Smith to Abraham Kephart This Indenture made the sixteenth day of Mary in the year of our Lord one thousand eight hundred and sixty four between Josiah W. Smith & Pascalina his wife of the Borough of Clearfield & state of Pennsylvania party of the first part & Abraham Kephart of Decatur Township Clearfield County & state aforesaid of the second & Scharlotte his wife of the other part Witnesseth the said Josiah W. Smith & wife for and in consideration of the sum of four hundred dollars lawful money of the United States of America then well and truly paid by the said Abraham Kephart at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and confirmed and by these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released and confirmed and by these presents do grant bargain sell alien enfeoff release and confirm unto the said party of the second part his heirs and assigns a certain piece of land situate in Decatur township Clearfield County and state of Pennsylvania being the south half of the Jonathan Neff survey beginning at a line & corner of land sold to Jonathan Kephart thence East along his line about two hundred and fifty four perches to a corner on old line of tract thence south along line of tract on (smudged) hundred and thirty five perches along line between the two surveys to place of beginning containing two hundred and four acres more or less being out of part of a whole tract which by letters Patent 2nd March 1838 enrolled in Patent Book “H” Vol 39 page 93 the Commonwealth of Pennsylvania granted to Joseph, Jacob, & Benjamin Gratz who by deed dated 12 August 1847 conveyed to said J. W. Smith recorded at Clearfield in Book “K” page 266. Together with all and singular the several the ways waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and all the estate right title interest property claim and demand whatsoever of them the said party of the first part in law equity or otherwise howsoever of in and to the same and every part thereof To have and to Hold the said two hundred and four acres more or less hereditaments and Premises hereby granted or mentioned and intended so to be with the appurtenances as aforesaid unto the said Abraham Kephart his heirs and assigns to and for the only proper use and behoof of the said Abraham Kephart his heirs and assigns forever, and the said Josiah W. Smith his heirs executors and administrators doth by these presents covenant grant and agree to and with the said Abraham Kephart his heirs and assigns that he the said Josiah W. Smith his heirs all and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Abraham Kephart his heirs and assigns against him the said Josiah W. Smith his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof under him & his heirs shall and will warrant and forever defend. In witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year first above written. Josiah W. Shugert Received the day of the date of the above Indenture of the above named Abraham Kephart the sum of four hundred dollars the full consideration money. Josiah W. Smith Witness present at Signing (no signature) On the sixteenth day of May Anno Domini 1864 before me the subscriber a Justice of the Peace of the Borough of Clearfield & County of Clearfield personally appeared the above named Josiah W. Smith & Pascalina his wife and in due form of law acknowledged the above Indenture to be their and each of their act and deed and desired the same might be recorded as such. And the said Pascalina being of full age and separate and apart from her said husband by me thereon privately examined and the full contents of the above deed being by me first made known thereunto her did thereupon declare and say that she did voluntarily and of her own free will and accord sign seal and as her act and deed deliver the above written Indenture Deed or conveyance without any coercion or compulsion of her said husband. Witness my hand and seal the day and year aforesaid. John W. Shugert JP Assignment Abraham Kephart and Wife to Samuel Spanogle and Andrew Spanogle made on back of Deed Know all men by these presents that I Abraham Kephart and Charlotte (sic) his wife of Decatur Township Clearfield County and state of Pennsylvania the said (Abraham the grantee within named) in consideration of the sum of fifteen hundred dollars to us in hand paid the receipt whereof is hereby acknowledged. We do hereby assign transfer and convey all our right title equity and claim to the within tract of land to Samuel Spanogle and Andrew Spanogle their heirs and assigns forever in fee simple the eighteenth day of May AD one thousand eight hundred and sixty four. On the eighteenth day of May A.D. 1864 before me a Justice of the Peace of the County of Clearfield personally appeared the above named Abraham Kephart and Charlotte (sic) his wife and acknowledged the above instrument to be their act and deed and desired that the same should be recorded as such according to law the Charlotte (sic) being of full age and by me examined separate and apart from her said husband and the full contents made known to her did thereupon declare and say that she did voluntarily sign seal and deliver the above instrument of writing as her act and deed without any coercion or compulsion of her said husband by voluntarily consenting thereto. In witness whereof I have hereunto set my hand and seal the day and year above written. David Gearhart JP I certify that the foregoing deed was duly stamped with U. S.
