All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: MK Hawn mkhawn2@gmail.com August 29, 2005, 9:30 pm Source: Cumberland County Historical Society Written: October 3, 1827 Recorded: December 13, 1827 Will of Ann Gillespie of the Borough of Newville In the name of the living and true God amen, I Ann Gillespie single woman of the Borough of Newville, Newton Township in the county of Cumberland and state of Pennsylvania being now sick and weak of Body, but of sound mind, memory and understanding [for which I desire most thankfully to praise the Almighty God] and considering the uncertainty of this transitory life and that it is appointed for all mankind once to die and come to judgment, do make and publish this my last will and testament in manner and form following: to wit principally and first of all I commend my immortal soul into the hands of God who gave it and my Body to the earth to be buried in the graveyard of the first Presbyterian church of Big Spring in a decent & Christian like manner at the discretion of my executors hereinafter named, and as touching such worldly estate wherewith it hath pleased God to bless me in this life, I give and dispose of the same in way and manner following. If there shall be found any lawful debts against me the same shall be paid. And whereas my father Nathaniel Gillespie late of Mifflin township in the county of Cumberland died intestate & leaving behind him four daughters as heirs in common, of his estate both real and personal, two of his said daughters being long since married, one to a man named George Craighead and the other to John Brown Junr., both of the county of Cumberland, and they having received their respective shares of my father's personal estate, and his real estate is yet unsold as lying and being situate in Mifflin township and Cumberland county aforesaid, being said to contain two hundred and twelve acres be the same more or less, the legal right and title to the one fourth part of said estate being vested in me by inheritance being one of the lawful heirs of my father Nathaniel Gillespie, and as such, I now hereby give devise and bequeath to my dear sister Nancy Gillespie: all my right, title, claim and interest in the one fourth part of my father's real estate, as before mentioned with the appurtenances thereunto belonging, as being free from all debts judgments mortgages and demands whatsoever, and of every sort and kind, being subject to the laws of the commonwealth as to taxes that may become due thereon, to her the said Nancy Gillespie his heirs and assigns forever, the profits arising from the one half of said estate to be hers so long as said estate shall remain unsold, and when sold by the administrators on said estate John Brown Junr. and George Brattan, the complete half of the purchase money to be paid to her the said Nancy Gillespie according to the terms of sale, I likewise give and bequeath to my sister Nancy Gillespie all and singular my personal estate consisting of household & kitchen furniture, every item and article thereunto belonging, embracing bedsteads and bed cloths, desks, bureaus, chests of drawers tables chairs, with every article now belonging to me, with one cow and horse creatures, to her and to her proper use and behoof forever also all my money books, with notes and papers containing accounts of any kinds and my carpets. I only reserve out of my estate and estates: one mourning dress to my sister Mrs. Eleanor Brown not exceeding ten dollars price. Likewise the same mourning dress or one of the same value of ten dollars to my sister Mrs. Mary Craighead and these dresses to be given to these women as soon as shall be found convenient after my deceases. I likewise give and bequeath to Tabitha Reed, the young woman that was raised in our family the sum of fifteen dollars if she is yet alive, as soon as shall be convenient for my executors to pay the same, to her use. And lastly I do hereby nominate and constitute my cousin Mr. George Brattan and John Harper Esq. of Mifflin township to be the executors of this my will hereby revoking all other wills, legacies and bequests by heretofore made, and declaring this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal at the Borough of Newville, the third day of October in the year of our lord one thousand eight hundred and twenty seven AD 1827. Ann Gillespie Signed, sealed, published, pronounced and declared by the said testatrix as her last will and testament in the presence of us who in her presence and at her request have subscribed as witnesses. John Johnson, William Richey Cumberland County This 13th day of December AD 1827 Before me Jacob Hendel and William Richey Esq. the subscribing witnesses to the within will, and being duly sworn according to the law depose and say that they were present and saw and heard the testatrix Ann Gillespie sign, seal, publish, pronounce & declare the within instrument of writing as and for her last will and testament, that at the time of so doing she was of perfect and sound mind memory and understanding to the best of their knowledge, observation & belief, that they subscribed their names thereto as witnesses at the request and in the presence of the testatrix, and in the presence of each other, the erasures & interleniations were made before signing - Sworn & subscribed John Johnson Before me William Richey Jacob Hendel, Regr. Cumberland County I do certify that the foregoing is a true copy of the last will and testament of Ann Gillespie decd. Which is duly proven & remains filed of record in the Register's office at Carlisle in & for said County.
