Faust Sheriff to Adam Kephart I Jacob A. Faust, High Sheriff of Clearfield County in the Commonwealth of Pennsylvania To all to whom these presents shall come greeting whereas by virtue of a writ of Fieri Facias bearing test the twenty second day of March A.D. 1867 the said Sheriff was commanded that of the goods and chattels lands and tenements which were of Abraham Kephart late of his County Yeoman in his bailiwick he should cause to be levied as well a certain debt of $167.98 which Brown & Smuker petition at the Court of Common Pleas of said county recorded against him also $20.25 like money which the said plaintiffs were adjudged for their damages which they sustained by occasion of the detention of that debt and that I should have those moneys before the judges of said court at Clearfield there to be held for the county of Clearfield on the second Monday of January then next, to be enclosed to the said plaintiffs for their debt and damages aforesaid whereof the said Defendant was ….. at which day before our judges at Clearfield the said Sheriffs returned that by virtue of the said writ to him directed he had seized and then in execution a certain tract of land situate in the Borough of Osceola, Clearfield county, Pennsylvania bounded on the west by Single street, north by hall street, east by an alley and south by lot No. 85 having a two story home and stable erected thereon and known in plot of said Borough as lot No. 86 as the property of Abraham Kephart, which remained in my hands unsold for want of buyers and therefore I could not have the money in the said writ mentioned at the day and place in the said writ specified as therein I was commanded and that the vendue of the execution of said writ appeared in a certain schedule or inquisition thereto annexed by which schedule or inquisition it was found that the rents, issues and profits of the duly described property in my said action upon the said writ thereunto annexed mentioned were not of a clear yearly value by and all reprises sufficient within the space of seven years to satisfy the debt and damages in the said writ mentioned and whereas by a certain writ of benditioni exponas to me the said Sheriff directed, to stay at Clearfield, the thirteenth day of January one thousand eight hundred and sixty eight I was commanded that the premises above described with the appurtenances I should expose to sale, and that I should have that money before the judges at Clearfield at county court of Common Pleas thereto be held the second Monday of January next to render to the said Burns & Smuker for his debt and damages aforesaid. In pursuance whereof I the said sheriff having given due and legal notice of the time and place of sale by advertisement in the public newspapers and by handbills set up in the most places in my bailiwick did on Monday the thirteenth day of January one thousand eight hundred and sixty eight expose the said premises above described with the appurtenances to sale by public vendue or outcry and adjourned the sale from day to day until Wednesday the fifteenth day of January AD 1868 when I sold the same to Adam Kephart for the sum of seven hundred dollars he being the highest and best bidder and that the highest and best five bidders for the same. Now know ye, that I the said Jacob A. Faust Esquire High Sheriff aforesaid for and in consideration of the aforesaid sum of seven hundred dollars to me in hand paid by the said Adam Kephart at and before the sealing and delivery hereof the receipt whereof I do hereby acknowledge have granted, bargained, and sold, and by these presents, according to the direction of the said writ and by force and virtue thereof and the Constitution and Laws of this Commonwealth in such are made and provided. Do grant, bargain and sell unto the said Adam Kephart his heirs and assigns all that certain tract or lot of land situate in the Borough of Osceola, Clearfield County, Pennsylvania bounded on the west by Single Street, north by Hall Street, east by an alley and south by Lot no 85, having a two story frame house and stable erected therein and known in plot of said Borough as Lot No 86 and being wherein before particularly described together with all and singular the rights liberties, privileges, hereditaments and appurtenances whatever thereunto belonging or in anywise appertaining and the reversions remainders, rents, issues and profits thereof. To have and to hold in singular the hereditaments and premises hereby granted with the appurtenances unto the said Adam Kephart, his heirs and assigns to and for his and their only proper use and behoof forever according to the form, force and effect of the law and images of this commonwealth in such are make and provided In witness whereof I the said Sheriff have hereunto set my hand and affixed my seal this sixteenth day of January A.D. one thousand eight hundred sixty eight.
