Jackson her husband of Reed Tp., Cambria County and state of Pennsylvania of the first part and Samuel Hegarty of Beccaria Township, Clearfield County and state aforesaid of the second part: Witnesseth that the said party of the first part, for and in consideration of the sum of seven hundred and fifty dollars lawful money of the United States of America well and truly paid by the said party of the second part with said party of the first part, at and before the unsealing and delivery of the presents the receipt whereof is hereby acknowledged have granted, bargained sold aliened enfeoffed released convey and confirm and by these presents do grant bargain sell alien enfeoff release convey and confirm unto the said party of the second part his heirs and assigns. All the coal and other minerals laying or being in upon or under all that certain tract or piece of land situate in Reed Township, Cambria County, and state of Pennsylvania bounded and described as follows: Beginning at a forked Hemlock thence by lands of B. A. Beyer north 85 perches to a stone heap thence by lands of Van Scoyoc East 100 perches to post thence south 76 perches to post and corner of Wm Glasgow land thence by same west 18 perches to post thence by same south 9 perches to post thence by land of D. Glass west 82 perches to place of beginning containing fifty two acres and 18 perches more or less being part of a larger survey warrented in the name of -----Gibson which by divine conveyances good and valid in law became vested in Henry Alleman who by his deed dated the eighth day of September AD 1869 and recorded in the proper office for the recording of Deeds in and for the County of Cambria in Deed Book Vol 30 page 71 conveyed the same unto grantor herein named reference being had thereto will more fully and at large appear with the full privilege of egress ingress and regress into refrom and from said lands for the purpose of examining and searching for and of mining and manufacturing the said coal or other minerals for market and taking removing and transporting the same and for these purposes to make all necessary improvements for the convenient use and working of the mines or works and the said party of the second part to be exempt from all damages that might be caused to said land by the opening or working of said mines as aforesaid and also the said part, of the second part to have the right and privilege of cutting and using from said tract of land a sufficient amount of timber for props and mining purposes in mining said coal of either standing or lying timber not exceeding 12 inches in diameter measured two feet from the ground. The said party of the first part agreeing to save said timber from being cut or in any way destroyed until needed as far as may reasonably be in their power except on any portion of the land that the party of the first part may wish to clear up for farm purposes which it not cut and move at the time may then be used by the said party of the first part. Together with all and singular the buildings, improvements woods ways rights liberties privileges hereditaments and appurtenances unto the same belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof and also all the estate right title interest property possession claim and demand whatsoever both in law and equity of the said party of the first part of in and to the said premises with the appurtenances that is the coal and mineral rights as hereinbefore mentioned. To have and to hold the said premises with all and singular the appurtenances unto the said party of the second part his heirs and assigns to the only proper use benefit and behoof of the said party of the second part his heirs and assigns forever and the said party of the first part for themselves their heirs executors and administrators do by these forever covenant grant and agree to and with the said party of the second part his heirs and assigns that they the said party of the first part their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the party of the second part his heirs and assigns against them the said party of the first part and heirs and against all and every other person or persons whomsoever lawfully claiming and to claim the same or any part thereof by from or under him, them, in any of them shall and will warrant and forever defend. In witness whereof the said party of the first part to these presents have hereunto set their hands and seals dated the day and year first above written. Margaret Jackson (seal) Andrew T. Fry Henrietta Mullin State of Pennsylvania, Clearfield, Clearfield County On the 28th day of February Anno Domini 1884 before me a Justice of the Peace for the County of Clearfield personally appeared the above named Andrew T. Jackson and Margaret his wife and in due form of law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such; and the said Margaret being of full age and separate and apart from her said husband by me thereover privately examined and the full contents of the above deed being by me first made known unto her did thereupon declare and say that she did voluntarily and of her own free will and accord, sign and seal and as her act and deed, deliver the same without any compulsion of her husband.
