Docket #2 Page 277 (Feb 27, 1781) Came into Court Margaret Silver late Margaret McCurdy late Widow and Administratrix and John McCurdy Administrator of the Estate of John McCurdy late of Allen Township Deceased and ________ an ________ of their administration and the Court having carefully examined and _________ the same do find remaining in the Hands of the administrators a Balance of twenty seven Pounds one Shilling & three pence subject to Distribution according to Law. Viz. to Margaret the Widow nine Pounds and five pence to David McCurdy the Eldest Son Two Pounds Fifteen Shillings and seven pence to John McCurdy one pound seven shillings and nine pence to William McCurdy one Pound seven Shillings and nine pence to John McCurdy one pound seven shillings and nine pence to Samuel McCurdy one Pound seven shillings ____ pence, to Jennet McCurdy one Pound seven shillings and nine pence, to Joseph McCurdy one Pound seven shillings and nine pence to Robert McCurdy one Pound seven shillings & nine pence Martha McCurdy one Pound seven Shillings and nine pence to Moses McCurdy one Pound seven shillings and nine pence to Mary McCurdy one Pound seven shillings and nine pence to Jane McCurdy ___ McCurdy _____ McCurdy Admt to hay The Petition of John McCurdy one of the Sons of John McCurdy late of Allen township Derry _________ in Court Setting forth that the Petitioners brther died Intestate ________ _________ of a Certain Tract of Land and Improvement Situate in Allen Township adjoining Land of Abraham ____, Jacob Norman, John Greer, Michal _____ and John Lamb and Containing about two hundred acres be the same more or less that he left Margaret his Widow late the Wife but now the Widow James Silver late of the Township aforesaid D______ and twelve Children Lawful Spouse to survive him. The request of the Petitionor is that the Court will be pleased to award an Inquest to Partition of the ____ Tract of Land and Improvement among the widow and Children of the Intestate of the same can be Divided without Prejudice to or Spoiling of the whole: but if the same cannot be Divided amongst the Widow and Children of the Intestate without Prejudice to or spoiling of the whole, then to Value the whole undivided according to the purport and True meaning of the Acts of the Court do ____ the High Sheriff of the County af'd to Survivor on an Inquest and go to the Plantation and _____ of Land in said Petition mentioned and if they find that the _____ cannot be divided amongst the Parties in Said Petition mentioned without Prejudice to or Spoiling the whole that then they appraise the same and make report to ___ __ at State Orphan Court Pay the Court N.B. the Children's named of the afsd deceased are David the Eldest Son_________ John, William, James, Samuel, Jannet, Joseph, Robert, Martha, Moses, Mary & Jane Wit of Partition Cumberland County O.C. Docket #2 page 278 FEb. 1781 O.C. Docket #3 page 57 (Cumberland County) An Orphan Court held at Carlisle the tenth day of April in the year of our Lord one thousand seven hundred and eighty nine by John Jordan John Agnew and Ephraim Hut Esquires Justices of the Same Court. On motion of Thomas Duncan Esq setting forth that John McCurdy had neglected to pay the costs of the Inquisition on the Real Estate of his Father John McCurdy who died intestate and likewise to give bonds with sufficient security for the payment of the respective shares of his Brothers and Sisters agreeable to a former order of Orphan Court Whereupon the Court set aside said Inquisition & Valuation and award a new writ to the Sheriff of Cumberland County is the dived the fare estate to and amongst the heirs of said deceased if the same could be done without prejudice to & spoiling the whole, and if not, to value & appraise the same and make return of his prodeedings to the State Orphan Court to be held at Carlisle the thirteenth day of August ensuing By the Court Orphans Court Docket #3 Page 64 (Aug 13, 1789) By the Court Came into Court Charles Leeper Esquire high Sheriff of the County of Cumberland and produces the unit of Partition or Valuation (being the 3rd) of the real estate of John McCurdy deceased together with the Inquisition thereto annexed whereby it appear that the said not estate of the said John McCurdy would not divide amongst the heirs & representatives of the said Deceased without injury to Spoiling the whole thereof, which partition the said Sheriff was commanded to make if without prejudice to the State he could, And the said Charles Leeper Esq Sheriff afsd taking with him twelve honest & lawful men of his Bailiwick to the Premisses did repair & upon consideration & inquiry finding that partition of the State of the said John McCurdy dont. not be made agreeably to direction, the said Sheriff with the Inquest aforesaid and Value & appraise the said Estate, con____ing of one tract of land situate in Allen Township containing two hundred and ten acres more or less to the ____ forty-four Shillings and four pence lawful money of Pennsylvania per acre which Valuation or appraisement the Court on consideration confirm & establish the said tract of land according to a late survey made thereof contains two hundred & forty six acres & one hundred & forty six perches & allowance... By the Court O.C. Docket #3 Page 72 At an orphan Court held at Carlisle the thirteenth day of March in the year of our Lord one thousand seven hundred and ninety by John Jordan, Samuel Irvine and Ephraim Steel Esquire Justices of the Same Court Came into Court Robert McCurdy one of the sons of John McCurdy deceased and made known to the Court that he is willing to accept of the real estate of the said deceased who died Intestate, at the appraisement thereof made by Charles Leeper Esquire and having produced Conveyance from David McCurdy the eldest son of said Deceased and from several other of the heirs of the said John McCurdy dec'd for their respective shares in the real estate of their late father the said deceased and being willing to pay the other heirs their shares of the estate and for the securing the payment of more heirs yet unsatisfied, their shares, the said Robert McCurdy hath produced to the Court his bonds with William Boor of East Pennsbro Township yeoman, security as follows Viz to John McCurdy for sixty eight Pounds Sixteen Shillings and eight pence Conditioned for the payment of thirty four Pounds eight shillings and four pence real specie on the fourteenth day of March which will be in the year of our lord one thousand seven hundred and ninety one with lawful intent on the same from the seventeenth day of September in the year of our Lord one thousand seven hundred & ninety, a bond to James McCurdy of the same tenor and date, to Robert W Mullen & Jennet his wife a bond of the same tenor and date, one to Samuel McCurdy of the same tenor and date, one to William Lyon Esqr in trust for the Creditor of Joseph McCurdy decd of the same tenor and date, and one to George Lochridge and Martha his wife of the same tenor and date and one bond from him the said Robert McCurdy to William Boor Guardian of Catharine McCurdy minor orphan Daughter of Moses McCurdy decd which several bonds and security the Court do approve of they amounting to two hundred and forty pounds eighteen shillings and four pence which together with sixty eight pounds sixteen shillings and eight pence the two shares of David the eldest son and thirty four pounds eight shillings & four pence the share of Elizabeth orphan Daughter of William McCurdy decd who intermarried with William Hunter, and thirty four pounds eight shillings & four pence the share of Jean intermarried with William Martin which said last three conveyed their respective shares of said estate to the aforesaid Robert McCurdy as appears of record and sixty eight pounds sixteen shillings and eight pence the two shares of Robert and Jean his full sister who died intestate and ninety six pounds fourteen shillings and eleven pence being the amount of expences for surveying Making out Patent for the land and the costs of Court Clerk Allen and Sheriff, amounts to five hundred & forty four pounds three shillings and three pence the total sum to which the Inquest returned by the aforsaid Charles Liiper Esq appraised the lands of the said John McCurdy deceased containing two hundred & forty six acres 11.7 peches and allowance situate in the Township in Cumberland County being valued by the inquest afsd at forty four shillings & four pence _____. The Court having approved of the Premises on consideration order and decree that the said Robert Mccurdy his heirs and assigns shall hold _____ and enjoy the said tract of land containing two hundred and forty six acres & one hundred & forty seven perches & allow and situate in Allen Township in Cumberland County aforesaid of which the said John McCurdy died seized and ______ as fully ______ & absolutely on the said John McCurdy held and ______ the same in his life time By the Court The Account of Margaret Silver late Margaret McCurdy for of all and singular the Goods and Chattels Rights and Credits who died Intestate, as will of all and singular the Goods and Chattels ___ Death, which came to their Stands Possession or Knowledge as of the propri_____. The said Accomptants charge themselves with all and singular the Goods and Chattels of the said Decedent which came to their Hands Possession or Knowledges, particularly mentioned in an Inventory thereof remaining in the Registor's Office at Carlisle amounting to Amount of Sales above the Inventory 5.9.4 Cash rec'ed of Walter Hood not in the Inventory 4.2.0 Cash reced of David McCurdy a Debt 4.7.6 28.4.10 This accompt Examined and _____ the 21st Day of February 1781 the Administration being Sworn thereto Willm Lyon Reg.
