Installment sale by Thomas & Mary Hibben to James C. Seaton in 1814. THIS INDENTURE made the twelfth day of February in the year of our Lord one thousand eight hundred and fourteen between James C. Seaton and Elizabeth his wife of Union Town in the County of Fayette of the one part and Thomas Hibben of the same place of the other. WHEREAS the said James C. Seaton in and by five several writing Obligations under his hand and seal bearing even date herewith standeth bound unto the said Thomas Hibben in the sum of five thousand dollars conditioned for the payment of twenty five hundred dollars in the following manner to wit five hundred dollars with interest on the first day of April 1815, five hundred dollars on the first day of April 1816, five hundred dollars on the first day of April 1817 - Five hundred dollars on the first day of April 1818 and the sum of five hundred dollars on the first day of April 1819 as in any by the said obligations and conditions thereof relation being thereunto had more fully and at large appears. NOW THIS INDENTURE WITNESSETH that the said James C. Seaton and Elizabeth his wife as well for and in consideration of the aforesaid debts or sums of money of the two thousand five hundred dollars and the interest thereon and during the payment of the same to the said Thomas Hibben his executors administrators and assigns in discharge of the said recited obligations as the further sum of one dollar to them in hand paid by the said Thomas Hibben the receipt whereof is hereby acknowledged HAVE granted bargained and sold and by their presents DO grant bargain and sell unto the said Thomas Hibben his heirs and assigns all that certain Lot of ground known and distinguished in that part of Jacobs Addition to Union Town by Number twenty one and the same now sold by Thomas Hibben to the said James C. Seaton. To Have and To Hold the said Lot of ground with the appurtenances unto the said Thomas Hibben his heirs and assigns to the only proper use and behoof of the said Thomas Hibben his heirs and assigns forever. Provided always nevertheless that if the said James C. Seaton his heirs executors or administrators shall and do well and truly pay ______ __ unto the said Thomas Hibben his executors administrators or assigns the debt or sum of money of two thousand five hundred dollars on the days and times herein before mentioned with the interest thereon according to the conditions of the said recited obligations without any fraud or further delay then and from the thenceforth as well this present Indenture and the estate hereby granted as the said recited obligations shall cease determine and become null and void to all intents and purposes anything heretofore contained to the contrary in any wise notwithstanding. Witness whereof the said James C. Seaton and Elizabeth his wife have thereunto set their hands and seals the day and year aforesaid James C. Seaton and Elizabeth his wife and acknowledged the foregoing Mortgage to be their act and deed she the said Elizabeth having been examined separate and apart for her said husband declared that she of her own voluntary will seal and as her act and deed deliver the same without any condition or compulsion of her said husband the contents thereof having been made known to her Given under my hand and seal the same day James Lindsay RECORDED AND COMPARED 12TH April 1814
