D. one thousand eight hundred and forty six between James Gillilance Administrator De Bonis non cum testamento annexo of Philip Bruner late of Spring Township Centre County decd of the one part and David Kephart of Decatur Township Clearfield County of the other part. Whereas by virtue of certain good conveyances in the said duly had and executed said Philip Bruner became in his lifetime lawfully seized of & in a certain tract of land situate on the north side of the Moshannon Creek in Clearfield County adjoining lands of Abraham Goss and others containing four hundred and forty acres more or less and being thereof seized made his last will and testament in writing bearing date the Third day of July 1832 whereby among other things after making a number of specific devises he did order and direct the rest and residue of his estate including the land above described to be sold by his Executor therein after named and of his said will and constitute and appoint his two sons Philip Bruner and Josiah M. Bruner to be the Executors and died without altering or revoking the same and by the last will remaining in the Registers office at Bellefonte reference thereunto being had will more fully appear and whereas the said executors were on their own and the petition of the rest of the heirs of the said Philip Bruner decd and on the first day of April A. D. 1836 discharged from the said executorship and the said James Gillilance appointed Admr De Bonnis non cum testamento annexo of the said Philip Bruner decd by virtue of the Power and authority contained in the said will for and in consideration of the sum of eleven hundred dollars to him in hand paid by the said David Kephart at and before the unsealing and delivery hereof the receipt and payment whereof is hereby acknowledged by these presents hath granted bargained sold aliened released and confirmed and by these presents by virtue of the power and authority to him given by the said will doth grant bargain sell alien release and confirm unto the said David Kephart his heirs and assigns all that the above mentioned and described tract of land situate on the north side of Moshannon Creek in Clearfield County adjoining land of Abraham Goss and others with the appurtenances (it being the same tract of land seized upon & taken in execution as the property of Jesse Williams of the said county of Centre) at the suit of the said Philip Bruner and virtue of a writ of vinditinus ophenas issued out of the Court of Common Pleas of the County of Centre and to John Ranken Esq high sheriff of said county direction bearing test at Bellefonte the 28th day of August A. D. 1813 and on the 23rd day November 1813 the aforesaid premises being exposed to sale by Public Vendue or outcry sold to the said Philip Bruner for the sum of fifty dollars and conveyed to him the said Philip Bruner by the said high sheriff of Centre County by deed bearing date the 3rd day of December one thousand eight hundred and fourteen. Together with all and singular the houses ways woods waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders rents issues & profits thereof and also all the estate right title interest & property claim and demand whatsoever of the said Philip Bruner in his lifetime at and immediately before his decease of in to or out of the same to have and to hold the said tract of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said David Kephart his heirs and assigns to the only proper use and behoof of the said David Kephart his heirs and assigns forever.
