All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Suzanne Bettac bettacssl@juno.com January 9, 2019, 8:03 pm Written: March 20, 1782 Recorded: March 20, 1782 Franklin Co., PA DB 5:196 ( image 113 of 565 on Familysearch) This Indenture made the twentyeth day of March in the Year of our Lord one thousand seven hundred and eight two Between Matthew Shields of the Township of Letterkenny in the County of Cumberland and State of Pennsylvania Farmer and Mary his wife and James Beard of the Township and County aforesaid Farmer and Jane his Wife of the one part and James Machon son of John Machan of the same Place of the other part Whereas, Benjamin Chambers of the Town of Chambersburg in the County aforesaid and Jane his wife by Deed dated the eighth day of December 1778 for the consideration therein mentioned did grant and confirm to a Certain James McKane his heirs and assigns the following described Lot or piece of Ground situate in the said town of Chambersburg, known on the general Plan of the said Town by- the Number Eighty one. Beginning at a Post on Second Street with said Street Southward sixty four feet to a sisteen --- Alley, with said Alley Westward two hundred fifty six feet to a sixteen Feet Alley, with said Alley Northward Sixty four feet to a Lot Number 82 with said Lot eastward two hundred and fifty six Feet to the place of the beginning Together with the Appurtenances And whereas the said James McKean being so seized in Fee of and in the said Lot of Ground died Intestate as to any Disposal thereof leaving issue the aforesaid Mary the wife of said Matthew Shields, the aforesaid Jane the Wife of the said James Beard and Ann the Wife of the said John Machan and leaving a Widow named Martha who hath since released all her right and Title of Dower of in and to all & singular the Lands Tenements and Heriditaments which were of the said James McKean her late Husband at the time of his decease to said Matthew Shields James Beard and John Machan Now this Indenture Witnesses that the said Matthew Shields and Mary his Wife and James Beard and Jane his Wife for And in Consideration of the Sum of Five shillings in specie to them in Hand paid by the said James Machan at and before the Sealing and delivery of these presents (the receipt of whereof is hereby Acknowledged) Have and each of them, Hath granted bargained and sold remised released and forever quit claimed and by these Presents DO and each of them Doth Grant bargain and sell remise Release and Forever quit claim to the said James Machan his Heirs and Assigns All the estate Right Title Interest Share part purport Claim and demand Whatsoever of them the same Matthew Sheilds and Mary his Wife, James Beard and Jane his Wife and every of them of in and to the aforesaid Lot or piece of Ground Number eighty one herein before described and every part thereof with the Apurtenances To Have and to hold, All the Singular the Premises hereby granted or mentioned so to be with the Appurtenances unto the said James Machan his heirs and assigns to the only proper Use and behoof of him the said James Machan his Heirs and assigns Forever Subject to the Annual Ground Rent due and to become due and payable thereout and there for to the aforesaid Benjamin Chambers his heirs and assigns forever, In Witness whereof the said parties to these presents Have hereunto interchangeably set their Jands and seals, Sated the day and Year first herein before Written, Sealed and Delivered Matthew Sheilds (seal) Mary Shields (seal) James Beard (seal) Jean Beard (seal) In the presence of, John Ferguson, Thomas Wier. Received the day of the date of the forgoing Instrument of writing from the aforesaid James Machan or on his behalf the Sum of Five Shillings specie, it being the full consideration money in the said Writing mentioned, Test, John Ferguson Matthew Shields, Thos Wier, James Beard Cumberland Co SS Be it remembered that on the 20th day of March in the year of our Lord one thousand seven hundred and eighty one, before me the Subscriber, one of the Justices of the peace for the County aforesaid, came Mathew Shields and Mary his wife and James Beard and Jane his wife in the foregoing Instrument of Writing named, and Acknowledged the same Instrument to be their act and deed respectively, to the Intent the same may be Recorded, the said Mary and Jane thereunto voluntarily Consenting, they both being of full age, apart from their respective Husbands by me examined, and the Contents of the said Writing being fully made known to them In Testimony whereof I have hereunto set my hand and seal the day and year aforesaid, Geo Mathews, A true copy taken from the Original the 28th day of September 1901 Edw Crawford Recorder Additional Comments: I believe there is an error on the date of the deed. Clearly this was registered in Franklin County, Pa on 20 Mar 1782 but the Cumberland County, Pa clerk recorded it with a year of 1781.
