Witnesseth whereas Alexander McNair of Toboin township in the County of Cumberland aforesaid seized in Fee of a certain Tract of Land situate in said Township supposed ___* contain one hundred and sixty nine acres and the usual allowance for roads ____* being so seized by his last will and Testament made the twenty third day of September in the year of our Lord one thousand seven hundred and ninety one Did devise and bequeath unto Alexander McNair, Jr. one full portion ___* half of the aforementioned Tract of Land subject to certain conditions in said will or testament mentioned, as by said Testament filed in the Orphans Court office of the County of Cumberland aforesaid reference therein to be had may more fully and at large appear and whereas the said Alexander McNair, Jr. by his Deed Poll made and bearing date the tenth day of March in the year of our Lord One Thousand seven hundred and ninety six for the consideration therein mentioned Did Grant, Bargain, and Sell in Fee simple to the said Dunning McNair all his Right, Title, Interest, Claim and Demand of in and to an undivided portion or half of the aforementioned Tract of Land supposed to contain in the whole one hundred and sixty nine acres as by said Poll recorded in the Office for recording of Deeds & in and for the County of Cumberland in Book D, page 336. Reference thereunto being had may more fully and at large appear. Now this Indenture witnesseth that the said Dunning McNair and Anne McNair his wife, for and in consideration of the sum of Five hundred pounds lawful money of Pennsylvania to them in hand paid by the said Christopher Bower, at and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged. Have Granted, Bargained and Sold, aliened, released, enfeoffed and confirmed and by these presents do Grant bargain and sell alien, release, enfeoff and confirm unto the said Christopher Bower all the aforementioned undivided moiety of the aforesaid tract of Land Situate in Toboin Township and County of Cumberland aforesaid, the whole supposed to contain one hundred and sixty nine acres and the usual allowance of six pr cent for Roads. Together with all and singular the hereditaments and appurtenances to the same belonging or in any wise and the reversions and remainders, rents issues and profits thereof and all the right Title, Interest, Claim and Demand of them the said Dunning McNair and Anne his wife of in and to the same To have and to hold the same to him the said Christopher Bower his heirs and assigns, to the only proper use benefit and behoof of him the said Christopher Bower his heirs and assigns forever. And the said Dunning McNair doth hereby for himself his heirs Executors and administrators covenant and agree to and with the said Christopher Bower his heirs and assigns, That he the said Dunning McNair his heirs Executors and administrators, the above granted premises to the said Christopher Bower his heirs and assigns, from and against any person or persons whatsoever lawfully claiming or to claim the same by through or under him or any other person or persons whatsoever shall and will warrant and forever defend.
