All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/dauphin/ _______________________________________________ 1805 9 April 1805 Deed Book O Vol 1 Page 483 Joseph Gingery to Tobias Miller This Indenture Made the ninth day of April in the year of our Lord one thousand eight hundred and five between Joseph Gingery of Derry Township in the county of Dauphin and State of Pennsylvania of the one part and Tobias Miller now of the Township County and State aforesaid of the other Part Whereas the Commonwealth of Pennsylvania by patent bearing date the twenty sixth day of March in the year of our Lord one thousand eight hundred and five for the consideration therein mentioned did grant and confirm unto the aforesaid Joseph Gingery and to his heirs and assigns a certain tract of Land situate in Derry Township in the county of Dauphin and State of Pennsylvania aforesaid called Kingston Beginning at a Stone thence by lands of David Gingery north forty nine and three quarter degrees west one hundred and fifty five perches to a Stone North thirty one degrees and a half East one hundred and sixteen perches and five tenths to a Stone thence by lands of Ludwick Wolfley and land of Jacob Shafner south sixty five degrees East one hundred forty eight perches and eight lenths to a Spanish Oak and thence by land of Joseph Breson dec'd South twenty nine degrees and a half west one hundred forty nine perches to the Beginning containing one hundred seventeen acres one hundred seventy two perches and allowances of six per cent for roads with the appurtenaces as in and by the said Patent enrolled in the roto office for the commonwealth in Patent book No 55 page 457 will appear Now this Indenture Witnesseth that the said Joseph Gingery for and in consideration of the Sum of Eleven hundred pounds gold or silver ___________ in hand paid by the said Tobias Miller at and before the sealing and Delivery of these presents the reciet and payment whereof the said Joseph Gingery doth hereby acknowledge ___ thereof and therefrom Doth acquit and forever discharge the said Tobias Miller his heirs executors and administrators Have granted bargained sold aliened enfeoffed released and confirmed and by these present doth grant bargain sell alien enfeoff release and confirm unto the said Tobias Miller his heirs and assigns the above described tract of Land of one hundred and seventeen acres one hundred twenty two perches and allowance with the appurtenances Together with all and singular the houses outhouses buildings improvements gardens orchards fences woods ways waters water courses rights priviledges advantages & hereditaments and appurtences whatsoever thereunto belonging or in any wise appurtaining and the reversions and remainders rents issues and profits thereof and also all the estate right title Interest _____ property claim and Demand whatsoever of him the said Joseph Gingery in law or equity or otherwise howsoever of in of or out of the same or any party thereof. To Have and to hold the said tract of Land of one hundred and seventeen acres one hundred twenty two perches and allowance hereby granted mentioned or intended is to be Hereditaments and Primaces with the appurtenaces unto the said Tobias Miller his heirs and assigns to the only proper use benefit and behoof of him the said Tobias Miller his heirs and assigns forever Under and Subject to the liberty of entering in and upon the above mentioned and Described tract of Land and at the distance of ten perches and a half from John Gingereys land to build erect maintain Support a dam across a certain stream of water running through the aforesaid Primaces and swell the same anyheighth not exceeding fourteen inches above the customary heighth and to dig one or more ditches from said Dam to the lands of said John Gingrich and convey the water out of said Dam along said ditches for the purpose of watering meadow and also the necessary Liberty of Passing to from and about the said Dam through the primaces hereby granted at anytime and at thall times hereafter forever which said reserve is made for the use of said John Gingrich his heirs and assigns forever and the said Tobias Miller his heirs or assigns shall not mislead obstruct or impede the passage of the said water but let the same pass freely Every other day for the purpose aforesaid and the said Joseph Gingery for himself and his heirs doth hereby covenant and Grant to and with the said Tobias Miiller his heirs and assigns that he the said Joseph Gingrich and his heirs the said tract of Land of one hundred and seventeen acres on a hundred twenty two perches and allowance as above bounded limited and described with the appurtenances and every part thereof unto him the said Tobias Miller his heirs and assigns against him the said Joseph Gingrich and his heirs and against all and every other person or persons whatsoever lawfully claiming or to claim the Same or any part thereof shall and will warrant and forever Defend by these presents In Witness whereof the said Joseph Gingrich hath hereunto set his hand and seal the day and year first above written Sealed and Delivered in the Presence of us Joseph Gingrich seal Herny Musser?
