Smith To Jonathan Kephart for 102 acres of land In Decatur Tp on name of Jon Nesbet This Indenture, made the twenty first day of May in the year of our Lord one thousand eight hundred and fifty five between Josiah W. Smith attorney at law of the Borough of Clearfield and State of Pennsylvania and Pascalina his wife of the first part and Jonathan Kephart, farmer of Decatur Township, County of Clearfield and state aforesaid of the other part - Witnesseth that the said parties of the first part for and in consideration of the sum of Four hundred twenty four dollars lawful money of the United States of America unto them well and truly paid by the said Jonathan Kephart party of the second part, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these presents. Do grant, bargain, sell, alien, enfeoff, release and confirm unto the said party of the second part, his heirs and assigns All that certain piece or Tract of Land, situate in Decatur Township, Clearfield County and state of Pennsylvania Beginning Quaking Asp corner, thence East along line of Benjamin F. West survey one hundred and twenty seven perches to corner of Jonathan Kephart purchase of 1848 and thence South along his line one hundred and thirty five perches to a post, thence West one hundred and twenty seven perches to line of David Stewart thence by same North one hundred and thirty five perches to place of beginning containing one hundred and two acres more or less being out of the Northwest corner of the survey in the name of Jonathan Nesbit patented 2nd February A. D. 1838 to Joseph, Jacob, and Benjamin Gratz enrolled in Patent Book H Volume 39 page 93 who the 12th August A. D. 1847 conveyed the same to Josiah W. Smith recorded at Clearfield in Book K page 266 on relation being thereunto had will more fully appear. Together with all and singular the several ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues and profits thereof: and all the estate, right title, interest, property, claim and demand whatsoever of them the said parties of the first part in law, equity, or otherwise howsoever, of, in and to the same and every part thereof, of the said one hundred and two acres. To have and to hold the said piece of land as above described hereditaments and premises hereby granted or mentioned and intended so to be, with the appurtenances unto the said party of the second part, his heirs and assigns to and for the only proper use and behoof of the said party of the second part his heirs and assigns forever, and the said Josiah W. Smith, his heirs Executors and Administrators doth by these presents covenant grant and agree to and with the said party of the second part his heirs and assigns that he the said Josiah W. Smith his heirs all and singular the hereditaments and Premises herein above described and granted, or mentioned and intended so to be with the appurtenances unto the said party of the second part, his heirs and assigns, against him the said Josiah W. Smith his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof by from or under him or them. Shall and will warrant and forever defend. In witness whereof, the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year first above written. Sealed & delivered in the presence Josiah W. Smith Of us (sic) Pascalina Smith Jas. Burnside Received the day of the date of the above named Jonathan Kephart party of the second part the sum of four hundred and twenty four dollars, the full consideration money. Witness at signing Josiah W. Smith Jas. Burnside The Twenty first day of May Anno Domini 1855, before me one of the judges of the Court of Common Pleas for the County of Clearfield State of Pennsylvania came the above named Josiah W. Smith and Pascalina his wife in due form of law acknowledged the above indenture to be their act and deed and desired the same might be recorded as such. The said Pascalina being of full age, separate and apart from her said husband by me examined declared that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the said Indenture without any coercion or compulsion of her said husband the contents thereof having first been by me fully made known unto her.
