James and Isabella Hibben to James Fletcher 1813. WHEREAS the Commonwealth of Pennsylvania by Patent dated the twenty eighth day of March in the year of our Lord one thousand seven hundred eighty eight did grant unto Jacob Beeson a certain tract of land called "Mount Vernon" situate adjacent the Original Town of Union Township Fayette County. Who together with Elizabeth his wife by indenture dated the twenty fifth day of April in the year of our Lord one thousand seven hundred and ninety six did grant bargain and sell unto Isaiah Stephens a certain Lot of ground, part of that part of "Mount Vernon" which the said Beeson had laid out Lots as and for Town Lots, adjoining Union Town aforesaid called "Jacobs Addition" which lot is distinguished on the plan of said "Addition" by the number twenty three and bounded and therein described as follows "Viz" Beginning on the North side of Elbow Street at the Southwest corner of Lot No. twenty two thence westward by the North side of Elbow Street seventy two feet and a half to the Corner of Henry Beeson's Millhouse Lot thence by the same Northward one hundred and fifty feet to Peter Street; thence by the South side thereof Eastward seventy two feet and a half to the Northwest corner of Lot No. twenty two thence by the same southward one hundred and fifty feet to the beginning. Subject to certain covenants in the said Indenture stated at large which by s ing thereto will fully appear -- And whereas the said Isaiah Stephens and Catherine his wife by Indenture dated the fourteenth day of November in the year of our Lord one thousand eight hundred and five conveyed the same lot of ground and premises to James Hibben subject to the former rules and intentions as the said Isaiah and Catherine his wife held the same, as mentioned in the Indenture above referred to "Viz" from Jacob Beeson and Elizabeth his wife to the said Isaiah Stephens. See Book C pages 95 & 96 in which the same is entered of Record --- Now this indenture WITNESSTH that the said James Hibben and Isabella his wife for and in consideration of one thousand Dollars to them paid by James Fletcher of the Town of Union the receipt whereof is hereby acknowledged. Have granted bargained and sold unto the said James Fletcher his heirs and assigns the before mentioned and described lot of ground and premises with the appurtenances. To Have and To Hold the same unto the said James Fletcher his heirs executor administrators or assigns power freely and clearly acquitted accounted and discharged from the effect of any judgment obtained against the granting party of any mortgage by them or either of them given or any encumbrance by them or either of them suffered prior to the date of the present by means of which a good and sufficient title in fee simple to the said lot of ground and premises with the appurtenances thereto of right belonging may or might at any time hereafter be embarrassed. And subject to the reservations, Covenants and Restrictions in the before mentioned Indenture from said Beeson and Elizabeth his wife to the before mentioned Isaiah Stephens -- to which reference has be before had, [ altho the same has not yet been recorded ] WITNESSETH whereof the granting party to these presents have set their hands & seals the day the third day of April in the year or our Lord one thousand eight hundred and thirteen Signed and dated Received the day of the date of foregoing James Hibben in presence of of the within named James Fletcher the Isabella Hibben John Patrick sum of One thousand Dollars the Wm McClelland,Jr. consideration therein mentioned. McClelland, Jr. --- Fayette County Pa. -- The third day of April Anno Domini one thousand eight hundred and thirteen before me the subscriber one of the Justices of the peace in and for said County Personally came James Hibben & Izabella his wife and Acknowledged the foregoing Indenture to be their Act and Deed the said Izabella having been previously commended in the Law in such case directs Given under my hand & seal the same day (signed) Thos.
