Pg 231 In the name of God Amen, I, Daniel Yetter, Farmer of Franklin Township being weak in body but sound in mind and memory Do make and declare this to be my will and testament in manner following that is to say I order that all my just debts funeral expenses and charges of proving this my will be in the first place be fully paid and satisfied and after payment thereof and every part thereof I give and bequeath to my beloved wife Sarah Yetter the farm on which I now reside together with all such personal, or household goods as she may deem necessary for use to have and to hold and fully have control of the same as long as she remain my widow, and provided she should get remarried before her decease, I then direct my Executor immediately to sell said farm and personal property to her so bequeathed and divide the proceeds of the same among my heirs in manner hereafter mentioned, and provided she shall remain my widow during her lifetime I then direct my Executor immediately after her death to sell the real and personal to her so bequeathed and divide the proceeds of the same in manner hereafter directed amongst my children or their heirs, I direct that any or all of my personal property remaining after my widow has selected hers aforementioned to be sold and the proceeds applied to the payment of my debts and the balance if any to be divided amongst my son and daughters or their heirs in manner hereafter mentioned, I further direct that my Executor shall by public or private sale sell the farm owned by me upon which my son Samuel now lives also a tract of land in the state of Iowa being one hundred and sixty acres as soon as can conveniently be done and the proceeds of the same after payment of all my just debts and expenses to be divided amongst my son and daughters or their heirs together with any and all the proceeds of my estate not otherwise bequeathed in manner as follows, I direct that my son Samuel Yetter shall receive two hundred dollars of my estate more than either of the rest of my children or their heirs that is to say an equal share with each of the rest of my children and two hundred dollars more I direct to my daughter Eliza intermarried with John Rider shall receive as her full share of my estate the one seventh part of my estate, less two hundred dollars as forementioned to be paid my son Samuel, I direct that my daughter Mary Ann ??? married with Matthias Gingles shall have as her full share of my estate the same amount as my daughter Eliza, I direct that my daughter Hannah shall have as her full share of my estate the same amount as my daughter MaryAnn, I direct that my daughter Amanda intermarried with John Lawrence to have as her full share of my estate the same amount as my daughter Hannah She is to have during her lifetime and at her death the same to pass to her heirs and provided she should die without leaving any heirs then at her death her share shall be equally divided between her brother and sister or their heirs, I direct that my daughter Catharine intermarried with William Stoker shall have as her full share of my estate the same amount as my daughter Amanda, I direct that my 2 Grandsons Daniel + Thomas Fincher sons of my daughter Susan, deceased shall have as their full share of my estate their mothers share of my estate which amounts shall be the same as my daughter Amanda and I authorize my executor to retain said share until the said Daniel and Thomas Fincher shall attain the age of twenty one years, the interest accrueing on said share to be equally divided between the rest of my children or their heirs and provided the said Daniel + Thomas Fincher should die before the age of twenty one then I direct that their shares be equally divided between my son and daughters or their heirs and I duly hereby nominate, constitute and appoint my son Samuel Yetter and William ??? Executors of this my last will and testament and I hereby empower my executors or either of them to deed or transfer any or all of my real estate with the same power as though I was living and done it myself, In witness whereof I the same testator have set my hand and seal the fifteenth day of May A.D. 1857 Signed Daniel Yetter Signed, sealed published and delivered by the said Testator as and for his last will and testament in the presence of us who in his presence and at his request and in the presence of each other have subscribed our names as witnesses thereto. Columbia County SS Be it remembered that on the eleventh day of September A.D. 1857 before me Daniel Lee, Register for the probate of will to in and for said County came Benjamin P Fortner, and Joseph N. Bitter, the subscribing witnesses to the within instruments of writing purporting to be the last will and testament of Daniel Yetter, Senior late of Franklin Township Columbia County deceased who being duly qualified according to law do depose and say that they were personally present and saw and heard the within named Daniel Yetter Sr. signed, seal and publicly pronounce and declare the within instruments of writing to be as and for his last will and testament and that at the time of his so doing he was of sound mind, memory and understanding to the best of these deponents knowledge and belief and that the named Benjamin P Fortner and Joseph N Bitter subscribe they as witnesses was done in the presence of the testator and at his request. Columbia County SS Be it remembered that on the eleventh day of September A.D. one thousand eight hundred and fifty seven before me Daniel Lee, Reg. for the probate of will and granting letters of administration in and for said County was duly proved and approved the last will and testament of Daniel Yetter, Sr. late of Franklin Township, Columbia County dec'd and that letters Testamentary in due and kind form of law were granted unto Samuel Yetter and William Stoker, the executors in said will named, the said executors having been first duly sworn to administer said estate well and truly and according to law and pursuant to the provisions of the said will and to faithfully comply with and regard the laws relating to collateral inheritances.
