Last Will and Testament of John Scouller dec'd of Mifflin Township I John Scouller of Mifflin township Cumberland County and state of Pennsylvania calling to mind my mortality, and that it is appointed for all men once to die, do this 3rd day of October 1805 make and ordain this as my last will and testament for the disposal of my property of what providence has favoured me with in this life in manner and form following viz - First I give and bequeath to my eldest daughter Agnes wife of John Wallace that plantation and tract of lands in Frankford township and state aforesaid (called Hicory Valley in the Patton) whereon she now lives as also the conveyance of forty acres and some [perches?} I bought of Elenor Porter (reference to be had thereto) to be enjoyed by her, her heirs and assigns forever in fee simple. Item I give and bequeath unto my daughter Margaret wife of James Young the sum of eight hundred and fifty pounds Pennsylvania currency above what she has got and that in notes or bonds or my outstanding deteres. Item I give and bequeath unto my son John Scouller the plantation and mills called Big Run Mill, whereon we now live, also the Patton from [illegible] adjoining the other and warrant round the mill [illegible] to be enjoyed by him, his heirs and assigns in fee simple forever and all books of Law, Arithmitick, Mathamaticks, Philosophy, Astronomy, the Big Bible and quotations thereon and all Books has has bought himself. Item I give and bequeath unto my daughter Mary, wife of Joseph McKee the sum of one thousand pounds Pennsylvania currency in notes or bonds on my outstanding deteres besides what she has got and all the rest of my Books not bequeathed I allow to be equally divided between my children; I bequeath all the rest of my goods and chattels rights and [creeds?] and book accounts unto my son John Scouller to be enjoyed by him forever and furthermore if there shall arise any misunderstanding or difference between my legatees, I order and ordain that they shall choose two honest and judicious men and the two men to be chosen shall choose a third man to judge, settle and determine the matter in difference according to truth, justice and equity and substance of what I have said above and a majority of them arguing and giving in their judgement in writing it shall be final, and no other prosecution shall be made above an audit under the penalty of forfeiting the plea, and I do hereby constitute and ordain my son John Scouller to be my whole and sole Executor of this my last will and testament utterly revoking all of the wills, testaments, legacyes, and Executors, ratifying and confirming this and no other to be my last will and testament in writing whereof I have set my hand and seal the day and year first above written.
