All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/clearfield ************************************************ File contributed for use in USGenWeb Archives by: Jan Kuhn kuhn_j@firn.edu February 14, 2009, 6:56 pm Decatur Township Written: April 15, 1890 Recorded: April 16, 1890 Clearfield County Deed Book 57 page 98 George Laws and wife to Jonathan Jones This Indenture made the fifteenth day of April in the year of our Lord one thousand eight hundred and ninety between George Laws and hi wife Margaret of the Township of Decatur, County of Clearfield, State of Pennsylvania of the first part and Jonathan Jones of the County and State aforesaid party of the second part, Witnesseth that the said party of the first part for and in consideration of the sum of seven hundred dollars lawful money of the United States of America well and truly paid by the said party of the second part to the said party of the first part at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed and by these presents doth grant, bargain, sell alien, enfeoff, release, convey and confirm, unto the said party of the second part his heirs and assigns, All the surface of a certain piece or parcel of land situated in Decatur Township, Clearfield County, State of Pennsylvania bounded and describe (sic) as follows: Beginning at a corner and lands of John Davis and thence south by line of Public Road two hundred and eighty five feet (285) to corner and lands of Albert Brown, thence by lands of Albert Brown East two hundred and thirty two feet (232) to corner and thence south by lands of A. Brown ninety seven feet to corner of lands of Jacob Brown and thence east by lands of Jacob Brown two hundred and thirty two feet (232) to corner of lands of James Nicholson thence north by lands of said J. Nicholson four hundred and eighty-five feet (485) to corner of lands of John Brown and thence by land of John Brown west one hundred and sixty four feet to corner of land of J. Brown, thence south one hundred and three feet to corner of land of J. Davis thence west by lands of said Davis three hundred feet to place of beginning. The said party of the first part reserves all veins of coal, fire clay, or other mineral in or underlying the above described surface land and the right and privilege of any part of said surface for any purpose in mining obtaining or removing said coal, fire clay or other mineral without paying for the use of said surface or in any way or manner becoming liable or responsible for any losses or damages sustained by said party of the second part his heirs or assigns on account of mining or removing of said coal, fire clay, or other minerals provided however if the same party of the first part - use one half acre of said surface for mining purposes he agrees to pay the party of the second part fifteen dollars ($15) the above described piece of land being part of a larger piece of land conveyed to George Laws by J. Blake Gearhart by Deed bearing date the twentieth day of June A.D. 1883 and recorded at Clearfield in said county in the office for recording of Deeds in Deed Book Vol 26 page 246 dated 11th August AD 1883. Together with all and singular the tenements, hereditaments and appurtenances to the same belonging or in anywise appertaining and the reversion and reversions, remainder and remainders rents, issues and profits thereof and also all the estate right, title, property, claim and demand whatsoever both in law and equity of the said party of the first part of in to or out of the said premises and every part and parcel thereof . To Have and to Hold the said premises with all and singular the appurtenances unto the said party of the second part his heirs and assigns, to and for the only proper use and behoof of the said party of the second part his heirs and assigns forever, And the said George Laws and his wife Margaret their heirs, executors and administrators do by these presents covenant, grant and agree, to and with the said party of the second part his heirs and assigns, that they the said parties of the first part their heirs, all and singular the hereditaments and premises hereinabove described and granted, or mentioned and intended so to be with the appurtenances, unto the said party of the second part his heirs and assigns, against them the said parties of the first part their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, Shall and Will bye these presents warrant and forever Defend. In Witness Whereof, the said party of the first part to these presents have hereunto set their hands and seals Dated the day and year first above written. On the 15th April A.D. 1890 before me the subscriber a Justice of the Peace in and for said county came the above named George Laws and his wife Margaret and they acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such, and the said Margaret Laws being of full age and separate and apart from her said husband by me examined and the full contents of said Indenture being first made fully known unto her declared upon such separate examination that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the said indenture without any coercion or compulsion of her said husband.
