We encourage links to the state and county table of contents. ____________________________________________________________ Indenture between HENRY STONE and SAMUEL HAGERTY; March 7, 1865 Book 17, Page 303 This Indenture made and confirmed this twenty seventh day of March one thousand and eight hundred and sixty five, witnesseth that Henry Stone of Perry Township, Fayette County, State of Pennsylvania for and in consideration of the sum of fifty dollars in hand paid by Samuel Hagerty the receipt whereof is hereby acknowledged, hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Samuel Hagerty all the rights, title and interest in and to a certain lot of stone coal (subject ---- (illegible) to certain restrictions herein-after mentioned, situated near the mouth of Vanmeters Run. [ What follows next is the survey description, and this initially states, "Beginning at a post-corner of Samuel Hagerty coal lot... Due to the mention of Vanmeters Run and the Samuel Hagerty coal lot, I place this new "coal lot" acquisition as adjacent to that lot deeded in Book 17, Page 272-273. The wording in this contract seems to say that Samuel Hagerty is purchasing the rights to the coal only, and the "soil and timber" remains a property of Henry Stone.] to have and to hold all the rights, title and interest of and with the stone coal within the above described lot. Together with privilege to ---- and ---- to and from the same forever or until all the coal in said lot shall become exhausted. He the said henry Stone reserving to himself exclusively the right of soil and timber on said lot, this lot being the same purchased by Henry Stone of Thomas Wilkinson by indenture of him and Samuel Browneller, bearing date July the fourteenth one thousand eight hundred and fifty two. Witnesseth, the said Henry Stone hath set his hand and seal. Attested to by: James G. McDonald; J. R. McDonald of Fayette County Be It Known that on the 20th day of May AD 1865 before me the ---- one of the justices of the peace in and for said county personally appeared Henry Stone and acknowledged the foregoing deed or indenture to be his act and deed and desired the same might be recorded as suck.
