Indenture of Mortgage to James Hibben 1808. WHEREAS the Commonwealth of Pennsylvania by patent on the twenty sixth day of March in the year of our Lord one thousand seven hundred and eighty eight did grant unto Jacob Beeson a certain tract of land called "Mount Vernon" situated in Union Township Fayette County who for the __________ of the inhabitants of the Town of Union laid out a part of Mount Vernon aforesaid into lots the same being adjacent to the original map of Union and called it Jacob's Addition And whereas the said Jacob Beeson and Elizabeth, his wife, by indenture dated the twenty fifth day of April in the year of our Lord one thousand seven hundred ninety six conveyed the following divided lot of ground situated in addition aforesaid known and distinguished on the General Plan of said Town by the number twenty three unto Isaiah Stevens Viz. Beginning on the North side of Elbow Street at the South West corner of lot twenty two thence then Westward by the North side of Elbow Street seventy two feet and a half to the corner of Henry Beesons hill house lot thence by the same Northward one hundred and fifty feet to Peter Street thence by the South side thereof Eastward seventy two feet and an half to the Northward corner of lot twenty two thence by the same Southward one hundred fifty feet to the beginning. The afterrecorded and Catherine his wife conveyed the same unto James Hibbin of the town of Union Waggon maker and Whereas the said James Hibben by his obligation in writing under his hand and seal bearing equal dates to those present hands bound unto Ephriam Douglas Esquire in the sum of four hundred dollars condition for the payment of two hundred dollars lawful money with legal interest from the date hereof on or before the sixth day of February which will be in the year of our Lord one thousand eight hundred and nine. Now this Indenture Witnesseth that the said James Hibben for the better surviving the payment if the aforesaid sum of two hundred dollars, the real debt with the interest growing due theron And as well for and in consideraton of the sum of one dollar to him paid at the sealing and delivery _____ said Ephriam Douglas Esquire the receipt is hereby acknowledged Hath granted bargained and sold and by these presents do grant bargain and sell unto the said Ephrian Douglas Esquire the before conveyed and described lot of ground as _______ to have been conveyed from the before pro___ Isaiah Stevens unto the said James Hibben To Have and To Hold the same with apperturences unto the said Ephriam Douglas his heirs and assigns forever. Provided always and in the Intent and meaning to the parties herein before mentioned that if the said James Hibben his certain attorney his executors or administrators shall well and truely pay or cause to be paid unto the said Ephriam Douglas or to his attorney duly authorized his executors administrators or assigns the before mentioned sum of two hundred dollars with the interest thereon due conforming to the tennor of the before obligatory writing or obligation and that without fraud defalcation or abatement that then and from thenceforth as will the said obligation will be void as every matter and thing therein or in the foregoing Indenture contained shall cause any thing mentioned therein to the contrary notwithstanding As Witness thereof the said James Hibben hath hereto set his hand and seal the tenth day of February in the year of our Lord one thousand eight hundred eight. Received on the day of the date of the foregoing Indenture of Mortgage of the within named Ephriam Douglas Esquire one dollar the consideration therein mentioned (signed) James Hibben Sealed and delivered James Hibben in presence of Morris Morris } Fayette County Pa the tenth day of February Annos Morris Morris Domini 1808 Personally appeared before me the subscriber Joseph W___ a Justice of the peace in and for said county James Hibben and acknowledged the foregoing Indenture of Mortgage to be his act and deed given under my hand and seal the same day James Allen RECORDED AND COMPARED the 30 " day of March 1808 The thirteenth day of April in the year of our Lord one thousand eight hundred thirteen personally came Ephriam Douglas Esquire and acknowledged that he had received full satisfaction in the above mortgage Witness my hand same day Alexander McLean Recorder Note: Mortgage retired 1813
