We encourage links to the state and county table of contents. ____________________________________________________________ This Indenture made this third day of December in the year of Our Lord eighteen hundred and thirty six between Alexander McClelland & Bathsheba his wife of the county of Fayette and the sate of Pennsylvania of the other part, Witnesseth that the said Alexander McClelland and Bathsheba his wife for and in consideration of the sum of twelve hundred and eighty seven dollars lawful money of the United States to them in hand paid by the said Bonaparte Hardin at or before the signing sealing and delivery of these presents the receipt whereof is hereby acknowledged by them the said Alexander McClelland and Bathsheba his wife and they themselves therwith fully satisfied have granted bargained and sold released and confirmed and by these presents do grant bargain sell release and confirm unto him the said Bonaparte Hardin his heirs and assigns forever, a certain tract of land containing seventy one and one half acres, it being a part of two surveys; one patented to Alexander McClelland containing three hundred and sixty acres and sixty perches by the Commonwealth of Pennsylvania dated the fourth day of July in the year of our Lord one thousand eight hundred and twenty ninethe other tract was patented by the Commonwealth of Pennsylvania patented to Joseph Hunt bearing the date the 31st of March 1789 for 371 acres. And by him transferred to George Tobin and by him transferred to Nathaniel Martin and by him transferred to Alexander McClelland aforesaid. And Bounded as followeth: Beginning at stones and stake corner to Alexander McClelland's home place near a pair of Bars N. 49 2 E.11.6 perches to a corner of an acre laid off for coal bank, south, 492 E. 13 p. to stones & stake, N 492 E.23.5 to stones in a fence corner, thence with the same N. 682 W 26 perches to stones, thence N.262 E.29 perches to White Oak, thence N. 75 W. 16 perches to stones; thence N. 4 W. 14 perches to stones near sugar tree in lane, thence North 87 : E 49.7 perches up to the lane to a post, thence south 73 : E. 33.6 perches to stones on the edge of Big road, thence N. 25 E. 7 perches to stones near a White Oak thence S. 41 3 E. 26.4 perches tp stone near road to Brownfields Coal Bank thence S 15 E. 57.6 poles to post in field, thence N. 74 : E. 11.6 poles to post & pointers thence south 60 : E. 8 perches to a hickory Revd Fairchilds Corner, thence with his line S. 34 : W. 32 perches to post near coal bank, thence S. 74 222 W. 112 perches to post in lane on Joseph Baxters line, thence N. 15 52' W 23.4 perches to beginning containing seventy one and one half acres Strict measure With the appurtenances to have and to hold the said tract or parcel of land with its appurtenances unto the said Bonaparte Hardin his heirs and assigns forever with all its ways woods waters whatsoever and all and singular the improvements that is made or is hereafter made on it of his orchards fences Together with rents issue profits or advantages therefrom arising or on anywise appertaining to the only proper use and behoof of him the said Bonaparte Hardin his heirs or assigns forever. And they the said Alexander McClelland and Bathsheba his wife do for themselves thus heirs executors and administrators covenant to and with the said Bonaparte Hardin his heirs executors and assigns that they the said Alexander McClelland and Bathsheba his wife are now seized with a good perfect and indisputable estate in fee simple of in and to the before indentured premises. And that they have full power Just and absolute authority to sell and convey the same and that the same is now and so forever shall remain free and clear of all former gifts and grants bargains sales mortgage deeds of trust and Judgments Excutions troubles or encumbrances whatever by them the said Alexander McClelland and Bathsheba his wife done suffered or committed toughing or in any wise respecting the said bargained premises, and they the Alexander McClelland and Bethsheba his wife do for themselves & their heirs the said bargained premises every part and parcel thereof unto the said Bonaparte Hardin his heirs and assigns against the cliam or claims of all and every other person or persons whatsoever of right or title thereto shall & will by these presents forever warrant and defend, & further they the said Alexander McClelland and Bathsheba his wife doth covenant and agree to and with the said Bonaparte Hardin his heirs and assigns they the said Alexander McClelland and Bathsheba his wife -------- time or time hereafter upon reasonable notice and at proper costs and charges in the ----- -- said Bonaparte Hardin directed make or execute any further or other deed or deeds to him the said Bonaparte Hardin his heirs or assigns for the more secure and perfect conveying the above or within mentioned and described tract of land and premises to the said Bonaparte Hardin his heirs or executors administrators or assigns as shall by him or them Council learned in Law be reasonably advised devised or required. In Witness Whereof they the said Alexander McClelland and Bathsheba his wife hath hereunto set their hands and seals the day and year first above written Signed sealed and delivered in Alexander McClelland, (Seal) presence of: John M. It is to be remembered that three fifths of Richard Poundstone the grain now sowed on the place is ThomasCrozier reserved for Richard Poundstone Fayette County S.S. Before me the subscriber a Justice of the Peace in and for the County of Fayette aforesaid personally came the within named Alexander McClelland & Bathsheba his wife who do acknowledge the forgoing Indenture to be their, act and deed, she the said Bathsheba having been by me examined apart from her said husband touching the same as by law directed. Given under my hand and seal the third day of December 1836. Wm Abraham Recorded and Compared Dec. 8th 1836 Fayette County S.S. Before me the siubscriber one of the Justices of the Peace in and for said County personally came the within named Alexander McClelland & Bathsheba his wife and acknowledged the within indenture to be their act and deed and desired that the same might be recorded as such, she the said Bathsheba being of full age and by me examined separate and apart from her said husband declared that she signed the same of her own free Will and accord without any coercion or compulsion from her said husband and declared that the same as such may be recorded.
