The Deputy Register of Wills left the date open but I still have the original I received along with the date on the reverse side of the will and also the envelope it was sent to me in. There is a copy in the Patton Exchange Letter, Volume 20, No. 4, dated May 1996, on pages 317 and 318. OLD BOOK "C", p. 69 MATTHEW PATTONS) In the name of God Amen I Matthew Patton of Peters LAST WILL & TEST.) Township County of Cumberland and Province of Pennsylvania being weak in body but of sound mind memory and Judgment Do make and ordain this my last Will and Testament in the following manner and form Viz. ... First I order that all my just debts and funeral expenses shall be duly paid out of my personal estate and as to the rest of my Estate Real and Personal of which I am or may die possessed of I give devise and bequeath in the following manner Viz: ... I give and allow to my wife Elizabeth the sum of ten pounds yearly and every year to be raised of the half of this Loudon plantation during her natural life or so much grain wheat ry corn or the like as shall be the value of ten pounds according to the current price to be yearly given to her during life if she shall chose the same rather than the money - I allow her the use of this my dwellilng during life and the half of the garden and free privilege of water and firewood on this plantation if she shall please to live on it - I allow her what portion of my household furniture she shall chuse and the rest shall be sold by my executors - Also give and bequeath to her my said wife my negro wench Sally to wait on her and if the said wench shall appear stubborn and not duly please her mistress I allow that my Executors at my wife('s) request hire out the said wench and that (the and that) they hire a girl instead to wait on her mistress and also I allow my wife two cows to be at her own choice and to be kept by whoever of my children she may chuse to live with and at theier expence - ... I also do by this Will ratify and confirm the deed of gift of the one half of this Loudon plantation and tract of land made to my son James Patton bearing date the twenty fourth day of March in the yar of our Lord one thousand seven hundred and seventy three according to the terms and interest thereof ... and also the deed therein expressed I do give and bequeath to my son Robert the one full half of the plantation and tract of land whereon he now lives and allow the same full half to be divided off to him according to the rights and privileges granted and given by the aforementioined deed to my son Samuel that they may have of the said plantation and tract share and share alike. ... I give and bequeath unto my son John the sum of fifty pounds and to my son Matthew the sum of fifty pounds and to my son Thomas the sum of fifty pounds to be raised and paid at the time and manner following and ... I give to my Granddaughters Elizabeth Wilson and Mary Wilson the sum of Twenty pounds each... ... I allow the one half of this plantation on which I now live as reserved from the other half give by deed to my son James as above mentioned to be at the death of my wife valued by three indifferent men chosen jointly by my sons James, Samuel & Robert and after paying the Legacies bequeathed to my sons John, Matthew and Thomas and my two Granddaughters Elizabeth and Mary Wilson the Remainder to be equally divided between my sons James, Samuel and Robert - ... I allow my Granddaughters as above not to be paid till the(y) arrive at the age of Eighteen Years. ... I give to my daughter Sarah the sum of Five schillings if demanded and ... I Order my personal estate to be sold (except the Reserved in power for my wife) and after the discharging my debts the remainder to be put to interest and Reserved to assist in paying the Legacies to my sons John, Mattew & Thomas & the Grandchildren above mentioned. And Lastly it is my will that all these to whom I have above bequeathed any portion of my estate shall hold the same for themselves their wives & assigns forever... I do nominate constitute & appoint my sons James and Robert Patton to be whole and sole executors of this my last will & Testament & I appoint my friend James M. Donell to be Overseer of my will to see the same executed according to the Intent & meaning thereof. In Testimony whereof I have to this my Last Will (Renouncing & setting aside all other wills by me heretofore made) Set my hand and Seal this Sixteenth day of August in the Year of our Lour one thousand seven hundred and seventy six... Before me, John Creigh register for the Probate of Wills & Granting Leters of Administration in and for the County of Cumberland afore, Personally came Robert Campbell and William Mitchel(l) two of the three subscribing witnesses to the within instrument of Writing who being duly swown according to law depose and Said that the(y) were personally present and saw and heard Matthew Patton sig (by making his mark) Seal publish and declare the Same as and for his last will and Testament that at his so doing he was of Sound mind & memory as they believe that the(y) subscribed their names as witnesses to the Same in the presence of the said Testator and in the presence of John Welch the other subscribing Witness who the(y) saw subscribe his name to the same... /s/ Robert Campbell /s/ William Mitchell Sworn and subscribed Jany 7th 1778 Before John Creigh Be it remembered that on the 7th day of Jany. 1778 the Testament & last Will of Matthew Patton Dec'd was legally provided of which the foregoing record is a true copy & Letters Testamentary issued in Common Form to James Patton, Robert Patton Executors herein names Inventory and account to be exhibited in the time appointed by law.
