Estate of Samuel Smith date; Aug 1897 No. 13 August T. 1897 In the Mater of the Estate of Samuel Smith Decd Petition for Partition At an Orphans Court held at Clarion in and for the county of Clarion on the 28th day of Sept. A.D. 1897 was presented the petition of Edward M. Smith, a son of Samuel Smith late of said County respectfully represents; That the said Samuel Smith died on the 4th day of December A. D. 189- intestate leaving a widow and ten children viz: Hannah Smith widow S.J. Elizabeth intermarried with Frederick Lintz age 44 years residing in Clarion County, Pa. J.W. Smith, age 42 residing in said county, J.T. Smith, age 40, residing in said county, C.W. Smith age 38, residing in said county, Sarah M. intermarried with A. J. Song, age 36 residing at Evans City Buttler County, Pa., Rachel S. intermarried with C. M. Thompson residing in said county of Clarion, Pa., age 34 years , J.A. Smith residing in Clarion county age 32, Matillda A. intermarried with J.B. Carson who died on or about Dec. 1st 1889 leaving to survive her J. B. Carson residence unknown to your petitioner and one child Arvilla Blanche, age 11 yrs, who has for guardian your petitioner. A. L. Smith age 27 residing at Cowanshannoe, Armstrong County, Pa., Ida Bell who died since the death of the deceased without issue and your petitioner Edward M. Smith age 22, residing in clarion County. That said Samuel Smith died seized in fee of and in a certain messuage tenement and tract of land situate in the Borough of Clarion Pa., bounded and described as follows to wit Beginning at north post on 4th Ave. and running south on 4th ave to south post or north corner of lot of R. Pollock thence west along line of Pollock to post or alley thence north along alley to north west corner or lot of John T. Smith thence along lot of John T. Smith to north east corner on 4th ave. to place of beginning containing one-half acre more or less. That by virtue and under the intestate laws of this commonwealth, the said land has descended to and vested in the parties above named as heirs at law of said decedent and that one partition of the same has been made. Your petitioner therefore prays the court to award an inquest to make partiotion of said real estate to and among the parties aforesaid according to their respective rights therein. -E.M. Smith. And now Sept 28, 1897 upon the presentation of the within petition and on due consideration thereof the Court corders an inquest as prayed for notice of the proceedings and of the same of said inquest thereto personally by writing left at theri respective places of abode or by personal service to all parties in interest or to the guardians of mionrs resident with the county, notice to all parties by advertisement in the Clarion Democrat for theree succesive weeks the last insertion to be 10 days before the holding of said inquest on those residing without the county. Heath Clark Nov. 19, 1897, Exceptions to inqusition proceedings presented and filed in Open Court Rule to show cause granted Returnabel on the ( ) Arguement List By the Court Dec 18” 1897 Argued by Counsel and upon due consideration thereof, rule to show cause discharged and exceptions dismissed and inquisition confirmed absolutely.
