I, William Brown Alexander of the township of Woodward County of Clearfield State of PA, Being weak of body but of Sound mind and Memory and understanding But considering the uncertainty of this transitory life do Make and ordain this my last will and Testament. First It is my will and I do order that all my Just debts and funeral Expenses be duly paid and Satisfied as Soon as conveniently can be after my decease out of My personal estate: - Item I give and bequeath to My dear wife Agnes all my present estate namely all my outstanding debts and money at interest and money in hand together with all my moveable property whatsoever, the above bequest I give in lieu of dower. Item I give and bequeath to my Said Wife the House in which I now live in lot No. one of the division of the Tract James Alexander together with the necessary yard belonging to Said House also the old garden and the Cider Press lot with the Privilege of taking what fruit She wants out of any part of the orchard with free ingress and Egress to remove the Same with all water Privileges necessary for the convenience and comfort also I will that She shall have Two Milch cows kept on the place their keeping to be paid as follows. No. one to pay 1 fourth No. two 2 to pay one fourth No. fourth to pay one fourth No. fifth to pay one Eighth No. three to pay one Eighth also one horse beast to be kept on the place for her use its keeping to be paid by the above numbers in the Same proportion as the cows. also the Same divisions to furnish her the necessarys of of life Such as provisions and fuel and clothing in the Same proportion-the above mentioned House and lots at my wifes death I I will to my Son William:-Item having caused the Indisputable part of the tract James Alexander on which I now live and asking for four hundred and thirteen acres and the allowance to be divided into Eight divisions by David Ferguson County Surveyor of Clearfield Co. in Eighteen hundred and fifty at which time Said divisions were made and having caused Said Surveyor to furnish a corrected ______ Draught of Said divisions which Draughts I direct my Executor to put on record - with this my last will and Testament:-Item I will and bequeath the above Divisions and their appurtenances in the Manner following:-Item I will and Bequeath to my Eldest Son Reed Alexander Number fifth of Said divisions with its courses and distances having respect to the lines on the ground made for Said divisions together with all the appurtenances therewith belonging or in anywise appertaining I do will it to him and his Heirs and Assigns forever:-Item I will and bequeath to my Second Son William B. Alexander the division no. one on the creek Subject to the provisions made for my wife of the House and lots during her Lifetime with its courses and distances having respect to the lines on the ground made for Said lot containing forty four acres strict measure also Page 76 A timber lot belonging to the Same division under the Same No one containing forty six acres Strict measure which two lots _____ as one in the divisions together with all the Privileges an appurtenances thereunto belonging or in anywise appertaining Still having Respect to the lines on the ground made for Said divisions I do will it to him and his Heirs and Assigns forever:-Item I will and bequeath to My third Son James Alexander the lot No Six of Said divisions with its courses and distances having respect to the lines on the ground made for Said division with all the appurtenances thereunto belonging or in anywise appertaining I do I do will it to him and his Heirs and Assigns forever:-Item I will and bequeath to my fourth son John Davis Alexander the lot No Seven of said divisions with its courses and distances having Respect to the lines on the ground made for said divisions with all the appurtenances thereunto belonging or in anywise appertaining I do will it to him and his heirs and assigns forever:-Item I will and bequeath to my fifth son Elimelich Alexander the lot No. four of Said divisions with its courses and distances having Respect to the lines on the ground made for said divisions with all Appurtenances thereunto belonging or in anywise appertaining I will it to him and his Heirs and Assigns forever:-Item I will and bequeath to My Sixth Son Boaz Alexander the lot No two 2 on the creek of Said divisions with its courses and distances having Respect to the lines on the ground made for Said divisions and containing forth one acres Strict Measure Also a lot of timber land belonging to Said division under the Same No two 2 and containing fifty acres Strict Measure Which two lots are counted as one in the division together with all Privileges and appurtenances thereunto belonging I do will it to him and his Heirs and Assigns forever:-Item I will and bequeath to my Seventh Son Robert Alexander the lot No three of Said division with its courses and distances having Respect to the lines made on the ground for Said division together with all the Privileges thereunto belonging or in anywise Appertaining. I do will it to him and his Heirs and Assigns forever:- Item I will and bequeath No Eight to the Public for a Burying ground and seat for a union church to be free to all Christian denomination together with all Privileges and Appurtenances thereunto belonging or in anywise Appertaining Excepting and Removing the timber on Said Eighth lot which I direct My Executor to Sell to the best advantage and lay it as my Subscription towards Building a church on Said lot. I do will it to them forever:- Item and Whereas the official course of the tract James Alexander crosses to the South west side of the Clearfield Creek and takes in land on which James Hegarty has an Improvement which Moiety remains undivided I will and bequeath it to my dear Sons herein afore named to them their Heirs and Assigns forever or to any one of them who will bring Suit for the recovery of Same Provided the rest will not agree to Share the Risk of a Suit and cost which Shall be optional. Item it is my Will and I direct that if any part of the title of any of the above Recited Seven divisions Should fail after a Regular trial the divisions to bear an equal Proportion of the loss to be Estimated at Woodland Price at the time the loss is Sustained the cost of trial to be paid in Equal parts to my Seven sons out of their Respective divisions:- Item it is my will that if any of my Sons Shall attempt to claim any part of the above recited Seven divisions under any other title and Shall proceed to bring Suit and put the ____ into law thereby creating family disturbance I direct in Such case that the division of Such Son Shall be forfeited to the rest of My Sons:-Item I will and bequeath to my Seven aforementioned Sons all My Right title and interest in the tract of which James Alexander now lives warranted in the name of Page 77 John ________ undivided Moiety I do will it to them their Heirs and Assigns forever:-Item I will and bequeath all my right title and interest in in the Tract Warranted in the name of ______ Roberts in Woodward TP. Clearfield County Bounded by lands of Roland Evans, Samuel Embon and Joseph Clark as an undivided Moiety to my Seven afore named Sons to them their heirs and assigns forever:- Item I will and bequeath all my Right title and interest in the Tract Joseph Budd Situated in Woodward TP. Clearfield Co. lying in the Neighborhood of Morgans Run North West of Roland Evans I do will it to my Seven afore named Sons as an undivided Moiety I will it to them their Heirs and Assigns forever:-Item I will and bequeath to My Eldest daughter Jane and John McMurray her husband the Sum of one hundred and fifty dollars having already paid fifty dollars to John Hegarty her former husband to be paid in the inside of four years from the Ninth of May one thousand eight hundred and fifty one as hereinafter directed:-Item I will and bequeath to My Second daughter Rosanah the Sum of Two hundred dollars to be paid in the inside of four years from the Ninth of May Eighteen hundred and fifty one as hereinafter directed:-Item I will and bequeath to my third daughter Catherine and John Whiteside her husband the sum of Two hundred dollars to be paid in the inside of four years from the ninth of May eighteen hundred and fifty one as hereinafter directed fifty dollars to be deducted from the above Sum I having already paid That sum to John Whiteside Item I will and Bequeath to my fourth daughter Agness and Robert Whiteside her husband the Sum of two hundred dollars to be paid in the inside of four years from the Ninth of May Eighteen hundred and fifty one as hereinafter directed fifteen dollars to be deducted out of the above Sum I having already paid Robert Whiteside that amount:-Item I will and bequeath to my fifth daughter Naomi the Sum of two hundred dollars to be paid on the inside of four years from the Ninth of May Eighteen hundred and fifty one as hereinafter directed:-Item I direct that the above bequest to My five daughters Shall be paid in Equal Shares by my Seven Sons and it is my will that if any Son or Sons do Neglect or refuse to pay their Respective Portions within the time above mentioned that their interest division or Share of Said that I have left them in this tract Whereon I now live herein aforementioned Shall be bound for it and Shall be ______ out of it as in case of other debts But no Sons Share Shall be liable for More than his proportion of Said bequest:- Item it is my will that the Recording of this My will Shall be paid out of the Money in hand and other Expenses of My Executor out of my Real Estate Equally amongst the legatees. And Lastly I nominate constitute and appoint My Son William B. Alexander Sole Executor of this my Will hereby Revoking all other wills legacies and bequests by me heretofore made and declaring this and no other to be my last will and testament. Hegarty the Subscribing witnesses to the foregoing last will and Testament of William B. Alexander deceased and on their Solemn Affirmation did Say that they were present, and did See and hear William B. Alexander of Woodward township Clearfield County Penna deceased to be Testator therein named, Seal, publish and declare is the Same as and for his last will and testament _____ ______ Page 78 at the doing thereof he was of Sound ______, Mind, Memory and understanding, to the best of their knowledge and belief affirmed and subscribed before me the day and year aforesaid S.K. Alexander Jr. do affirm that as the Executor of the foregoing last will and testament of William B. Alexander of Woodward Township Clearfield County deceased I will well and truly administer the goods and Chattels rights and credits of Said deceased agreeable to law affirmed and subscribed before one the day and year aforesaid and letters testamentary granted unto William B.
