Pa Written: May 21, 1866 Recorded: May 21, 1866 Clearfield County Deed Book Y 1866-67 Pages 105-106 Deed Jonathan Kephart & Wife to James Kephart in trust for Mary wife of Jon Kephart This Indenture made the Twenty first day of May in the year of our Lord one thousand eight hundred and sixty six between Jonathan Kephart of Decatur Township Clearfield County and state of Pennsylvania and Mary His wife of the one part and James Kephart of the Township County and state aforesaid of the other part. Witnesseth that the said Jonathan Kephart and Mary his wife for and in consideration of the sum of one thousand dollars lawful money of the United States of America there now and truly paid by the said James Kephart for the use and upon the trust hereafter mentioned at and before the sealing and delivery of these presents the receipt thereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and confirmed unto the said James Kephart his heirs and assigns. All that certain tract or piece of land situate in Decatur Township Clearfield County and state of Pennsylvania Beginning at a white oak in the southeast corner of the survey, thence by lands of H. Philips west one hundred and twenty seven perches to a white oak, thence by lands of H. Philips and Jacob Baughman north one hundred and thirty three and a half perches to a white oak thence by lands of H. Philips East one hundred and twenty seven perches east to a stone heap thence by lands of H Philips south one hundred and thirty three and a half perches to the place of beginning. Containing one hundred and five acres and one hundred and fifty five perches more or less being part of a larger tract of land surveyed in the name of John Shyrin and being the same premises, conveyed by Heardman Philips and Sophia his wife unto Henry Kephart by deed dated 31 Aug. A. D. 1842. Recorded in Deed Book I page 34 at Clearfield (which rec for more full recital of title) and the said Henry Kephart and Sarah his wife by assignment and entered on the back of the aforesaid deed dated the 22d day of May A. D. 1858. Recorded at Clearfield in Deed Book S page 1167 and conveyed the same unto the said Jonathan Kephart. Together with all and singular the improvements, ways, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues and profits thereof, and all the estate right title interest property claim and demand whatsoever of Jonathan Kephart & Mary his wife in law equity or otherwise howsoever, of on and to the same and every part thereof; To have and to hold the said tract of land hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances in trust unto the said James Kephart his heirs and assigns to and for the only proper use and behoof of said Mary Kephart wife of Jonathan Kephart her heirs and assigns forever with the right, to the said Mary Kephart, wife of Jonathan Kephart. To devise the said premise by letters of appointment and dispose of the same in any other manner, under the laws and according to the statutes of the Commonwealth of Pennsylvania and the said Jonathan Kephart and Mary his wife their heirs, executors and administrators do by these presents covenant grant and agree to and with the said James Kephart his heirs and assigns thereby the said Jonathan Kephart and Mary his wife their heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said James Kephart his heirs and assigns against them the said Jonathan Kephart and Mary his wife their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, shall and will warrant and forever defend. In Witness thereof the said parties to these presents have hereunto interchangeably set their hands and seals Dated the day and year first above written. Jonathan X (his mark) Kephart Mary X (her mark) Kephart William Porter The 21st day of May Anno Domini `1866 before me one of the Justices of the Peace for the county of Clearfield came the above named Jonathan Kephart and Mary his wife and in due form of law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such the said Mary being of full age separate and apart from her said husband by me examined declared that she did voluntarily and of her own free will and accord and her act and deed declares the said Indenture deed or conveyance without any coercion or compulsion of her said husband the contents thereof having first been by me fully made known unto her. Witness my hand and seal the day and year above said. Wm. Porter J. P. I certify that the foregoing deed was duly stamped with N. S. Revenue stamps to the value of one Dollars and entered of Record May 21 A. D. 1866. Received and compared by I. G.
