnston and Laura W Johnston in due form of law acknowledged the foregoing written Indenture to be his own act and deed as the Attorney of his said Constituentes by him the said Horace Binney Junior, done and executed by virtue of a letter of Attorney to him for that purpose granted and the said Horace Binney Junior at the same time as an acting Executor of Maria C. Johnston deceased also acknowledged the said Indenture to be his act and deed and desired the same to be recorded as such according to law, Witness my hand and Seal the day and year aforesaid B. V.
