I John Brown, sen. of Frankford Township, Cumberland County, and Commonwealth of Pennsylvania, being of sound & disposing mind and memory, so make, ordain and publish this my last will and testament in manner and form following, viz: First I allow all my just debts and funeral expenses to be paid out of my personal estate as soon as convenient after my decease. 2nd: I give & bequeath to my beloved wife Margaret (if she survive me) a decent and comfortable maintenance out of that part of my […] herafter devised to my some James' heirs, while she lives together with all necessary apparel, her bed, bedstand, and clothing. 3rd I give and devise to my son John that [line missing] or tract to be divided off by a line beginning at a stone corner between lands of George Gillespie, Adam Britains' heirs and by my lands, […] thence by land of said Britain's heirs to land of Thomas Kennedy's heirs, thence by said Kennedy's heirs to the line between this land and mine comes at the run which passes my mansion house, from thence along the line between land of Jacob Worst's heirs and my land about fifteen or twenty […] until it passes the piece of clear land where a cabin once stood on the said line, from thence a division line through my farm as follows, viz: from this place to run a right angle with the last line until it strikes the meadow fence, thence along the said fence until it reach the lower field at a small white oak notched, thence between the meadow and field leaving the meadow on the right to a small white oak and hickory which are notched, thence along the fence between the upland and the meadow to the lower corner of the garden occupied by my son John, thence by a straight line to the small hickory growing out of one root by the lane leaving a spring on the N. west side of said line, thence along the lane into the fording of the run towards my mansion house, thence up the run one perch, thence back along the lane the several courses thereof to the corner stone or place of beginning to be held by him, his heirs and assigns from, which bequests are to be in full of his share of my estate, and also in full of any expense for building or repairs he may have made or may make on my said land. 4th: I give and devise to my daughter Jane, widow of John Scouller, deceased, the one third part of the remaining half of my land situate in Clermont County, state of Ohio, on the east fork of Little Miami River, to be held by her, her heirs and assigns forever, about one half of the whole of said tract having been grated and conveyed by me to my son William and now occupied by him which I consider as in full of his share of my estate. 5th: I give and devise to my daughter Mary the remaining part of my said tract of land situate in Clermont County as state of Ohio not already devised or conveyed away - it to be held by her, her heirs and assigns forever, with a good horse and saddle and bridle, a good feather bed, bedclothes and bedstead, and one half of the cupboard furniture and a cow, exclusive of what she got of her sister Eleanor Douglass. 6th: I give and devise all the residue of my estate both real and personal to my deceased son James' children, viz: John Culbertson Brown, Eleanor Brown, Mary Brown and James Brackenridge Brown to them their heirs and assigns forever, to be divided between them as follows, viz: I allow my estate left to my son James' children to be divide into five equal parts or shares and John Culbertson Brown to have two shares, and Eleanor Brown, Mary Brown and James Brackenridge Brown to get one share each, this land to remain unsold as long as my wife lives. But after her death if it should be thought more advantageous for the children in the opinion of their Guardians and the Executors o this my last will and testament that the land should be sold, then I do hereby authorize and empower my executors hereinafter named to make sale of the land hereby devised to said children and to make good and sufficient Deed or Deeds of Conveyances in fee simple to the purchase, or purchases. 7th: I give and bequeath to my daughter-in-law Martha Brown one bed and bedding, the one half of the cupboard furniture, not bequeathed to my daughter Mary, all the thick cloth that may be in the house at the time of my decease (if any), and the one-half of any flannel that may be in the house at the time of my decease, and the one-half of any linen, and the other half of both flannel and linen I give to my daughter Mary. I also allow my said daughter-in-law Martha to retain any property she brought with her when she intermarried with my son James. And I do hereby nominate, constitute, and appoint John Harper, and Isaiah Graham to be the Executors of this my last will and testament hereby revoking all other wills by me heretofore made, and declaring this and this only as my last will and testament. In witness whereof I have hereunto set my hand and seal this twenty sixth day of May AD one thousand eight hundred and thirty four. John Brown Signed, sealed, published and declared by the said John Brown to be his last will and testament who at the request and in the presence of each other have subscribed as witnesses - William Gillespie, James G. Gillespie Codicil. I, the beforementioned John Brown do hereby make and publish this codicil to the foregoing last will and testament and declare it as a part of the same, […] In consequence of the resignation of my friend Isaiah Graham, Esq who was therein appointed one of the Executors thereof and also John Harper, the other Executor therein named, I do hereby nominate, constitute and appoint my friends Alexander Kerr and James Wallace to be the Executors of my said will in the room of Isaiah Graham and John Harper. In witness whereof I set my hand and seal this twenty- first day of February, one thousand eight hundred and thirty five.
