Indenture from Thomas & Mary Hibben to William Lyon in 1824. This Indenture made and concluded this tenth day of June in the year of our Lord one thousand eight hundred and twenty four by and between Thomas Hibben and Mary his wife of German Township Fayette County and state aforesaid of the one part and William Lyon of Union Town County and state aforesaid of the other part Witness that the said Thomas Hibben and Mary his wife for and in consideration of the sum of six hundred dollars heretofore paid by John Lyon Esq. of Union Town County and the state aforesaid who purchased the herein after described premises from Thomas Hibben and in the further consideration of the said William Lyon having purchased the same at Sheriff's sale as the property of the said John Lyon and in fulfillment of the contract of the said Thomas Hibben with the said John Lyon. Have granted, bargained and sold and by these presents do grant bargain and sell unto the said William Lyon his heirs and assigns the following described lot or piece of ground Beginning at the stones a. _____ Allen now David Ewings thence by the fence North Eighty four degrees thirty seven and one half minutes for forty two perches to a stone Thence by the fence South five degrees twenty two and a half minutes there to one perch to a stone Thence north eighty four degrees thirty seven and one half minutes West twenty five perches to a post in the line of William Bromfield line now David Ewings a little below the head of a spring Thence by the same south five degrees twenty two and a half minutes west thirty seven perches and three tenths to a post in the line of John Woods now Seth Woods land formerly Thomas McLaughlin Thence by the same and Isaac Sutton, now also Seth Woods land and South forty three degrees seven and one half minutes east twenty eight perches and six ______ to a post a. corner of Philip Kerekhaumers lot, Thence by the house and two other lots purchased by William McClelland and John Collins of Henry Tomlinson and wife and Joseph Tomlinson North five degrees twenty two and one half minutes east fifty six perches and three tenths to a corner of John Collins's lot thence by the same South eighty four degrees thirty seven and one half minutes East fifty perches to stones one perch westward of the line of division between said Tomlinsons land and the adjacent tract formerly Samuel McCoys now John Millers, thence North five degrees twenty two and a half minutes East one perch to the beginning. Containing six acres one half and twenty two perches strict measure with the appurtenances _____ _____ _____ which Henry Tomlinson and wife and Joseph Tomlinson by Indenture dated ____ day of November in the year of our Lord one thousand eight hundred and seven Conveyed to Thomas Hibben in fee simple for the Consideration therein mentioned all which _____ ____ fully appear by reference to the said Indenture recorded in the Office for recording of Deeds for Fayette County in Book F, page 199 And also the following described Lot or piece of ground Beginning at a post a. ___ of _____ of John Collins lot formerly M____ F___ thence by the same North eighty four degrees and three quarters West forty _____ ____ ___ Thence by the before described lot South five degrees and one quarter West eight perches to a post Thence South eighty four degrees and three quarters East forty perches to a post one perch west of the division line heretofore mentioned in the Deed between the Tomlinsons and James McCoy now John Miller Thence North five degrees and one quarter East eight perches to the beginning. Containing two acres strict measure being the same which Henry Tomlinson and Joseph Tomlinson did by Indenture dated the twenty seventh of February one thousand eight hundred and four did convey in fee simple to William McClelland who with Rachel his wife by Indenture dated the eleventh day of September one thousand eight hundred and five convey the same to John ______ in fee simple who by Indenture dated the seventh day of January one thousand eight hundred and six conveyed the same to John Phillips in fee simple who together with his wife by Indenture dated the Eighteen of May one thousand eight hundred and seven conveyed the same in fee simple to the said Thomas Hibben all which will more fully appear on reference to the Records of deeds of said County in Book E, page 230, Book G, page 119 and 130, Book H, page 185. To Have and To Hold the above severally describes tracts or parcels of land with all and singular the Gen_____ He__ amounts and appurtenances thereunto belonging unto the said William Lyon his heirs and assigns to the only proper use benefit and behoof of the said William Lyon his heirs and assigns aforementioned the said Thomas Hibben for himself his heirs executors and administrators doth hereby covenant to and with the said William Lyon his heirs and assigns to warrant and defend the Estate and Title hereby conveyed and intended to be conveyed against him the said Thomas Hibben and his heirs and assigns and all persons whomsoever lawfully claiming or that may here after claim the same. In testimony where of the granting party have hereunto set their hands and seals the day and year first above written. Sealed and delivered in presence of Thomas Hibben James Lindsay Fayette County Pa her Wm. Eberts Mary * Hibben mark Be it remembered that on the tenth day of June AD 1824 Thomas Hibben and Mary his wife grantors in the foregoing Indenture named personally appeared before me James Lindsay one of the Justices of the peace in and for the county of Fayette and acknowledged the foregoing Indenture as their act and deed. The said Mary having been by me previously made acquainted with the contents of said Indenture and examined separate and apart from her said husband thereupon declared that she did voluntarily of her own free will and accord sign and seal and as her action did deliver the said Indenture without any compulsion or influence from her said husband.
