Recorded 15 Dec'r 1841 H. B. Beatty, Recorder This Indenture and amicable agreement of partition made the twentieth day of April A. D. One thousand Eight hundred and thirty nine Between David Harper of the first part, Robert Harper of the second part, Andrew Harper of the third part, Robert Kerr and Jane Kerr formerly Jane Harper of the fourth part, John Harper of the fifth part, John Quigley and Elizabeth Quigley formerly Elizabeth Harper of the sixth part, and Samuel Harper of the seventh part. Whereas the parties to this Indenture are the legal representatives of John Harper deceased, late of Vernon Township in the County of Crawford and Whereas an inquest was awarded in the Orphans Court of Crawford County to make partition of the estate of the said John Harper which inquest have divided the real estate of the said John Harper into seven purparts and directed to which of the said above mentioned heirs each of the purparts should respectively belong. And whereas the parties interested have thought it expedient and proper in order to confirm the order of partition so reported by said inquest and to make the partition among themselves perfectly valid and good without any doubts as to its sufficiency that a Deed of partition should be made by them in which each should severally Convey and receive conveyance from the others according to the [unreadable] of distribution or partition as determined by the said inquest. Now this Indenture witnesseth that for the purpose of carrying the foregoing into effect the parties of the parties of the second, third, fourth, fifth & sixth parts do grant, bargain, sell, release and convey unto David Harper, his heirs and assigns, all that certain piece of land in Vernon Township bounded as follows viz. Beginning at a post on the south line of the whole Tract Thence by land of Joseph Stockton north 100 perches and six tenths of a perch to a post, thence by the same west Eleven and a half perches to a post, thence still by same north 24 perches to a post, thence by purpart G and B as designated on a map hereto annexed west thirty nine and one half perches to a butternut, thence south by Allotment B 124 perches and six tenths of a perch to a post in aforesaid Original South line, thence east long the same fifty one perches to the place of beginning Containing Thirty eight Acres of land neat measure together with the appurtenances. The parties of the first, second, third, fourth, fifth and sixth parts do grant bargain sell release and convey unto Samuel Harper and to his heirs and assigns all that certain piece of land situated in Vernon Township and bounded as follows viz. Beginning at a post the south west corner of the land above described conveyed to David Harper, thence north by said Land 124 perches and six tenths of a perch to a Butternut, thence east by the same Eleven and one half perches to a post, thence north by land hereinafter conveyed to Elizabeth Quigley ninety one perches and four tenths of a perch to a post in the south line of the whole tract, thence west by Land occupied by Frailey and others fifty four perches and five tenths of a perch to a post, thence South by allotment C (of John Harper) 216 perches to a post in the south line of the tract, thence east forty three perches to the place of Beginning containing Sixty five Acres neat measure, together with the appurtenances. The parties of the first, second, third, fourth, sixth and seventh parts do grant bargain sell release and convey unto John Mc. Harper and to his heirs and assigns all that certain piece of land situate in Vernon township and bounded as follows viz. Beginning at a white oak tree the south east corner of the whole tract, thence along the south line of the same East sixty seven perches to a post, thence by land above of Samuel Harper north two hundred and sixteen perches to a post in the north line of the tract, thence west Sixty seven perches to a post the north west corner of the whole tract, thence South along the west line of the whole tract two hundred two hundred [repeated] and sixteen perches to the place of beginning containing ninety acres and Seventy two perches neat measure, together with the appurtenances. The parties of the first, third, fourth, fifth, sixth and Seventh parts do grant bargain sell release and convey unto Robert Harper his heirs and assigns all that certain piece of land situate in Sadsbury Township and bounded as follows, viz. Beginning at the south west corner of the whole tract a post in Thomas McCrays mill race, thence by land of said McCray and others north one hundred and Eleven perches to a post, thence by land of Wm. W. White east seventy four perches to a post, thence by land of John McClure south thirty eight perches to a post, thence still by same east forty perches and nine tenths of a perch to a post, thence south by allotment E (of Andrew Harper) seventy three perches to a post, thence along the south line of the whole tract west one hundred and fourteen perches and nine tenths of a perch to the place of beginning containing Seventy acres of land neat measure together with the appurtenance. Also all that other piece of land situate in said Township of Sadsbury and bounded as follows viz. Beginning at the south east corner of allotment F in the south line of the whole tract, thence east twenty nine perches and seven tenths of a perch to a post, thence north seventy nine perches to the center of the State road, thence north Seventy six and a half Degrees West thirty perches and five tenths of a perch to a post in the center of Said road, thence South by allotment F (of Robert Kerr and Jane Kerr) ninety eight perches to the place of beginning containing Fifteen Acres neat measure together with the appurtenances. The parties of the first, second, fourth, fifth, sixth and seventh parts grant bargain sell release and convey unto Andrew Harper and to his heirs and assigns all that certain piece of land situate in Sads. township and bounded as follows viz. Beginning at a post standing in the south line of the whole tract being the north west corner of allotment F, thence by the same north two hundred and Eighteen perches and seven tenths of a perch to a post in the north line of the Tract, Thence along the same west forty three perches and three perches [repeated] and three tenths of a perch to a post John McClures north west corner, thence by said land South one hundred and forty four perches and five tenths of a perch to a post, thence west forty five perches and six tenths of a perch by part of same land to a post, thence south by allotment D (of Robert Harper) seventy three perches to a post in the South line of the tract, thence east by said line eighty Eight perches and nine tenths of a perch to the place of beginning containing Eighty acres of Land neat Measure together with the appurtenances. The parties of the first, second, third, fifth, sixth and seventh parts do grant bargain sell release and convey unto Robert Kerr and Jane Kerr in right of the said Jane and to the heirs and assigns of the said Jane Kerr all that certain piece of land situate in Sadsbury Township and bounded as follows viz. Beginning at a post the south west corner of the purpart of Andrew Harper in the south line of the tract, thence along said line east fifty eight perches and one half of a perch to a post, thence north by parts of the allotments of Robert Harper and Elizabeth Quigley north two hundred and eighteen perches and seven tenths of a perch to a post in the north line of the whole tract, thence along said line west fifty eight perches and five tenths of a perch to a post, thence south by allotment E (of Andrew Harper) two hundred eighteen perches and seven tenths of a perch to the place of beginning Containing Eighty Acres of Land neat measure together with the appurtenances. The parties of the first, second, third, fourth, fifth and seventh parts do grant bargain sell release and convey unto John Quigley and Elizabeth Quigley in right of said Elizabeth Quigley and to the heirs and assigns of the said Elizabeth Quigley all that certain piece of land situate in Sadsbury Township and bounded as follows viz. Beginning at a post the north east corner of the whole tract, thence along the north line west sixty perches and two tenths of a perch to a post, thence by allotment F South one hundred and thirty two perches and seven tenths of a perch to the center of the state road, thence along the center of said road South Sixty seven and one half degrees west thirty perches and five tenths of a perch to a post, thence by part of allotment D South seventy nine perches to a post in the South line of the tract, thence east by said line thirty One perches and five tenths of a perch to a post the south west corner of the tract, thence along the east line of the same North two hundred eighteen perches and Seven tenths of a perch to the place of beginning containing Sixty Seven Acres and forty five perches of land neat measure together with the appurtenances. Also all the other piece of Land situate in Vernon Township and bounded as follows viz. Beginning at a post the north east corner of the purpart of Samuel Harper, thence by the same South ninety one perches and four tenths of a perch to a post, thence west twenty eight perches to a post, thence by land of John Martin north ninety one perches and four tenths of a perch to a post, thence along the north line of the whole tract West twenty eight perches to the place of beginning containing Sixteen Acres of Land neat measure together with the appurtenances. And Whereas the inquest directed by the Orphans Court of Crawford County viz. H. H. Laughlin, Isaac Walker, Hugh Cotton, Robert Harper, David Harper Junior, William Cook, Thomas McCray, John Beatty, Nathaniel Marshall, Daniel Marshall, John Breckenridge and John Miller have made partition of the estate of the said John Harper deceased as above mentioned and have made report to said Court now the parties of this Indenture, heirs of the said John Harper dec'd. do hereby ratify, adopt and confirm the Order of partition as contained in said report and do elect for our purparts the parts of said Estate which are severally and respectively allotted to us in said report with which report of said inquest this agreement of partition is in accordance and to carry which order of partition into effect this Deed is made. The said Elizabeth being of full age and by me separate from her said husband examined and the contents of this deed being made known to her declared that she did voluntarily sign and as her act deliver the same.
